AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE 
CITY 
OF EL 
MIRAGE, ARIZONA, 
AMENDING CHAPTER 
97 
(RECREATIONAL 
MARIJUANA), 
IN 
TITLE 
IX 
(GENERAL 
REGULATIONS) OF THE EL MIRAGE CITY CODE BY ADOPTING 
REASONABLE REGULATIONS TO PERMIT THE OPERATIONS OF 
MARIJUANA 
ESTABLISHMENTS 
AND 
MARIJUANA 
TESTING 
FACILITIES PURSUANT TO ARIZONA REVISED STATUTES § 36-2857. 
 
 
WHEREAS, Arizona Revised Statutes § 9-802 provides a procedure whereby a 
municipality may enact the provisions of a code or public record by reference, without setting forth 
such provisions, provided that the adopting ordinance is published in full, 
 
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the City of El 
Mirage, that: 
 
Section 1. 
The certain document titled “Adopting Reasonable Regulations to Permit  
 
 
the Operations of Marijuana Establishments and Marijuana Testing  
 
 
Facilities” which document was made public record by Resolution R21-04-
 
 
07 is hereby referred to and adopted is fully set out in this Ordinance and  
 
 
is on file with the City Clerk. 
 
 
Section 2.  
All ordinances and parts of ordinances in conflict with the provisions of  
 
 
 
this Ordinance or any part of the Code adopted herein by reference, are  
 
 
 
hereby repealed. 
Section 3.  
If any section, subsection, sentence, clause, phrase or portion of this  
 
 
Ordinance in any part of this addition adopted here by reference is for any  
 
 
reason held invalid or unconstitutional by the decision of any court of  
 
 
competent jurisdiction, such decision shall not affect the validity of the  
 
 
remaining portions thereof. 
 
Section 4. 
This Ordinance does not affect the rights and duties that matured, penalties 
 
 
that were incurred, or proceedings that were begun before the effective date 
 
 
of this Ordinance. 
 
Section 5. 
The effective date of this Ordinance shall be 30 days following adoption by 
 
 
the City Council.  
 
Section 6. 
The City Clerk is hereby directed to publish this adopting ordinance in full.
