3.
PRESENTATION
 
1.
Presentation by Governor's Office of Equal Opportunity for Hispanic Heritage Month 2022.
Deputy Director of Intergovernmental Affairs Amber Wakeman introduced Mr. Barry Wong,
Executive Director of the Governor's Office of Equal Opportunity.  Mr. Wong read the
Proclamation from Governor Douglas Ducey for the recognition of Hispanic Heritage Month,
September 15, 2022, through October 15, 2022.
  
 
4.
CALL TO THE PUBLIC
Citizens desiring to speak on any issue within the jurisdiction of the public body may do so at this
time. Comments shall be limited to three (3) minutes per person and shall be addressed to the City
Council as a whole. At the conclusion of the Call to the Public, individual City Council Members
may (1) respond to criticism made by those who have spoken, (2) direct staff to review or follow
up on the matter, and/or (3) direct that the matter be put on a future agenda.
Police Officer Doug Jones, President of the El Mirage Police Employee Association, read a
statement to council regarding the staffing and retention concerns of his association.  He detailed
the causes of the recent concerns and asked for council to read the statement he printed for each
member.

CONSENT AGENDA
All items listed under the Consent Agenda will be voted on with one motion. If discussion is
desired regarding any Consent Agenda Item, that item will be removed from the Consent Agenda
and voted on separately.
 
1.
Consideration and action to approve the minutes of the Work Session and Regular Council
meeting held on September 8, 2022. (City Clerk)
  
 
2.
Consideration and action to approve the use of Chasse Building Team to complete the design for
Capital Improvement Project (CIP) 62345 Customer Service Facility in an amount not to exceed
$40,350 and authorize the finance department to make any necessary transfers.  (Public Works)
  
 
3.
Consideration and action to approve a contract with M.R. Tanner for FY23 pavement maintenance
work for an amount of $787,705.18 and authorize finance to make any necessary transfers. (Public
Works)
  
 
4.
Consideration and action to approve Resolution R22-09-21 in order to allow alcoholic beverages to
be served and consumed at specific City of El Mirage Special Events for the FY2022/2023 event
season. (Community Services)
  
 
5.
Consideration and action to approve the MOU with AZ Department of Public Safety for the
purpose of conducting joint law enforcement training or attending law enforcement training hosted
by either party through 6/30/27 with one 5-year automatic renewal. (Police)
  
 
6.
Consideration and action to approve the purchase of computers, laptops, docks and monitors with
Dell in an amount not to exceed $51,659.43 with a contingency of $840.57, for a total or
$52,500 utilizing the State of Arizona Contract ADSPO16-098163. (Information Technology)
  
 
7.
Consideration and action to approve a three-year subscription agreement with CDW Direct for
software licenses including Cisco Collaboration Flex at an annual cost not to exceed $16,105.34
($15,150.84 + applicable sales tax of $954.50) in Fiscal Years 2023, 2024, and 2025 for a total of
$48,316.02 ($45,452.52 + applicable sales tax of $2,863.50) over the three years and waiving the
formal purchase requirement.  (Information Technology)

Consideration and action to authorize the City Manager to sign a purchasing agreement to acquire
the right to use OpenGov Procurement to assist in the management of the procurement process and
contract storage for an FY 2023 cost not to exceed $22,276. (Finance)  
  
 
9.
Consideration and action to authorize the City Manager to enter into a contract with Willdan
Financial Services and Pat Walker Consulting LLC (collectively the Willdan Team) to complete a
water, sewer, and sanitation rate study for a cost not to exceed $36,140 and waive the competitive
bid process. (Administration)
  
 
10.
Consideration and action to approve Bond Reimbursement Resolution R22-09-22. 
(Administration)
  
 
11.
Consideration and action to fill the vacancy on the Public Safety Sub-Committee, created by the
resignation of Councilmember Hutchinson, with Vice Mayor Dorcey.  (Councilmembers Shapera
and Winston)

Vice Mayor Dorcey moved to approve the Consent Agenda items 1-11 as presented; seconded by
Councilmember Shapera. 
 
Vote: 5 - 0 Passed - Unanimously
 
6.
REGULAR AGENDA
 
1.
Consideration and action to approve Ordinance O22-09-06 setting forth and fixing the dates, times,
and location of the 2023 City Council Meetings.  (City Clerk)
  
 
 
Vice Mayor Dorcey moved to approve Ordinance O22-09-06 setting forth and fixing the dates,
times, and location of the 2023 City Council Meetings, as presented; seconded by Councilmember
Shapera. 
 
Vote: 5 - 0 Passed - Unanimously
 
7.
CITY MANAGER'S COMMENTS & SUMMARY OF CURRENT EVENTS 
The City Council may not act upon any matter in the City Manager's summary but may have
general comment or questions.
City Manager Crystal Dyches stated she has met with Dr. Grooms and Ms. Watkins regarding the
upcoming events, and she has been asked to find out which council members would like to
participate in the winter festival parade.  She asked that council members let her know in the
coming weeks if they would like to participate.  
 
8.
MAYOR'S COMMENTS and COUNCIL SUMMARY OF CURRENT EVENTS 
The Mayor and City Council may not discuss or act upon any matter in the summary unless the
specific matter is properly noticed for legal action.
Councilmember Norton stated the El Mirage Cares Forum with Teen Lifeline would take place
on virtually on Wednesday, September 21, 2022.  If anyone would like to participate they can
RSVP online.  Councilmember Norton also stated there will be a virtual event to recognize
Domestic Violence in October on the 19th.  Councilmember Shapera asked Fire Chief Michael
Long if there was a snake removal that had taken place in the city and Chief Long stated a baby
rattlesnake was removed and relocated to a safer location.  
 
9.
EXECUTIVE SESSION
 
1.
Consideration and action to convene in Executive Session pursuant to A.R.S. § 38-431.03.A.3,
A.4, and A.7 for legal advice, consultation, and instructions pertaining to negotiations on two
parcels of land in two separate subdivisions and contemplated litigation pertaining to same.
