D R A F T REGULAR MEETING OF THE COMMON COUNCIL OF THE CITY OF EL MIRAGE EL MIRAGE CITY COUNCIL CHAMBERS 10000 N. EL MIRAGE ROAD 6:00 PM -TUESDAY, APRIL 19, 2022 Minutes 1. ROLL CALL Present: Mayor Alexis Hermosillo; Councilmember Roy Delgado; Vice Mayor Monica Dorcey; Councilmember Anita Norton; Councilmember Mike Hutchinson (via phone); Councilmember David Shapera; Councilmember Donna Winston 2. CALL TO ORDER - MEETING CALLED TO ORDER AT 6:00 PM. Pledge of Allegiance Moment of Silence Introduction of new City employees Police Chief Marzocca introduced K9 Mando and his handler Officer Hewetson. 3. PRESENTATION 1. Presentation of award to El Mirage Police Officer Steven Braswell from Arizona Law Enforcement Outreach & Support (ASLEOS). (Councilmember Donna Winston and Vice Mayor Monica Dorcey) Councilmember Winston introduced Officer Jim Hill with the Arizona Law Enforcement Outreach and Support who presented a football jersey and check for $3,000 from the Battle of the Badges to Officer Steven Braswell who was unable to attend. 4. PROCLAMATION 1. A proclamation to proclaim April 29, 2022, as Arbor Day in El Mirage. (Public Works) Environmental Manager Derek Castaneda gave a brief history of Arbor Day and thanked Mayor and Council for the proclamation. He stated that a tree will be planted in Gentry Park on April 28, 2022, at 2:00 pm. Mayor Hermosillo proclaimed April 29, 2022, as Arbor Day in El Mirage. 5. CALL TO THE PUBLIC Citizens desiring to speak on any issue within the jurisdiction of the public body may do so at this time. Comments shall be limited to three (3) minutes per person and shall be addressed to the City Council as a whole. At the conclusion of the Call to the Public, individual City Council Members may (1) respond to criticism made by those who have spoken, (2) direct staff to review or follow up on the matter, and/or (3) direct that the matter be put on a future agenda. Resident Keith Gray requested more information on consent agenda items in order to research them prior to the Council meetings. He also stated that although the traffic light at Acoma Road is appreciated by residents, the lack of communication regarding landscaping is frustrating noting inconsistent coloring of landscape rock. 6. CONSENT AGENDA All items listed under the Consent Agenda will be voted on with one motion. If discussion is desired regarding any Consent Agenda Item, that item will be removed from the Consent Agenda and voted on separately. 1. Consideration and action to approve the minutes of the Regular Council meeting held on Tuesday, April 5, 2022. (City Clerk) 2. Consideration and action to approve Resolution R22-04-06 in order to allow alcoholic beverages to be served and consumed at a specific City of El Mirage Special Event for the FY 2021/2022 event season. (Community Services) 3. Consideration and action to enter into a thirty-six (36) month agreement with Cox Business to provide Internet services to city facilities at a total cost not to exceed $47,412. (Information Technology) 4. Consideration and action to approve the three-year contract with Henry + Horne, LLP for the City's financial audit services at a total cost not to exceed $131,894. (Finance) 5. Consideration and action to authorize the purchase for the NET Team, an unmarked, equipped 2022 Ford Police Responder Truck at a cost of $67,562.99 from PFVT Motors, Inc (Peoria Ford) under State Contract ADSPO17-166117. (Police) 6. Consideration and action to renew the existing intergovernmental agreement (IGA) for jury services provided by the Maricopa County Superior Court. (El Mirage City Court) 7. Consideration and action to enter into an agreement(s) with Educational Services Inc. (ESI) to retain experienced employees and provide RetireRehire employment staffing services for an amount not to exceed $225,000. (Human Resources) Vice Mayor Dorcey moved to approve Consent Agenda items 1-7 as presented; seconded by Councilmember Shapera. Vote: 7 - 0 Passed - Unanimously 7. REGULAR AGENDA 2 Regular Meeting - Council Minutes April 19, 2022 1. A Public Hearing, closure of public hearing followed by a discussion and action on a Conditional Use Permit application for a request to collocate new wireless service equipment on an existing wireless communications facility located at 10341 N. El Mirage Road, El Mirage, Arizona submitted by Tower Engineering Professionals. (Development Services) Mayor Hermosillo opened the public hearing. Senior Planner Jose Macias gave a brief presentation on the conditional use permit application and stated there were no comments received