RESOLUTION R20-11-22 
 
A RESOLUTION OF THE MAYOR AND COUNCIL OF THE CITY OF EL 
MIRAGE, MARICOPA COUNTY, ARIZONA, AMENDING THE ZONING 
CODE OF EL MIRAGE ARIZONA BY ADOPTING A NEW CHAPTER 154.091 
MARIJUANA CULTIVATION FACILITIES REGULATIONS TO THE ZONING 
CODE USAGE VOLUME 2. 
 
WHEREAS, this Resolution has been properly noticed for public hearing pursuant to the 
requirements of El Mirage Zoning Ordinance and the statutes of the State of Arizona set forth in A.R.S. 
§ 9-462.03, A.R.S. § 9-462.04, and necessary hearings have been completed; and, 
 
WHEREAS, the City of El Mirage has limited zoning code or standards to regulate marijuana 
cultivation facilities operations; and, 
 
WHEREAS, the Planning Commission reviewed and recommended approval on October 13, 
2020, of the proposed Zoning Text Amendments, creating a new Chapter 154.091 Marijuana Cultivation 
Facilities Regulation; and,  
 
WHEREAS, the City Council desires to adopt Resolution R20-11-22 on November 5, 2020, to 
adopt a newly created Chapter 154.091 Marijuana Cultivation Facilities Regulations to the El Mirage, 
Arizona Zoning Code: Land Usage Volume 2; and, 
 
WHEREAS, the city seeks to protect and enhance public health, safety, and welfare by 
establishing a zoning code and standards to regulate marijuana cultivation facilities;  
 
NOW, THEREFORE, be it ordained, by the Mayor and Council of the City of El Mirage, 
Arizona, as follows: 
 
Section 1. 
That the Zoning Code of El Mirage, Arizona Zoning Code: Land Usage Volume 
2, is hereby amended by adding a new Chapter 154.091 Marijuana Cultivation 
Facilities Regulations which is newly adopted and made part of this Resolution as 
set forth in the attached Exhibit A; and, 
 
Section 2 
That the Zoning Code of El Mirage, Arizona Zoning Code: Land Usage Volume 
2, is hereby amended by revising Chapter 154.052 Permitted Uses By Zone which 
is revised and made part of this Resolution as set forth in the attached Exhibit B.
