STAFF REPORT 
Compliance with General 
Plan: 
The 2010 General Plan designates this area as part of the 
Commerce/ Industry Park Planning Area and is compatible with 
the General Plan Land Use Map. 
 
Considerations: 
The City of El Mirage currently has no zoning standards for 
regulating the cultivation of marijuana; such as building size 
limitations, distance restrictions from similar uses and emission 
regulations. The El Mirage Planning and Zoning Commission felt the 
lack of regulations could create a reputation for the City El Mirage 
to become a marijuana cultivation destination.    
 
As a directive from the Planning and Zoning Commission city staff 
is proposing the regulations mentioned in the attached resolution.   
 
All required documents and the public notification requirements 
for a public hearing have been met.  
 
ARS 28-8481 Land Use 
Compatibility 
The zoning district affected by the proposed zoning text 
amendment is located within the Luke AFB Noise Contour Zone. 
Development Applications for cultivation will be forward to Luke 
AFB for review for compatibility with A.R.S. §28-8481 Planning and 
Zoning; Military Airport and Ancillary Military Facility’s Operation 
Compatibility requirements when submitted for City approval.

Staff has reviewed the amendments and has no further 
comments.
