Agenda Item 2 – Ordinance Draft Presentation - Eric Anderson, City Attorney The presentation focused on reviewing existing law surrounding drink spiking, identifying city goals, and outlining a potential ordinance to enhance protections and supplement enforcement. The group discussed using the ordinance recitals (“Whereas” statements) to establish broader goals, such as protection, incentives, and promotion of public health. A natural placement for the ordinance would be within the security plans already required by the Tempe Police Department. As currently written, the ordinance applies to bars, cocktail lounges, taverns, dance clubs, and nightclubs. The group agreed that adult entertainment venues should also be included. Security plans would recommend that establishments offer drink lids for free, while test kits would be mandatory. Establishments can charge up to 120% of the cost for kits. Clear signage would be required in visible areas, with multiple versions of the signs developed to fit different venues. Businesses that fully participate by offering free lids and kits would qualify for a 25% license fee rebate. The ordinance would also require reporting of drink spiking incidents, provide flexibility for Tempe Police to adapt the program as needed, and ensure kits are stored at district locations. The group discussed whether to include hotel bars in the ordinance, with a decision deferred until engagement with Tempe Tourism takes place. Councilmember Hodge raised concerns about the financial burden on establishments. Members clarified that the ordinance does not impose mandatory costs, but instead offers fee reductions as incentives. Danya from KnoMore added that her nonprofit is willing to cover program costs for the first year. Deputy City Manager Lissette Camacho will work with the City Attorney’s Office and Tax/License to estimate the fiscal impact of providing fee refunds. Finally, Shirah from NightCap shared her organization’s role in providing drink covers to bars and nightclubs and noted their advocacy experience, including direct lobbying in California, where they were a key voice in passing similar legislation. Agenda Item 3 – Presentation on Test Kits, Drink Covers, and Campus Engagement – Danya Sherman, KnoMore Danya, Executive Director of KnoMore, presented several resources that could support a drink spiking prevention program, including signage, drink covers, and test kits. She shared a video demonstrating a one-minute test kit, priced at $5 per unit, which can detect 12 different types of drugs. The kits function similarly to COVID tests in the way they display results. Danya also highlighted a range of drink cover options, such as reusable covers, sticker covers and can covers. In her remarks, she emphasized the importance of data collection and stressed that any city-led prevention program should include a clear reporting component. Agenda Item 4 – Input from staff and stakeholders Keaton Hill, Assistant to Councilmember Keating, provided a brief update on stakeholder development. He has been in discussions with several bars and restaurants, including University Grill and Outlaw Distillery. Outlaw expressed strong interest in supporting the initiative in any way possible, and initial conversations have also begun with Pedal Haus. Danya and Keaton are coordinating with ASU Student Government and Planned Parenthood to potentially host a table next month. Dr. Aaron Krasnow also expressed interest in helping engage Greek Life. A recommended outreach approach was discussed: Councilmember Keating would connect with fraternities, while Vice Mayor Garlid and Councilmember Hodge would reach out to sororities. The goal would be to lobby for their support, connect them with KnoMore, and encourage participation either at Council subcommittee meetings or in media outreach. Agenda Item 5 – Future Agenda Items The subcommittee recommends no future agenda items. Agenda Item 6 - Adjourn The next meeting will be held on Oct. 31, 2025.
