ORDINANCE O25-11-10
AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE CITY OF EL MIRAGE,
MARICOPA COUNTY, ARIZONA, AMENDING THE CITY OF EL MIRAGE ZONING CODE,
LAND USE VOLUME 2, AMENDING THE EXISTING CITY OF EL MIRAGE CITY CODE
TITLE XV, CHAPTER 154 ZONING CODE AND CHAPTER 155 SUBDIVIDISIONS TO
COMPLY WITH ARIZONA HOUSE BILL 2447 SELF-CERTIFICATION PROGRAM;
ADMINISTRATIVE REVIEW.
WHEREAS, this Ordinance has been properly noticed for a public hearing pursuant to the
requirements of El Mirage Zoning Ordinance and the statutes of the State of Arizona set forth in A.R.S. §
9-462.03, A.R.S. § 9-462.04, and necessary hearings have been completed; and,
WHEREAS, the City Council adopted Ordinance O87-07-05 on July 23, 1987, adopting The El
Mirage Zoning Ordinance, including written text and map; and,
WHEREAS, the City Council adopted Ordinance O06-02-05 on March 9, 2006, adopting the
chapter number change for the Zoning Code and codification of Chapter 21; and,
WHEREAS, the City Council amended Ordinance O11-09-17 on September 22, 2011, amending
the miscellaneous sections of the El Mirage Zoning Ordinance; and,
WHEREAS, HB 2447 amends A.R.S. §9-500.49 to require municipalities to authorize
administrative personnel to review and approve certain development documents, including site plans,
development plans, land divisions, lot line adjustments, lot ties, preliminary plats, final plats, and plat
amendments without a public hearing; and
WHEREAS, the El Mirage Planning and Zoning Commission reviewed and provided a
recommendation to the City Council of the Zoning and Land Use text amendments at the October 14,
2025, Public Hearing.
WHEREAS, the proposed Zoning and Land Use text amendment will enhance public health,
safety, and welfare and preserve the character of the City of El Mirage; and
WHEREAS, in accordance with Article II, Sections 1 and 2, Constitution of Arizona, and the laws
of the State of Arizona, the City Council has considered the individual property rights and personal
liberties of the residents of the City and the probable impact of the proposed ordinance on the cost to
construct housing for sale or rent before adopting this ordinance.
NOW, THEREFORE, be it ordained, by the Mayor and Council of the City of El Mirage,
Arizona, as follows:
Section 1.
That the City of El Mirage Zoning Code, Land Use Volume 2, Chapter 154 and
Chapter 155, is hereby amended and made a part of this Ordinance as incorporated
and attached as Exhibit A and Exhibit B. The Exhibits are on file with the City
Clerk’s Office for review.
Section 2.
The various City officers and employees are authorized and directed to perform all
acts necessary or desirable to give effect to this Ordinance.

Section 3.
All ordinances and parts of ordinances in conflict with the provisions of this
Ordinance or any part of the Code adopted herein by reference are hereby repealed.
Section 4.
If any section, subsection, sentence, clause, phrase, or portion of this Ordinance or
any part of the Code adopted herein by reference is, for any reason, held to be
invalid or unconstitutional by the decision of any court of competent jurisdiction,
such decision shall not affect the validity of the remaining portions thereof.
Section 5.
Violation of this ordinance is subject to City Code Section 154.999 (Penalties).
Section 6.
This ordinance shall take effect thirty (30) days after its passage by the City
Council.
