D R A F T REGULAR MEETING OF THE COMMON COUNCIL OF THE CITY OF EL MIRAGE EL MIRAGE CITY COUNCIL CHAMBERS 10000 N. EL MIRAGE ROAD 6:00 PM -TUESDAY, NOVEMBER 2, 2021 Minutes 1. ROLL CALL Present: Mayor Alexis Hermosillo; Councilmember Roy Delgado; Vice Mayor Monica Dorcey; Councilmember Anita Norton (via phone); Councilmember Mike Hutchinson; Councilmember David Shapera; Councilmember Donna Winston (via phone) 2. CALL TO ORDER - Meeting called to order at 6:00 pm Pledge of Allegiance Moment of Silence Introduction of new City employees: Police Chief Paul Marzocca introduced Police Officer Brandon Clark, Police Officer Mathew Boice and Analytical Research Coordinator Kelley Martin. Interim Finance Director Dana Williams introduced Program Manager Robert Weddigan and Fiscal Services Analyst Nicholas DeWin. 3. PROCLAMATION 1. Proclamation to recognize Extra Mile Day November 1, 2021. (Administration) Vice Mayor Dorcey read a brief explanation behind the meaning of Extra Mile Day which celebrates citizens who go the extra mile in personal effort, volunteerism, and service to the community. Mayor Alexis Hermosillo declared November 1, 2021, as Extra Mile Day and encouraged citizens to 'go the extra mile' within the community. 4. CALL TO THE PUBLIC Citizens desiring to speak on any issue within the jurisdiction of the public body may do so at this time. Comments shall be limited to three (3) minutes per person and shall be addressed to the City Council as a whole. At the conclusion of the Call to the Public, individual City Council Members may (1) respond to criticism made by those who have spoken, (2) direct staff to review or follow up on the matter, and/or (3) direct that the matter be put on a future agenda. There were no public comments received. 5. CONSENT AGENDA All items listed under the Consent Agenda will be voted on with one motion. If discussion is desired regarding any Consent Agenda Item, that item will be removed from the Consent Agenda and voted on separately. 1. Consideration and action to approve the minutes of the Regular Council meeting held Tuesday, October 19, 2021. (City Clerk) 2. Consideration and action to approve the destruction of Personnel Records that have reached the end of their retention period as authorized under ARS §41-151.19. (Human Resources) 3. Consideration and action to approve the service agreement renewal with Banner Occupational Health Clinics in an amount not to exceed $9,500 annually. (Human Resources) 4. Consideration and action to approve the subscription for use of the Investigative Data Platform for License Plate Reader access provided by Vigilant Solutions (part of Motorola Solutions), via a Sole Source Letter, for a cost of $12,217.50 for FY21/22. (Police) 5. Consideration and action to accept and award Coco's Roadside Services, Inc. as the Police Department's Towing Service (PD21-VTS01). Upon acceptance and award, the contract shall run for three years and, by mutual written consent, be extended annually for two one year terms up to maximum of five years unless terminated. (Police) 6. Consideration and action to approve an agreement with APS for the installation of an electric vehicle (EV) charging station at the library facility as part of APS' "Take Charge" program. (Public Works) 7. Consideration and action to approve an agreement with APS for the installation of an electric vehicle (EV) charging station at the Public Works facility as part of APS' "Take Charge" program. (Public Works) 8. Consideration and action to approve the adoption of the modification to the FY 2021 Financial Policies. (Finance) 9. Consideration and action to approve a contract with B&F Contracting using the City of Peoria JOC No. ACON53218 for the purpose of installing speed radar signs along El Mirage Road and Dysart Road in the amount of $44,052.16 (Activity No. 62214) (Development Services) 10. Consideration and action to approve Resolution R21-11-25 for the Call of Election for the 2022 Primary and General elections. (City Clerk) 11. Consideration and action to authorize the City Clerk to opt into the Secretary of State's new electronic nomination petition portal known as E-Qual for municipal candidates to receive on-line petition signatures and voters to "sign" candidate petitions on-line at no cost to the City. (City Clerk) Vice Mayor Dorcey moved to approve consent agenda items 1-11 as presented; seconded by Councilmember Shapera. 