from the public. Councilmember Delgado thanked Mr. Macias for the palm design and asked if there would be any income to the city from this project. Mr. Macias stated there would not be because the agreement is between the two parties on private property even though they need a conditional use permit from the City. Hearing no comments from the public the Mayor closed the Public Hearing. Councilmember Shapera stated he was in favor of this project. Vice Mayor Dorcey moved to approve a Conditional Use Permit application for a request to collocate new wireless service equipment on an existing wireless communications facility located at 10341 N. El Mirage Road, El Mirage, Arizona, as presented; seconded by Councilmember Shapera. Vote: 7 - 0 Passed - Unanimously 2. Consideration and action to approve a site plan zoning application for restaurant use for a fast-food business at the southeast corner of El Mirage Road and Thunderbird Road submitted by Hauser Engineering Group, LLC. (Development Services) Senior Planner Macias presented information on the site plan zoning application for a fast food restaurant at the southeast corner of El Mirage Road and Thunderbird Road. Councilmember Norton asked if customers would be able to enter the restaurant and if there would be restrooms available to the public. Mr. Macias stated there was no service or seating inside the building and Chris Hauser with Hauser Engineering Group, LLC, stated there would be exterior restrooms available for patrons. Councilmember Shapera stated he had a car queuing concern and requested cameras be installed for restaurant staff to monitor the number of cars in the line at any time. Councilmember Delgado asked if there would be patio seating available to customers and Mr. Macias stated yes. Councilmember Winston stated she is excited about the restaurant opening. Vice Mayor Dorcey moved to approve a site plan zoning application for restaurant use for a fast-food business at the southeast corner of El Mirage Road and Thunderbird Road submitted by Hauser Engineering Group, LLC., with a stipulation to add cameras allowing restaurant staff to monitor car traffic in the queue; seconded by Councilmember Shapera Vote: 7 - 0 Passed - Unanimously 3. Consideration and action to increase project amount of $50,000 for changing audio visual components at the El Mirage Fire Department by $9,247.88 to accommodate increases due to inflation of materials and installation costs and authorize the Finance Department to make necessary budget transfers. (Fire) Fire Chief Michael Long explained cost increases to the original project amount. Councilmember Shapera stated 19% is a substantial increase and Chief Long stated it began as a higher increase until they modified the project to bring the increase total down. 3 Regular Meeting - Council Minutes April 19, 2022 Vice Mayor Dorcey moved to increase project amount of $50,000 for changing audio visual components at the El Mirage Fire Department by $9,247.88 to accommodate increases due to inflation of materials and installation costs and authorize the Finance Department to make necessary budget transfers as presented; seconded by Councilmember Shapera. Vote: 7 - 0 Passed - Unanimously 4. Consideration and action to approve the purchase and installation of audio, visual, and information technology equipment from Bluum Troxell Communications for technology upgrades to the existing El Mirage Emergency Operations Center located at the El Mirage Fire Department Station 121 at a cost not to exceed $59,247.88 utilizing ARPA (CoronaVirus) funds. (Fire) Fire Chief Long gave information on the vendor Bluum Troxell Communications and the technology upgrades they will provide. Councilmember Delgado asked if materials were ready to be ordered and Chief Long stated the materials were approximately thirty to sixty days out. Vice Mayor Dorcey moved to approve the purchase and installation of audio, visual, and information technology equipment from Bluum Troxell Communications for technology upgrades to the existing El Mirage Emergency Operations Center located at the El Mirage Fire Department Station 121 at a cost not to exceed $59,247.88 utilizing ARPA (CoronaVirus) funds as presented; seconded by Councilmember Shapera. Vote: 7 - 0 Passed - Unanimously 5. Consideration and action to extend the existing independent Allied Universal Security Services contract through June 30, 2022. (El Mirage City Court). Court Administrator Jessica Swanson explained the need for the two-month extension to the contract. Councilmember Norton asked what the plan