This application is for a 48,000 SF building for the fabrication of metal products to include manufactured homes, modular homes, commercial buildings, park model RF’s and vacation cabins. The site is located on 38.5 acres of vacant land located .25 miles west of Dysart Road on Joe R. Ramirez Road, El Mirage, AZ. The parcel in which the building is to be located is entirely inside APZ 2, “high noise or accident potential zone” as identified by A.R.S. § 28-8461 and is within the “territory in the vicinity of a military airport” also defined by A.R.S. § 28-8461. This request, as described in the narrative, will not negatively impact the flying operations at Luke AFB as long as A.R.S. § 28-8482 is followed. Furthermore, please ensure an FAA Obstruction Evaluation / Airport Airspace Analysis form is filed, if required (talking paper attached). If this development is approved, we recommend you review the sound attenuation requirements found in ARS. § 28-8482. In addition, a strong notification program on the part of the applicant would be essential to inform potential residents about Luke AFB operations. Walker, Vice Commander, 56th Fighter Wing Ms. Cindy L, Allen, GS-13, General and Environmental Law Attorney, 56th Fighter Wing FAA Obstruction Evaluation / Airport Airspace Federal Aviation ; ) Administration Analysis (OE/AAA) In administering Title 14 of the Code of Federal Regulations (14 CFR) Part 77, the prime objectives of the FAA are to promote air safety and the efficient use of the navigable airspace. To accomplish this mission, aeronautical studies are conducted based on information provided by proponents on an FAA Form 7460-1, Notice of Proposed Construction or Alteration. Advisory Circular 70/7460-1L Change 1, Obstruction Marking and Lighting, describes the standards for marking and lighting structures such as buildings, chimneys, antenna towers, cooling towers, storage tanks, supporting structures of overhead wires, etc. OE/AAA Filing Process If your organization is planning to sponsor any construction or alterations which may affect navigable airspace, you must file a Notice of Proposed Construction or Alteration (FAA Form 7460-1) either electronically via this website or manually with the FAA. Who Needs to File 14 CFR Part 77.9 states that notice must be filed with the FAA if requested by the FAA or when anyone proposes any of the following types of construction or alteration: e any construction or alteration exceeding 200 feet above ground level e any construction or alteration that exceeds an imaginary surface extending outward and upward at any of the following slopes: o 100to1 fora horizontal distance of 20,000 ft. from the nearest point of the nearest runway of each airport described in 14 CFR 77.9(d) with its longest runway more than 3,200 ft. in actual length, excluding heliports. o 50 to 1 fora horizontal distance of 10,000 ft. from the nearest point of the nearest Tunway of each airport described in 14 CFR 77.9(d) with its longest runway no more than 3,200 ft. in actual length, excluding heliports. o 25 to 1 fora horizontal distance of 5,000 ft. from the nearest point of the nearest landing and takeoff area of each heliport described in 14 CFR 77.9(d) e any highway, railroad or other traverse way for mobile objects, of a height which, if adjusted upward as defined in 14 CFR 77.9(c) would exceed a standard of 14 CFR 77.9 (a) or (b). e any construction or alteration located on an airport described in 14 CFR 77.9(d). The requirements for filing with the Federal Aviation Administration for proposed structures vary based on a number of factors: height, proximity to an airport, location, and frequencies emitted from the structure, etc. For more details, please reference CFR Title 14 Part 77.9. https://oeaaa.faa.gov/oeaaa/external/portal.jsp FAA Notice Criteria Tool You must file with the FAA at least 45 days prior to construction if: e your structure will exceed 200ft above ground level ® your structure will be in proximity to an airport and will exceed the slope ratio e your structure involves construction of a traverseway (i.e. highway, railroad, waterway etc...) and once adjusted upward with the appropriate vertical distance would exceed a standard of 77.9(a) or (b) * your structure will emit frequencies, and does not meet the conditions of the FAA Co- location Policy e your structure will be in an instrument approach area and might exceed part 77 Subpart C e your proposed structure will be in proximity to a navigation facility and may impact the assurance of navigation signal reception e your structure will be on an airport or heliport e filing has been requested by the FAA If you require additional information regarding the filing requirements for your structure, please identify and contact the appropriate FAA representative using the Air Traffic Areas of Responsibility map for Off Airport construction, or contact the FAA Airports Region / District Office for On Airport construction.
