D R A F T REGULAR MEETING OF THE COMMON COUNCIL OF THE CITY OF EL MIRAGE EL MIRAGE CITY COUNCIL CHAMBERS 10000 N. EL MIRAGE ROAD 6:00 PM -TUESDAY, JUNE 7, 2022 Minutes 1. ROLL CALL Present: Mayor Alexis Hermosillo; Councilmember Roy Delgado; Vice Mayor Monica Dorcey; Councilmember Anita Norton; Councilmember Mike Hutchinson; Councilmember David Shapera; Councilmember Donna Winston (via phone) 2. CALL TO ORDER - MEETING CALLED TO ORDER AT 6:00 PM Pledge of Allegiance Moment of Silence Introduction of new City Employees Chief Marzocca introduced Police Records Technician, Senior, Rachel Schmidt, Police Officer Garrin De Ronde and Police Officer Anthony Joseph. 3. PROCLAMATION 1. Proclamation for Mens' Health Month June 2022 Deputy Director of Intergovernmental and Public Affairs Amber Wakeman gave a brief background on the origins of Mens' Health Month which began in 1994. Mayor Hermosillo proclaimed June 2022 as Mens' Health Month and encouraged citizens to pursue preventative health practices and early detection efforts. 4. CALL TO THE PUBLIC Citizens desiring to speak on any issue within the jurisdiction of the public body may do so at this time. Comments shall be limited to three (3) minutes per person and shall be addressed to the City Council as a whole. At the conclusion of the Call to the Public, individual City Council Members may (1) respond to criticism made by those who have spoken, (2) direct staff to review or follow up on the matter, and/or (3) direct that the matter be put on a future agenda. No public comments received. 5. CONSENT AGENDA All items listed under the Consent Agenda will be voted on with one motion. If discussion is desired regarding any Consent Agenda Item, that item will be removed from the Consent Agenda and voted on separately. 1. Consideration and action to approve the minutes of the Work Session and Regular Council meeting held Tuesday, May 17, 2022. (City Clerk) 2. Consideration and action to approve the destruction of municipal documents that have reached the end of their retention period as authorized under A.R.S. §41-151.19. (City Clerk) 3. (DBA “NEOGOV”) Software-as-a-Service (SaaS) Agreement for their Insight job posting and application processing software subscription in an amount not to exceed $6,658.46 for FY 23. (Human Resources) 7. Consideration and action to renew Governmentjobs.com, Inc. (DBA “NEOGOV”) Software-as-a-Service (SaaS) Agreement for their performance employee evaluations software subscription in an amount not to exceed $9,987.20 for FY 23. (Human Resources) 8. Consideration and action to approve a service agreement with 1582, LLC in an amount not to exceed $30,000 annually. (Human Resources) 9. Consideration and action to approve Resolution R22-06-14 designating Robert Weddigen as the City of El Mirage Chief Fiscal Officer for FY 2023 as required by Arizona Revised Statutes §41-1279.07(E). (Finance) 10. Consideration and action to request, and accept if awarded, funding from the Tohono O'odham Nation 2022 revenue sharing program in an amount of approximately $300,000 for an outdoor learning plaza at the El Mirage Library and authorize the Finance department to make the necessary budget adjustments. (Grants) 11. Consideration and action to authorize the City Manager to sign two Letters of Agreement with Arizona Public Service Company (APS) for electrical work required as part of the City's Dysart Road project in an amount not-to-exceed $1,044,546.02. (Development Services) 12. Consideration and action to authorize an increase to budget authority for Capital Improvement Project (CIP) #62065 in an amount not to exceed $59,691.86 and authorize the finance department to make any necessary transfers. (Public Works) 13. Consideration and action to approve contract PW22-SHD01 for Sludge Hauling Services at the City's water reclamation facility in an amount not to exceed $91,499.20 for FY23. (Public Works) 2 Regular Meeting - Council Minutes June 7, 2022 14. Consideration and action to authorize the City Manager to enter in budgeted goods and services contracts to allow Public Works to perform their duties during FY 22/23. (Public Works) Vice Mayor Dorcey moved to approve Consent Agenda items 1-14 as presented (No consent agenda item 5 - blank intentionally); seconded by Councilmember Shapera. Vote: 7 - 0 Passed - Unanimously 6. REGULAR AGENDA 1. Consideration and action to approve Ordinance O22-06-03 adopting the City’s property tax levies for Fiscal Year 2022-2023. (Administration) Financial Administrator Macy Walker offered to answer any questions regarding the property tax levies. There were no questions. Vice Mayor Dorcey moved to approve Ordinance O22-06-03 adopting the City's property tax levies for Fiscal Year 2022-2023; seconded by Councilmember Shapera. Vote: 6 - 1 Passed NAY: Councilmember Mike Hutchinson 2. Consideration and action to approve a franchise agreement between the City of El Mirage and Epcor regarding utility services generally south of Peoria Avenue and west of El Mirage Road in preparation for consideration on the November 2022 general election ballot. (Public Works) Public Works Director Nick Russo presented information on the franchise agreement between the City of El Mirage and Epcor. He stated the City would receive a 3% gross sales revenue from the agreement and that it would be listed on the general election ballot as Proposition 475. Councilmember Norton asked what the cost to the City would be if this agreement were not approved. Mr. Russo stated the amount would be approximately 35 million dollars. Councilmember Norton asked for clarification that the City is not turning over all water services to Epcor and Mr. Russo stated no, only a certain area of the city would be involved and he detailed the specific location affected by this agreement. Councilmember Shapera stated he is okay with this agreement. Vice Mayor Dorcey asked what the process would be for determining the value of the assets to be sold to Epcor with this agreement. Mr. Russo stated his department would take the costs of the program and depreciate the assets accordingly to determine the value. Vice Mayor Dorcey stated she is also in favor of this agreement. Councilmember Hutchinson asked if there was any situation that could occur that would cost taxpayers the franchise fee and Mr. Russo stated it would be very unlikely but that if a catastrophic event were to occur, it was written into the agreement how the affects of the event would be evaluated. Councilmember Delgado asked if Epcor would connect with the City's water treatment plant and Mr. Russo explained that an interconnect has been looked into and if it were to occur it would only affect a few properties. Vice Mayor Dorcey asked what the consequence would be if this item were not approved and Mr. Russo stated there would be no franchise fees for the City and Epcor would be required to proceed through the normal planning and zoning process with fees due. Councilmember Norton asked the amount of revenue this would produce and Mr. Russo stated the amount is not known at this time. Vice Mayor Dorcey moved to approve a franchise agreement between the City of El Mirage and Epcor regarding utility services in preparation for consideration on the November 2022 general election ballot; seconded by Councilmember Shapera. 3 Regular Meeting - Council Minutes June 7, 2022 Vote: 7 - 0 Passed - Unanimously 7. CITY MANAGER'S COMMENTS & SUMMARY OF CURRENT EVENTS The City Council may not act upon any matter in the City Manager's summary but may have general comment or questions. City Manager Dyches had no comments. 8. MAYOR'S COMMENTS and COUNCIL SUMMARY OF CURRENT EVENTS The Mayor and City Council may not discuss or act upon any matter in the summary unless the specific matter is properly noticed for legal action. Councilmember Shapera complimented the Police Department on their NET Squad and reminded everyone of the blood drive coming to City Hall next Wednesday, June 15, 2022. 9.