was for FY22-23 and Ms. Swanson stated the next agenda item addresses next fiscal year. Vice Mayor Dorcey moved to extend the existing independent Allied Universal Security Services contract through June 30, 2022, as presented; seconded by Councilmember Shapera. Vote: 7 - 0 Passed - Unanimously 6. Consideration and action to join the Arizona State contract for Allied Universal Security Services beginning July 1, 2022, for the duration of FY 2022/23 (El Mirage Municipal Court). Councilmember Shapera moved to table this item for a future agenda; seconded by Vice Mayor Dorcey. Vote: 7 - 0 Passed - Unanimously 7. Consideration and action to approve Resolution R22-04-07 setting water recharge and other miscellaneous fees and service charges for FY 2022/23. (Administration) Fiscal Services Administrator Macy Walker explained the fee changes proposed for each department and Deputy City Manager Robert Nilles presented information on the property tax fee changes. Vice Mayor Dorcey asked Ms. Walker if the changes to the fee schedule were comparable with other municipalities. Ms. Walker stated the changes are reflective of staff input and rising costs in general and Mr. Nilles explained that some fees are comparable with other municipalities that offer the same 4 Regular Meeting - Council Minutes April 19, 2022 service and some fees are not as they are services specific to El Mirage. Councilmember Hutchinson stated he has not been shown the need to increase fees and would not support this item. Vice Mayor Dorcey moved to approve Resolution R22-04-07 setting water recharge and other miscellaneous fees and service charges for FY 2022/23 as presented; seconded by Councilmember Shapera. Vote: 6 - 1 Passed NAY: Councilmember Mike Hutchinson (via phone) 8. Consideration and action to approve Resolution R22-04-05 adopting the Capital Improvements Plan (CIP) for fiscal years 2023 through 2027. (Administration) Fiscal Services Administrator Walker presented information on the five-year plan for Capital Improvement expenses and the next steps in the process. Councilmember Norton asked why the Court and Fire Station were included in this plan when they were not agreed on yet and Ms. Walker stated these were just tentative plans for the next five years. Vice Mayor Dorcey moved to approve Resolution R22-04-05 adopting the Capital Improvements Plan (CIP) for fiscal years 2023 through 2027 as presented; seconded by Councilmember Shapera. Vote: 7 - 0 Passed - Unanimously 9. Consideration and action to approve Resolution R22-04-04 adopting the tentative budget thereby setting the maximum expenditure limit for FY22-23. (Administration) Mayor Hermosillo moved to table this item for a future agenda; seconded by Councilmember Shapera. Vote: 7 - 0 Passed - Unanimously 8. CITY MANAGER'S COMMENTS & SUMMARY OF CURRENT EVENTS The City Council may not act upon any matter in the City Manager's summary but may have general comment or questions. City Manager Dyches invited everyone to the Community Appreciation Day taking place at Gentry Park on April 29, 2022, from 5:00 pm - 9:00 pm. There will be Lucha Libre wrestling, face painting, life-like dinosaurs, a cheer squad, a Japanese drummer and much more. She also reminded everyone of the Household Hazardous Waste event taking place until April 24, 2022. This is a free service to residential utility customers in El Mirage. 9. MAYOR'S COMMENTS and COUNCIL SUMMARY OF CURRENT EVENTS The Mayor and City Council may not discuss or act upon any matter in the summary unless the specific matter is properly noticed for legal action. Councilmember Norton stated the splash pad at Gateway Park is unique and incredible and encourages families to visit the park to discover it. She also requested additional shade be installed for seating areas near the splash pad. Councilmember Shapera asked if water safety messages could be added to the message boards and City Manager Dyches stated they are already planned for upcoming posts. Councilmember Winston stated she attended the Police Department's Family Fun 5 Regular Meeting - Council Minutes April 19, 2022 Day and had a wonderful time. Mayor Hermosillo wished Councilmember Delgado a happy birthday this past Sunday. 10. EXECUTIVE SESSION 1. Consideration and action to adjourn into Executive Session pursuant to A.R.S. $38-431.03.A7 regarding consultation for legal advice from the City Attorney on the sale of City-owned property. (Economic Development) Vice Mayor Dorcey moved to adjourn into Executive Session; seconded by Councilmember Shapera. Vote: 7 - 0 Passed - Unanimously 11.
