D R A F T REGULAR MEETING OF THE COMMON COUNCIL OF THE CITY OF EL MIRAGE EL MIRAGE CITY COUNCIL CHAMBERS 10000 N. EL MIRAGE ROAD 6:00 PM -TUESDAY, FEBRUARY 15, 2022 Minutes 1. ROLL CALL Present: Mayor Alexis Hermosillo; Vice Mayor Monica Dorcey (via phone); Councilmember Roy Delgado; Councilmember Anita Norton; Councilmember Mike Hutchinson; Councilmember David Shapera; Councilmember Donna Winston 2. CALL TO ORDER - The meeting was called to order at 6:10 pm. Pledge of Allegiance Moment of Silence Introduction of new City employees Police Chief Paul Marzocca introduced Police Officer Rafael Santos-Candelario and Senior Police Investigator Specialist Allen Antoniewicz. 3. PRESENTATION 1. El Mirage State of the City 2022 Presentation. (Administration) Mayor Hermosillo presented the first video El Mirage State of the City 2022 presentation. 4. PROCLAMATION 1. Proclamation for February 2022 Teen Dating Violence Prevention and Awareness Month. (Administration) Deputy Director of Intergovernmental and Public Relations Amber Wakeman provided background information on Teen Dating Violence Prevention and Awareness Month, and she introduced Ms. Adaly Armenta, the Victims' Assistance Supervisor with El Mirage Police Department. Mayor Hermosillo proclaimed the month of February 2022 to be Teen Dating Violence Prevention and Awareness Month. Ms. Armenta accepted the proclamation and thanked the Mayor for participating. 5. CALL TO THE PUBLIC Citizens desiring to speak on any issue within the jurisdiction of the public body may do so at this time. Comments shall be limited to three (3) minutes per person and shall be addressed to the City Council as a whole. At the conclusion of the Call to the Public, individual City Council Members may (1) respond to criticism made by those who have spoken, (2) direct staff to review or follow up on the matter, and/or (3) direct that the matter be put on a future agenda. No public comments were received. 6. CONSENT AGENDA All items listed under the Consent Agenda will be voted on with one motion. If discussion is desired regarding any Consent Agenda Item, that item will be removed from the Consent Agenda and voted on separately. 1. Consideration and action to approve the minutes of the Regular Council meeting held Tuesday, February 1, 2022. (Clerk) 2. Consideration and action to approve the third extension of four one year periods for the Senior Center congregate meal service with Banner Olive Branch Senior Center in an amount not to exceed $27,000 per year. (Community Services) 3. Consideration and action to enter into an IGA with the Arizona Department of Public Safety for use of the Insight system. (Police) 4. Consideration and action to approve Arizona Public Service (APS) utility easement on City property in order to facilitate the construction of electrical vehicle charging station. (Public Works) 5. Consideration and action to approve an Automatic Aid Agreement between Luke Air Force Base and the City of El Mirage for provision of mutual aid fire protection services in times of emergency. (Fire Department) 6. Consideration and action to enter into an agreement between American Medical Response (AMR) and the City of El Mirage for Emergency Medical Transport Services. (Fire) 7. Consideration and possible adoption of Resolution R22-02-02 Authorizing all Matters Necessary to Sell and Issue General Obligation Refunding Bonds of the City. (Administration) Councilmember Delgado moved to approve Consent Agenda Items 1-7 as presented; seconded by Councilmember Shapera. Vote: 7 - 0 Passed - Unanimously 7. REGULAR AGENDA 1. Consideration and action to approve Resolution R22-02-01 including the attached Exhibit "A" enacting and adopting a supplement (S-12 - 2021) to the Code of Ordinances through December 2021. (City Clerk) 2 Regular Meeting - Council Minutes February 15, 2022 Councilmember Delgado moved to approve Resolution R22-02-01 including the attached Exhibit "A" enacting and adopting a supplement (S-12-2021) to the Code of Ordinances through December 2021; seconded by Councilmember Shapera. Vote: 7 - 0 Passed - Unanimously 2. Consideration and action to approve Ordinance O22-02-01 enacting and adopting a supplement (S-12 2021) to the Code of Ordinances for the City of El Mirage. (City Clerk) Councilmember Delgado moved to approve Ordinance O22-02-01 enacting and adopting a supplement (S-12 - 2021) to the Code of Ordinances for the City of El Mirage; seconded by Councilmember Shapera. Vote: 7 - 0 Passed - Unanimously 3. Consideration and action to adopt a notice of intent to change certain fees which could include adding, deleting, increasing or decreasing fees not sooner than 60 days from the date of posting the notice pursuant to A.R.S. Section § 9-499.15. (Administration) Fiscal Services Administrator Macy Walker gave a brief explanation of the proposed fee changes. Councilmember Delgado moved to adopt a notice of intent to change certain fees which could include adding, deleting, increasing or decreasing fees not sooner than 60 days from the date of posting the notice pursuant to A.R.S. Section § 9-499.15; seconded by Councilmember Shapera. Vote: 7 - 0 Passed - Unanimously 8. CITY MANAGER'S COMMENTS & SUMMARY OF CURRENT EVENTS The City Council may not act upon any matter in the City Manager's summary but may have general comment or questions. City Manager Dyches had no comments. 9. MAYOR'S COMMENTS and COUNCIL SUMMARY OF CURRENT EVENTS The Mayor and City Council may not discuss or act upon any matter in the summary unless the specific matter is properly noticed for legal action. Mayor Hermosillo acknowledged the birthdays of City Clerk Sharon Antes and Councilmember David Shapera. 10. EXECUTIVE SESSION Councilmember Delgado moved to adjourn into Executive Session; seconded by Councilmember Shapera. Vote: 7 - 0 Passed - Unanimously 3 Regular Meeting - Council Minutes February 15, 2022 1. Consideration and action to adjourn into Executive Session pursuant to A.R.S. § 38-431.03.A3. regarding consultation for legal advice from the City attorney on future residential developments relative to the Luke Air Force Base graduated density concept and pursuant to A.R.S. § 38-431.03.A7 regarding sale of City owned property.
