Agenda Item 1 – Public Appearances 
No public appearances. The Council Subcommittee votes to approve the minutes from the July 
25, 2025 meeting. 
 
Agenda Item 2 – Tempe Police Presentation on Current Drink Spiking Procedures 
Tempe Police, Lieutenant Bacon reported that in in 2024, there were 23 reported cases of drink 
spiking in Tempe, three of which occurred on Mill Avenue. Forensic nurse examination kits 
could not be conducted in 15 of these incidents. He emphasized that negative test results 
should not be interpreted as disproving drink spiking, since the body metabolizes these 
substances very quickly. 
 
When the police department learns of an incident, the bike squad typically serves as the point of 
contact, conducting interviews, using test strips, reviewing surveillance footage, and leading the 
investigation. Tempe Police will need to work with the Maricopa County Attorney’s Office to 
determine what types of test strips could support criminal charges. More comprehensive testing 
may also be available through forensics labs; Mesa Labs currently offers such services. Under 
ARS 13-1205, unlawfully administering liquor or dangerous drugs without consent constitutes 
drink spiking and can be charged as either a class 5 or class 6 felony. 
 
For community engagement, Tempe Police identified several opportunities, including outreach 
to high school students, education for bar owners, developing security plans, providing signage 
for bars, neighborhood outreach, and engaging ASU classrooms and Greek Life. Tempe Police 
also noted that they do not currently carry drink spiking test kits. A posted sign at bars and 
restaurants with enforcement authority would strengthen their ability to make arrests. They 
expressed support for this effort, stating it will be a beneficial program to prevent crime and 
identify perpetrators. They are willing to lend their assistance in standing up the program. 
 
The group also discussed including ASU Police in future conversations. 
 
Agenda Item 3 – Tempe Coalition Presentation on Public Health Education Campaigns, 
Bernadette Coggins 
The Tempe Coalition has long focused on youth substance-use prevention, working with 
parents, businesses, law enforcement, and faith groups to connect residents to resources. 
Since 2009, the Coalition has led efforts around marijuana, tobacco, and alcohol prevention, 
and contributed to Tempe’s tobacco ordinance raising the legal age of use. Recent work has 
centered on reducing stigma around opioid addiction and providing community events with

supportive resources. 
 
Funded largely through grants, the Coalition expressed interest in aligning some of its resources 
with the subcommittee’s work. The Coalition noted they could support through literature, 
outreach campaigns, community engagement, and events. Council Subcommittee members 
welcomed the partnership, recognizing the Coalition’s track record of effective citywide 
initiatives. 
 
Agenda Item 4 – Update on Stakeholder Engagement, Keaton Hill 
Between subcommittee meetings, Councilmember Keating and staff met with Dr. Aaron D. 
Krasnow, Associate Vice President at ASU Counseling Services, and Marlissa Valenzuela, 
Planned Parenthood Gen Action ASU Chapter Lead. Both expressed support and willingness to 
assist the subcommittee’s work. The group discussed potential elements of a drink spiking 
ordinance. Provisions could require establishments to sell drug testing kits, either at cost, at up 
to 20% of market value, or free of charge. Establishments would also need to post signage, 
ensure kits are not expired, and would not be held liable for inaccurate results. The 
subcommittee will hold public meetings on Wednesday, Dec. 10, with sessions scheduled at 
noon and 6 p.m. at the Tempe Public Library. The group brainstormed possible Boards and 
Commissions to run an ordinance through, considering the Mayor’s Youth Advisory Board, the 
Neighborhood Advisory Board, and the Tempe Family Justice Commission, among others. 
Looking ahead, the Council Subcommittee intends to meet on the last Friday of each month 
through February, at which point it expects to be prepared for Council action. 
 
Agenda Item 5 – Input from Staff and Stakeholders 
Councilmember Keating prioritized drink test kits but supported adding drink covers to the 
ordinance. The Council Subcommittee emphasized stakeholder input while keeping the timeline 
on track and agreed to work with the City Attorney on a draft ordinance.
