D R A F T REGULAR MEETING OF THE COMMON COUNCIL OF THE CITY OF EL MIRAGE EL MIRAGE CITY COUNCIL CHAMBERS 10000 N. EL MIRAGE ROAD 6:00 PM -TUESDAY, OCTOBER 6, 2020 Minutes 1. ROLL CALL Present: Mayor Alexis Hermosillo; Vice Mayor Roy Delgado; Councilmember Monica Dorcey; Councilmember Anita Norton; Councilmember Kallimayor Richards; Councilmember David Shapera; Councilmember Donna Winston (online) 2. CALL TO ORDER - The meeting was held online and publicly with limited access; called to order at 6:00 pm. Pledge of Allegiance Moment of Silence 3. CALL TO THE PUBLIC Citizens desiring to speak on any issue within the jurisdiction of the public body may do so at this time. Comments shall be limited to three (3) minutes per person and shall be addressed to the City Council as a whole. At the conclusion of the Call to the Public, individual City Council Members may (1) respond to criticism made by those who have spoken, (2) direct staff to review or follow up on the matter, and/or (3) direct that the matter be put on a future agenda. El Mirage resident Brad Johnson stated the City had requested the dumpster located at their multi-unit property be placed within an enclosure per current code. Mr. Johnson further stated there have been issues with non-residents of this property dumping waste such as mattresses and couches in front of the dumpster and along the street. He requested the City approve to replace the dumpster with individual trash cans to try to resolve the problem. Mayor Hermosillo stated she would have the City Manager investigate the situation and a member of staff would get back to Mr. Johnson regarding this matter. 4. CONSENT AGENDA All items listed under the Consent Agenda will be voted on with one motion. If discussion is desired regarding any Consent Agenda Item, that item will be removed from the Consent Agenda and voted on separately. 1. Consideration and action to approve the minutes of the Regular Council meeting held Tuesday, September 22, 2020. (City Clerk) 2. Consideration and action to approve the destruction of municipal documents that have reached the end of their retention period as authorized under A.R.S. §41-151.19. (Police Department) 3. Consideration and action to extend contract EM20-INSP01 with Consultant Engineering, Inc. in the amount of $50,000 and approve the Finance Director to make necessary budget transfers. Consideration and action to authorize the City Manager to enter into a Professional Services Contract with bo ARCH L.L.C. to provide design services and construction documents for the Library Remodel / Relocation project (project # 62114) in an amount not to exceed $166,230.00, utilizing the Baboquivari Unified School District No. 40 Request for Qualifications for On-Call Professional Architectural Services RFQ # S.A.V.E. (Community Development) 6. Consideration and action to waive the formal bid process and approve contracts with Trim and Tidy and Brightview Landscaping for landscape maintenance at Basin Park, the Police Station, and the YMCA facility for the remainder of fiscal year 2020-2021 in an amount not to exceed $31,545. (Public Works) 7. Consideration and action to approve a contract with Dropcountr, Inc. to provide a real-time utility usage platform to residents and City staff in an amount not to exceed $30,000. (Public Works) 8. Consideration and action to approve addendum #6 short-term use of a vehicle for the agreement between Northwest Valley Family YMCA and the City of El Mirage. 9. Consideration and action to approve an agreement with Logic Compensation Group, LLC for a classification and compensation study, in an amount not to exceed $65,450. (Human Resources) Vice Mayor Delgado moved to approve Consent Agenda items 1 through 9 as presented; seconded by Councilmember Shapera. Vote: 7 - 0 Passed - Unanimously 5. REGULAR AGENDA 1. A Public Hearing, closure of Public Hearing followed by consideration and action to approve Resolution R20-10-18 for re-zoning a 6.4 acre parcel of land from Rural Area (RA) to Employment/Industry (E/I) located a quarter mile west of Dysart Road on Northern Parkway and declaring the Resolution and attached Exhibit "A" as a public record. (Community Development) Mayor Hermosillo opened the Public Hearing. Planner/GIS Jose Macias presented this item stating it is a request to approve Resolution R20-10-18 for the applicant Gammage & Burnham PLC, to re-zone the noted 6.4 acre parcel to Employment/Industry (E/I). Mr. Macias noted the parcel was annexed into the City on August 19, 2020, and re-zoned to Rural Area at that time. The 2010 General Plan designates this area as part of the Commerce/Industry Park planning area and is compatible with the General Plan Land Use Map. The applicant, on behalf of the landowner, is requesting the re-zoning of the 6.4 acres to match the adjoining 136 acres for future development. The Planning Commission recommended approval with a 4-0 vote. Mr. Macias introduced attorney Steve Anderson on behalf of the landowner John F. Long. Mr. Anderson advised Council the parcel was marooned by the construction of the Northern Parkway, which John F. Long acquired from Maricopa County, and annexed it to an already large successful Logistics Park, which includes Microsoft as the major user within the park. No public comments were received. Councilmember Norton asked Mr. Anderson if they had a prospecitive buyer for the parcel and Mr. 2 Regular Meeting - Council Minutes October 6, 2020 Anderson responded there were no potential buyers just now, and they anticipate the parcel to be purchased as part of a larger acquisition of land. Mayor Hermosillo closed the Public Hearing. Vice Mayor Delgado asked Mr. Macias if any land north of the parcel was owned by the City of El Mirage. Mr. Macias responded by identifying the land owned by the City on the presentation maps. Vice Mayor Delgado moved to approve Resolution R20-10-18 for re-zoning of a 6.4 acre parcel of land from Rural Area (RA) to Employment/Industry (E/I) located a quarter mile west of Dysart Road on Northern Parkway; seconded by Councilmember Shapera. Vote: 7 - 0 Passed - Unanimously 2. Consideration and action to approve Ordinance O20-10-06 for re-zoning 6.4 acres of land from Rural Area (R/A) to Employment/Industry (E/I) located a quarter mile west of Dysart Road on Northern Parkway and declaring a public record by reference in Resolution R20-10-18, including Exhibit A. (Community Development) Planner/GIS Jose Macias stated with Council approval of Resolution R20-10-18, this ordinance by reference to the resolution can be published without the attachments, per State law, thereby saving a substantial publishing cost. Vice Mayor Delgado moved to approve Ordinance O20-10-06 for re-zoning 6.4 acres of land from Rural Area (R/A) to Employment/Industry (E/I) located a quarter mile west of Dysart Road on Northern Parkway and declaring a public record by reference in Resolution R20-10-18; seconded by Councilmember Shapera. Vote: 7 - 0 Passed - Unanimously 6. CITY MANAGER'S COMMENTS & SUMMARY OF CURRENT EVENTS The City Council may not act upon any matter in the City Manager's summary but may have general comment or questions. City Manager Dyches announced the inauguration of the City's quarterly paper newsletter called the El Mirage Connect stating it would be going out to resident mailboxes this week. She expressed her appreciation to Marketing and Communications Coordinator, Ms. Kari Sliva for this coordinating this project. A digital monthly version of the newsletter is planned to start in the new year. Ms. Dyches also announced the extension of the Census data collection until October 31, 2020; allowing more residents to complete their census. Staff will be engaging with residents again at Food City on October 14 and 28 to encourage Census participation. 7. MAYOR'S COMMENTS and COUNCIL SUMMARY OF CURRENT EVENTS The Mayor and City Council may not discuss or act upon any matter in the summary unless the specific matter is properly noticed for legal action. Vice Mayor Delgado expressed his appreciation to the El Mirage Police Department. Mayor Hermosillo recognized Dysart High School for the A+ (Excellence) rating. 8.
