D R A F T REGULAR MEETING OF THE COMMON COUNCIL OF THE CITY OF EL MIRAGE EL MIRAGE CITY COUNCIL CHAMBERS 10000 N. EL MIRAGE ROAD 6:00 PM -TUESDAY, OCTOBER 4, 2022 Minutes 1. ROLL CALL Present: Mayor Alexis Hermosillo (via phone); Vice Mayor Monica Dorcey; Councilmember Roy Delgado; Councilmember Anita Norton; Councilmember David Shapera; Councilmember Donna Winston 2. CALL TO ORDER - MEETING CALLED TO ORDER AT 6:00 PM. Pledge of Allegiance Moment of Silence 3. PROCLAMATION 1. A City Proclamation to recognize "Domestic Violence Awareness Month - October 2022." (Police) Police Chief Paul Marzocca provided background statistics on domestic violence and how it affects the community. Vice Mayor Dorcey proclaimed the month of October 2022, to be Domestic Violence Awareness Month. 2. Proclamation to declare October 9-15, 2022 as Fire Prevention Week in the City of El Mirage. (Fire) Fire Chief Michael Long provided background information on fire prevention week and stated the theme for 2022 is "Fire won't wait. Plan your escape." Vice Mayor Dorcey proclaimed the week of October 9-15, 2022, as Fire Prevention Week. 4. CALL TO THE PUBLIC Citizens desiring to speak on any issue within the jurisdiction of the public body may do so at this time. Comments shall be limited to three (3) minutes per person and shall be addressed to the City Council as a whole. At the conclusion of the Call to the Public, individual City Council Members may (1) respond to criticism made by those who have spoken, (2) direct staff to review or follow up on the matter, and/or (3) direct that the matter be put on a future agenda. There were no public comments. 5. CONSENT AGENDA All items listed under the Consent Agenda will be voted on with one motion. If discussion is desired regarding any Consent Agenda Item, that item will be removed from the Consent Agenda and voted on separately. 1. Consideration and action to approve the minutes of the Regular Council meeting held Tuesday, September 20, 2022. (City Clerk) 2. Consideration and action to approve the destruction of municipal documents that have reached the end of their retention period as authorized under A.R.S. § 41 -15I.19. (City Clerk) 3. Consideration and action to approve a Letter of Agreement between Maricopa County Community College District and the City of El Mirage for provision of a supervised Emergency Medical Technician (EMT) and Paramedic Preceptorship. (Fire) 4. Consideration and action to accept funding from the Salt River Pima-Maricopa Indian Community FY23 12% Gaming Grant program in an amount of $32,000 for Gentry Park Lighting Project and authorize the Finance department to make the necessary budget adjustments. (Community Services) 5. Consideration and action to accept the award agreement from the State of Arizona Office of the Attorney General for the FY23 Victims' Rights Program in the amount of $10,600 for the El Mirage City Prosecutor's Office and authorize Finance to make the necessary budget transfers. (Community Services/Police) 6. Consideration and action to accept the award agreement from the State of Arizona Office of the Attorney General for the FY23 Victims' Rights Program in the amount of $10,600 for the El Mirage Police Department and authorize Finance to make the necessary budget transfers. (Community Services/Police) 7. Consideration and action to approve an agreement with Baker Commodities Inc. for an annual "F.O.G." disposal program at no cost to the City. (Public Works) 8. Consideration and action to authorize the City Manager to enter into a Professional Services Contract with Michael Baker International to provide services to develop a Downtown Revitalization Plan for an amount not to exceed $71,700. (Development Services) Item 8 pulled from consent agenda and addressed as a regular agenda item. 9. Consideration and action to accept the dedication of 17 Temporary Drainage and Retention Basin Easements, 1 Permanent Drainage and Retention Basin Easement and a portion of right of way from Dermody Properties to aid in the construction of the City's Dysart Road Improvement project. (Development Services) 10. Consideration and action to accept the dedication of 7 Temporary Construction Easements and 1 Public Access Easement to aid in the construction of the City's Dysart Road Improvement project. (Development Services) 2 Regular Meeting - Council Minutes October 4, 2022 11. Consideration and action to accept the dedication of a Pedestrian Access Easement from the Dysart Unified School District (DUSD) in conjunction with the Catholic Charities Head Start project. (Development Services) Councilmember Shapera moved to approve Consent Agenda items 1-7 and 9-11 as presented; seconded by Councilmember Norton. Vote: 6 - 0 Passed - Unanimously 6. REGULAR AGENDA Consent Agenda # 8. Consideration and action to authorize the City Manager to enter into a Professional Services Contract with Michael Baker International to provide services to develop a Downtown Revitalization Plan for an amount not to exceed $71,700. (Development Services) City Engineer Jorge Gastelum provided information