EXHIBIT A
§ 31.21 CITY CLERK.
(A)
Appointment. The Clerk shall be appointed by the Council and shall report directly to the
Council. The Mayor shall act as the direct supervisor of the Clerk for purposes of day-to-day
supervision.
(B)
Bond. The Clerk shall be covered under a bond pursuant to § 31.03 of this Code.
(C)
Compensation. The Clerk shall receive such compensation as directed by the Council.
(D)
Removal. The Clerk may be suspended, demoted, or removed, with or without cause, upon
a majority vote of the Council.
(E)
Records.  The Clerk shall be designated the Records Official for the City of El Mirage and
shall maintain and manage the records of the City in accordance with state statute and the Arizona
State Library and Public Records Division of the Secretary of State’s Office.  The Clerk shall keep
a true and correct record of all business transacted by the Council and any other records that either
pertain to the business of the city or that the Council directs. The Clerk shall keep and maintain
official city documents, including but not limited to official copies of the city Code, council
meeting minutes, ordinances, resolutions, budgets, contracts/agreements, deeds and easements,
leases, insurance certificates, bonds, annexation documents, and meeting and agenda postings.
(F)
Public inspection of records. The Clerk shall keep convenient for public inspection all
public records and public documents under his or her control, as provided by state statute.
(G)
Service of process. The Clerk shall be designated as the person authorized to accept
service for the City pursuant to A.R.S. § 12-821.01.
(H)
Duties as Treasurer. The Clerk shall hold the Office of City Treasurer.  The duties of the
city treasurer shall be delegated to the Finance Director.
(I)
Election Official. The Clerk shall be the City Election Official and perform those duties
required by state statute.
(J)
Administrative duties. The Clerk shall perform those administrative responsibilities and
duties that are conferred upon the Clerk by the Mayor or Council in addition to those specified in
this code and state law.
(K)
Notary public. The Clerk shall be or shall become, within sixty (60) days of taking office,
a notary public in the State of Arizona.
§ 50.002 RECEIPTS AND DEPOSITS.
The City Manager or designee shall keep a correct account of all receipts, make out all bills
for water and materials furnished to consumers, collect the same, and deposit the proceeds so
collected to the credit of the city and in accordance with the direction of the Council.
