The subject site is located south and west of the intersection at West Rio Salado Pkwy and West 1st Street and is in the Brighton Place Terrace 1 Subdivision, part of the F W Industrial Park. Surrounding uses include office, industrial, and warehouse uses to the north, east, and west, and south. The site and all adjacent properties are zoned General Industrial District or GID. The site includes two multi-tenant industrial buildings; the subject tenant is in the northern building. Suite 107 fronts West 1st Street and is 1,353 square feet in size. It shares off-street parking with other tenant suites in a paved lot with one hundred-thirteen (113) spaces at the south end of the site. The proposed business is a fitness studio which will include an office, restroom, reception area, and work- out space with exercise equipment. The applicant and one other employee will operate the suite and instruct small groups of up to fifteen (15) guests at a time, with a more regular class size of five (5) individuals. The applicant is requesting the Development Review Commission take action on: ZUP250116 Use Permit to allow a fitness center in the GID zoning district. PUBLIC INPUT Staff has not received input from the public regarding this request as of the publication of this report. USE PERMIT The proposed use requires a Use Permit to allow a fitness center within the GID zoning district. Section 6-308(E) Approval criteria for Use Permit (in italics): 1. Any significant increase in vehicular or pedestrian traffic; while the proposed use will result in an increase in vehicular trips to the subject site, such traffic is not anticipated to be significant in nature, and the site contains sufficient parking to accommodate the additional vehicles. Hours of operation are limited to appointment only, small groups of 5-15 persons. 2. Nuisance arising from the emission of odor, dust, gas, noise, vibration, smoke, heat or glare at a level exceeding that of ambient conditions; no external nuisances exceeding ambient conditions are anticipated as a result of this use. The fitness center will use speakers inside the tenant space but are not expected to be disruptive to adjacent tenants during their hours of operation. 3. Contribution to the deterioration of the neighborhood or to the downgrading of property values, PL250423 – FGFC FITNESS STUDIO Page 2 January 27, 2026 which is in conflict with the goals, objectives or policies for rehabilitation, redevelopment or conservation as set forth in the city’s adopted plans or General Plan; the peak hours of use will provide more visual surveillance of the area in evening and weekend hours, which activates the site and surrounding area, and represents new investment in a currently vacant suite. 4. Compatibility with existing surrounding structures and uses; the proposed use would utilize a similar office-warehouse configuration as other tenants and appears to be compatible with other uses, which include office, manufacturing users, and logistics businesses. The nearest fitness center to the site is more than a mile away. 5. Adequate control of disruptive behavior both inside and outside the premises which may create a nuisance to the surrounding area or general public; the fitness studio is by appointment only. Only staff will have keys to the suite; visitors will not be able to enter at-will. All small classes will be led by trainers during hours of operation. REASONS FOR APPROVAL: Based on the information provided by the applicant, the public input received, and the above analysis, staff supports approval of the requested Use Permit. This request meets the required criteria and will conform to the conditions. SHOULD AN AFFIRMATIVE ACTION BE TAKEN ON THIS REQUEST, THE FOLLOWING NUMBERED CONDITIONS OF APPROVAL SHALL APPLY, BUT MAY BE AMENDED BY THE DECISION-MAKING BODY. CONDITION(S) OF APPROVAL: (Non-standard conditions are identified in bold) EACH NUMBERED ITEM IS A CONDITION OF APPROVAL. THE DECISION-MAKING BODY MAY MODIFY, DELETE OR ADD TO THESE CONDITIONS. 1. Hours of operation shall begin no earlier than 5:00 a.m. and end no later than 7:00 p.m. 10:00 p.m. Monday – Sunday. 2. The Use Permit is valid only after a Building Permit has been obtained, the required inspections have been completed, and a Final Inspection has been passed. As part of the Building Permit process, on-site storm water retention may be required to be verified or accomplished on this Site. 3. The Use Permit is valid for the plans as submitted within this application. Any additions or modifications may be submitted for review during the building plan check process. 4. If there are any complaints arising from the Use Permit that are verified by a consensus of the complaining party and the City Attorney’s office, the Use Permit will be reviewed by City staff to determine the need for a public hearing to reevaluate the appropriateness of the Use Permit, which may result in revocation of the Use Permit. To avoid unnecessary review time and reduce the potential for multiple plan check submittals, become familiar with the ZDC. BUILDING & FIRE CODES: Any modifications to the buildings involving mechanical, electrical, plumbing or structural tenant improvements that would require a building permit must obtain required permits. SIGNS: Separate plan review process is required for signs in accordance with requirements of ZDC Part 4 Chapter 9 (Signs). Refer to www.tempe.gov/signs. BUILDING AND SITE MODIFICATIONS: Modifications to the building and site require review and approval by City of Tempe Community Development through the Development Plan Review Process. USE PERMIT: The Use Permit is valid for Feel Good Fitness Club and may be transferable to successors in interest through an administrative review with the Community Development Director, or designee. The Use Permit approval shall be void if the use is not commenced or if an application for a building permit has not been submitted, whichever is applicable, within twelve (12) months after the use permit is granted or within the time stipulated by the decision-making body. Specific requirements of the Zoning and Development Code (ZDC) are not listed as a condition of approval but will apply to any application. To avoid unnecessary review time and reduce the potential for multiple plan check submittals, become familiar with the ZDC. Access the ZDC through http://www.tempe.gov/zoning or purchase from Development Services. Any intensification or expansion of use shall require a new Use Permit. All required permits and clearances shall be obtained from the Audit and Licensing Division of the City of Tempe prior to the Use Permit becoming effective. HISTORY & FACTS: May 6, 1987 The Design Review Board approved the building elevations, site plan, and landscape plan for HARBOR VIEW WAREHOUSING, located at 2209 West 1st Street in the I-2, General Industrial District. (DRB87.105) March 21, 1988 Tempe Building Permit 82204 was issued, approving the construction of the two shell industrial buildings. July 17, 1990 Tempe Building Permit 82204 completed construction and was issued a certificate of occupancy. December 2, 2025 Applicant submitted documents requesting a Use Permit for a Fitness Studio at the subject site. January 27, 2026 Development Review Commission is scheduled to hear this request for a Use Permit to allow a fitness center in the GID zoning district.