2 Regular Meeting - Council Minutes November 2, 2021 Vote: 7 - 0 Passed - Unanimously 6. REGULAR AGENDA 1. Consideration and action to approve a Site Plan Zoning application for a Light Manufacturing Use located at 12501 West Olive Avenue, Arizona 85335 submitted by Avanti Windows and Doors. (Development Services) Senior Planner Jose Macias gave a brief presentation on the site plan zoning application submitted by Avanti Windows and Doors. There were no questions from Councilmembers regarding the application. Vice Mayor Dorcey moved to approve a site plan zoning application for a light manufacturing use located at 12501 West Olive Avenue, El Mirage, Arizona, 85335, submitted by Avanti Windows and Doors; seconded by Councilmember Shapera. Vote: 7 - 0 Passed - Unanimously 2. A Public Hearing, closure of public hearing, followed by a discussion and action on a Conditional Use Permit and Site Plan Amendment Zoning application for a Marijuana Cultivation Site Use located at 12475 West Alice Avenue, El Mirage, Arizona 85335 submitted by White Mountain Health Center. (Development Services) Mayor Alexis Hermosillo opened the public hearing. Senior Planner Jose Macias provided a description of the conditional use permit and site plan amendment application which includes an addition of twelve temporary greenhouses. He also introduced Taylor Candland as the applicant who answered Council questions. Councilmember Shapera asked if the greenhouses are permanent and Mr. Candland explained they are temporary and can be moved. Councilmember Delgado asked why a fence is on top of another fence and Mr. Candland stated the second fence is inside the first for additional security. Vice Mayor Dorcey asked how long the structures would be in place and Mr. Candland stated he was unsure at this time. Councilmember Hutchinson asked if there was remote security monitoring taking place and Mr. Candland stated yes. Councilmember Norton asked if there were several people monitoring the location and Mr. Candland replied there were multiple security personnel on site at all times. He also stated there have been no attempted break-ins at the site. Vice Mayor Dorcey asked how many jobs would this approval bring to the city and Mr. Candland stated that eight positions were added with the greenhouse additions. Councilmember Hutchinson asked if there was live remote monitoring taking place and Mr. Candland answered yes. Hearing no further questions or comments, the Mayor closed the public hearing. Vice Mayor Dorcey moved to approve a conditional use permit and site plan amendment zoning application for a marujuana cultivation site use located at 12475 West Alice Avenue, El Mirage, Arizona, 85335 submitted by White Mountian Health Center; seconded by Councilmember Shapera. Vote: 7 - 0 Passed - Unanimously 3 Regular Meeting - Council Minutes November 2, 2021 7. CITY MANAGER'S COMMENTS & SUMMARY OF CURRENT EVENTS The City Council may not act upon any matter in the City Manager's summary but may have general comment or questions. Deputy City Manager Robert Nilles stated that City Manager Crystal Dyches was not in attendance due to illness. 8. MAYOR'S COMMENTS and COUNCIL SUMMARY OF CURRENT EVENTS The Mayor and City Council may not discuss or act upon any matter in the summary unless the specific matter is properly noticed for legal action. Vice Mayor Dorcey commended staff on the Fall Harvest Festival which recently took place. There was an excellent crowd, and she appreciates everyone who took part. Councilmember Delgado stated he participated in the fundraising car wash for an El Mirage police officer. He also provided a tour of City Hall for previous City Manager Stu Brackney who was greatly impressed with the enthusiastic staff he met. Councilmember Hutchinson agreed with the Vice Mayor about the Fall Harvest Festival and stated it was the best event he has attended. He also participated as a judge in the recent band jamboree. Councilmember Norton was impressed with the super turnout at the event and is looking forward to more events in the future. Councilmember Shapera noted that the Fire and Police departments have been very busy lately, and he appreciates their hard work. Councilmember Winston stated she had a great time at the Fall Harvest Festival as well. She also participated in the car wash and the Battle of the Badges event which both support police officers. There was an amazing turnout at both fundraisers. Mayor Hermosillo reminded everyone of the upcoming Winter Parade taking place on December 4, 2021. 9.
