‘Trim & Tidy Landscape Maintenance

LANDSCAPE MANAGEMENT PROPOSAL

CITY OF EL MIRAGE BASIN PARK

PROJECT ADDRESS: EL MIRAGE AND CACTUS RD-EL MIRAGE, AZ 85335

The Trim & Tidy Landscape Service Specifications are hereby incorporated into this agreement
in accordance with the type and service as specified in the statement of work.

LANDSCAPE MAINTENANCE PROPOSAL

‘The purpose of this agreement is to set forth the terms and conditions under which Trim & Tidy
Landscape Maintenance will provide weekly landscape maintenance service for City of El Mirage
Basin Park.

Trim and Tidy will meet all requirements as specified in the Basin Park Landscape Maintenance
Contract (PW13-LMO1)

Trim & Tidy will furnish all labor and equipment necessary to perform the services outlined in the
SOW.

Customer agrees to promptly notify Trim & Tidy, in writing, of any dissatisfaction with
maintenance service to ensure that maintenance performed is satisfactory and concerns are remedied
timely.

Customer shall pay Trim & Tidy at a rate of $2500.00 dollars per month for service herein agreed to
by the SOW. Pricing is at a fixed rate for the term of this agreement and customer will not be
subject to a price increase unless there is a change of terms in writing. Trim and Tidy will bill the
customer and the customer shall make payment within 30 days of billing date.

The terms of this agreement shall commence on the Ist day of 2020 and shall continue in
full force for a minimum of 12 months, effective until the 1“ day of 2021. The contract may
be terminated by either party with a 30 day written notice. After the 12 month term, this agreement
may be modified and/or a new contract may be submitted for renewal.

Trim & Tidy guarantees that it will perform its services in a professional workmanlike manner.
Should the customer’s plantings be damaged by Trim & Tidy, damage would be repaired or replaced
by Trim & Tidy at no cost to the customer. Trim & Tidy shall not be liable for any damage due to
acts of God, nature, vandalism, or acts of third parties. Customer’s right to repair and replacement
are exclusive remedies and Trim & Tidy shall not be liable for damages as a result of work

This annual contract, when accepted and signed by you and approved by a duly
authorized official of this firm, shall constitute the contract between us, with it being
understood that it covers all agreements between us. No modifications of this proposal or
contract shall be binding unless said modifications are in writing and signed by the
parties hereto. This contract will renew automatically and either party may cancel with a
30-day notice sent by certified mail.
