Owens Residence 
Letter of Explanation 
This pertains to a detached garage build on the right rear of the lot of the single family 
residence at 27 W Duke Dr. Tempe, AZ 85283. The house sits high in relation to the grade 
height at the roll curb. Due to this, the height of the ridge correspondingly increases to 
17.5-18 feet and would not fit within the normal set back requirements. I am requesting a 
use permit standard to reduce the side set back of an accessory structure from 9’ to 5’ and 
a use permit to allow increased height of an accessory structure to 18’. The primary home 
has been recently remodeled. The original carport has been enclosed and no longer allows 
for covered parking. (a) There would be no additional impact on vehicular or pedestrian 
traffic because of the garage as it will be behind our gate in the corner of our lot. (b) Due to 
the original carport being enclosed the building would be used as a garage and would not 
lead to any additional noise, nuisance, or emissions above normal ambient conditions and 
the majority of the structure would not be visible from the street. (c) The garage would 
maintain the same look as our recently remodeled house (white lap siding with black roof) 
and would only offer to enhance the look of the neighborhood and our newly remodeled 
home. (d) The garage is entirely in a residential neighborhood would allow us to limit the 
total amount of cars in the driveway at any one time and allow for more space to keep our 
trash cans behind our gate and out of view of the street. (e) There would be no disruptive 
behavior  inside or outside of the premises as a result of the garage being built.
