REQUEST FOR COUNCIL ACTION

ACTION:  PUBLIC HEARING ITEM Hold a public hearing to recommend the approval of a Series 12 
Restaurant Liquor License for Rite Yah Suh Jamaican Vibez LLC, dba Rite Yah Suh Jamaican Vibez, 
located at 502 South College Avenue, Tempe, AZ  85281.
FISCAL IMPACT:  No fiscal impact.
RECOMMENDATION:  Recommend approval of this application noting the applicant must resolve 
any pending City of Tempe building and zoning requirements to be in compliance with the City of Tempe 
Ordinances.
 
BACKGROUND INFORMATION:  Clifton Joel Bartley is the agent for this application. State License 
Application 374134. This application is for a new liquor license for a new establishment at a location 
where a previous liquor license was held.
Tempe City Code requires that the Financial Services Department, as designated agent of the City Clerk, 
shall submit recommendation requests to the Police Department, Fire Marshal, and the Community 
Development, to ensure the establishment meets minimum city code licensing criteria. 
Community Development has conditionally approved this application: The site is zoned CC City Center 
and allows restaurant uses. Pursuant to A.R.S. § 4-224, Zoning shall not be a basis for protesting or 
denying a license.
Pursuant to A.R.S. § 4-201, the premise has been posted for the required 20-day period. No protest or 
support letters were received regarding this liquor license application. 
The City Council has the option of recommending approval, disapproval or no recommendation to the 
Arizona Department of Liquor Licenses and Control (DLLC).  A recommendation for disapproval or “no 
recommendation”  will require a hearing by the State Liquor Board.  A hearing is also required if the 
application is protested by the DLLC Director or a member of the public.
The City Council’s recommendation will be forwarded to the DLLC for their consideration. The State 
Liquor Board has the legal authority to make the final determination on whether to approve or deny the 
license.
