AMENDMENT NO. 2 TO THE INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF EL MIRAGE AND THE CITY OF TOLLESON FOR POLICE AND FIRE DISPATCH SERVICES AND ADMINISTRATION THIS AMENDMENT NO. 2 between the City of El Mirage, an Arizona municipal corporation, (“El Mirage”), and the City of Tolleson, an Arizona municipal corporation, (“Tolleson”), is hereby entered into and shall be effective on the last signature date set forth below. El Mirage and Tolleson are jointly referred to herein as the “Parties” and individually as a “Party.” RECITALS WHEREAS, the Parties entered into an Intergovernmental Agreement dated April 18, 2023, and amended by Amendment No. 1 dated July 1, 2024 (collectively, the “Agreement”) for police and fire services and administration; and WHEREAS, the terms of the Agreement set forth that said Agreement will automatically renew annually for a period not to exceed ten (10) years; and WHEREAS, the Parties have met in accordance with Section 5.1 of the Agreement and agreed on an updated annual fee for the fiscal year FY2025-2026 (July 1, 2025 – June 30, 2026). AGREEMENTS The Recitals are accurate and are incorporated and made a part of the Agreement by this reference. The Parties agree to an annual cost adjustment and that El Mirage shall pay to Tolleson an annual fee of $1,337,031.00, minus a credit in the amount of $169,216.00, for a total of $1,167,815.00 for FY2025/2026 in quarterly increments beginning July 1, 2025. All other terms and conditions of the Agreement remain unchanged and in full force and effect.
