ACTION: Request a Variance to allow a reduction of the side yard setback from 5 feet to 2 feet for a 
detached accessory building in the R1-6 district for WEED RESIDENCE, located at 1309 East Orange 
Street. The applicant is Kate Hartley Weed. (PL250279)
FISCAL IMPACT: There is no fiscal impact on City funds.

BACKGROUND INFORMATION:  WEED RESIDENCE (PL250279) is located on the south side of 
East Orange Street on Lot 39 of the Carlson Park Subdivision in the University Heights Neighborhood 
Association boundary. The applicant and property owner, Kate Hartley Weed, is requesting a reduction 
to the side (east side) setback from 5 feet to 2 feet for a detached accessory building that was 
constructed without building permits in the mid 1990’s. Historic aerial photography shows the building 
was constructed between 1993 and 1996. The current owner purchased the property in 2013 and is 
looking to obtain a variance to bring the property into compliance. The request includes the following:
VAR250008 Variance to reduce the side yard setback from 5’ to 2’ for an existing detached accessory 
building.