on the Downtown Revitalization Plan agreement with Michael Baker International. Community Services Manager Dr. Autumn Grooms provided information on the community services benefits of the agreement and Economic Development Manager Tom Doyle gave information on the economic benefits of the agreement. Councilmember Shapera stated he is in favor of assisting the residential portion of this plan and is hesitant to provide assistance to vacant lot and commercial property owners. Councilmember Norton asked if it would be possible to achieve buy-in from the landowners in the area to participate if they were to receive any grants and Mr. Gastelum stated he believed they could get participation from the landowners. Councilmember Norton stated that without funding there would be no change, and she is in favor of this item. Councilmember Delgado stated he is in favor of the possibilities this item would provide for the city. Councilmember Winston asked for clarification on the residential parameters of the plan and Mr. Gastelum detailed the location. Councilmember Shapera stated the investors do not need the city to tell them what to do with the land, and he is not in favor of spending money on vacant lots. Mayor Hermosillo stated she agrees with Councilmember Delgado and sees this item as an investment in the future of El Mirage residents. Vice Mayor Dorcey stated she appreciates the efforts of staff to provide the additional information and is happy to see the ideas and suggestions being brought forward. Councilmember Shapera moved to authorize the City Manager to enter into a Professional Services Contract with Michael Baker International to provide services to develop a Downtown Revitalization Plan for an amount not to exceed $71,711, as presented; seconded by Councilmember Norton. Vote: 6 - 0 Passed 1. Consideration and action on a site plan approval application for a Distribution / Warehousing Center, Indoor use located at the southeast corner of El Mirage Road and Joe R Ramirez Road submitted by the Stonemont Financial Group. (Development Services) Senior Planner Jose Macias presented information on the site plan application. Councilmember Shapera asked if the water would be from EPCOR or El Mirage and Mr. Macias stated they would receive service from El Mirage. Councilmember Shapera asked where the signage and trash containers would be located and Mr. Macias stated the applicant has not yet provided that information. Councilmember Norton asked if the end portion of the west and north buildings would be the offices and Mr. Macias stated yes. 3 Regular Meeting - Council Minutes October 4, 2022 Councilmember Shapera moved to approve a site plan approval application for a Distribution/Warehousing Center, Indoor use located at the southeast corner of El Mirage Road and Joe R Ramirez Road submitted by the Stonemont Financial Group, as presented; seconded by Councilmember Norton. Vote: 6 - 0 Passed - Unanimously 2. Consideration and action on a site plan approval application for a Manufacturing, Light Use wood truss plant operation located at 10100 N. Dysart Road, submitted by Cariari Holding, Inc. (Development Services) Senior Planner Jose Macias presented information on the site plan application. Councilmember Delgado asked if the lighting of the facility would affect Luke Air Force Base operations and Mr. Macias stated the representative from LAFB had no issues with the proposed lighting but did note in their letter that the applicant should be mindful of the lighting when submitting plans. Councilmember Shapera moved to approve a site plan approval application for a Manufacturing, Light Use wood truss pant operation located at 10100 N. Dysart Road, submitted by Cariari Holding, Inc., as presented; seconded by Councilmember Norton. Vote: 6 - 0 Passed - Unanimously 7. CITY MANAGER'S COMMENTS & SUMMARY OF CURRENT EVENTS The City Council may not act upon any matter in the City Manager's summary but may have general comment or questions. City Manager Crystal Dyches advised council that the EPCOR publicity pamphlets were mailed to households with registered voters today and that the Council Chambers would be unavailable for meetings from October 10 through November 10 as it will be an early voting location for the November 8 General Election. Ms. Dyches stated the Council and Planning and Zoning meetings during this time would be held at the Police Department in the community room, and she will send reminders to staff prior to those meetings. Deputy City Manager Robert Nilles provided updates on budget adjustments that were recently made for FY21-22. 8. MAYOR'S COMMENTS and COUNCIL SUMMARY OF CURRENT EVENTS The Mayor and City Council may not discuss or act upon any matter in the summary unless the specific matter is properly noticed for legal action. Councilmember Norton stated the El Mirage Cares community forum was a success and advised everyone the Domestic Violence forum will be taking place on October 19, 2022. Councilmember Shapera stated the Fire Department community outreach that recently took place was very informative. 9.
