D R A F T REGULAR MEETING OF THE COMMON COUNCIL OF THE CITY OF EL MIRAGE EL MIRAGE CITY COUNCIL CHAMBERS 10000 N. EL MIRAGE ROAD 6:00 PM -WEDNESDAY, JANUARY 4, 2023 Minutes 1. ROLL CALL Present: Mayor Alexis Hermosillo; Vice Mayor David Shapera; Councilmember Roy Delgado; Councilmember Monica Dorcey; Councilmember Bob Jones; Councilmember Anita Norton; Councilmember Donna Winston (via phone) 2. CALL TO ORDER - MEETING CALLED TO ORDER AT 6:00 PM Pledge of Allegiance Moment of Silence Introduction of new City employees - Police Chief Paul Marzocca introduced Police Officer Michael Pissos, Police Assistant Dylan Wendt, Police Records Technician, Senior, Brieanna Vega and Police Records Technician, Senior, Izabella Abrams. Public Works Director Nick Russo introduced Environmental Technician Sean Lynch. 3. PRESENTATION 1. Consideration for the Veterans of Foreign Wars (VFW) Post 285 to recognize and present Senior Property and Evidence Technician, Jason Michael, the 2022 VFW Police Employee of the Year Award, (Police), and Firefighter Paramedic Tyler Werth, the 2022 VFW Firefighter of the Year Award. (Fire) Post Commander Glenn Stark gave a brief background on Jason Michael's and Tyler Werth's service and presented both with the 2022 VFW Police Employee and Firefighter of the Year Award, respectively. Mayor Hermosillo thanked everyone for their service to the community. 2. State and federal legislative update for the 2023 legislative session. Deputy Director of Intergovernmental Affairs Amber Wakeman gave an update on the upcoming 2023 legislative session which included information on state and federal legislative issues that she will be monitoring. She will be providing updates to Council on issues that may affect El Mirage as they occur. 4. CALL TO THE PUBLIC Citizens desiring to speak on any issue within the jurisdiction of the public body may do so at this time. Comments shall be limited to three (3) minutes per person and shall be addressed to the City Council as a whole. At the conclusion of the Call to the Public, individual City Council Members may (1) respond to criticism made by those who have spoken, (2) direct staff to review or follow up on the matter, and/or (3) direct that the matter be put on a future agenda. Resident Austin Buck explained an issue his mother is having with Code Enforcement regarding vehicles being parked on their property. He has been unable to meet with Council or the Mayor to discuss the issue and would like to have time to discuss the matter with them to assist his mother. Resident Maribel Buck stated her son is trying to help her address the issues with Code Enforcement and she needs to speak with Council about the matter. She is willing to work with the City so that she can continue to run her business from her property and not violate any zoning codes. 5. CONSENT AGENDA All items listed under the Consent Agenda will be voted on with one motion. If discussion is desired regarding any Consent Agenda Item, that item will be removed from the Consent Agenda and voted on separately. 1. Consideration and action to approve the minutes of the Work Session and the Regular Council meeting held Tuesday, December 6, 2022. (City Clerk) 2. Consideration and action to approve the destruction of municipal documents that have reached the end of their retention period as authorized under A.R.S. § 41 -15I.19. (City Clerk) 3. Consideration and action to approve the new price list from TransUnion that will lower our monthly costs to $110.00 per month, moving forward within our contract. (Police) 4. Consideration and action to authorize the City Manager to enter into a Development Agreement with EYS West Valley Holding, LLC, in connection with the El Mirage Outpatient Treatment Center located at the southwest corner of El Mirage Road and Cactus Road. (Development Services) Vice Mayor Shapera moved to approve Consent Agenda items 1-4 as presented; seconded by Councilmember Dorcey. Vote: 7 - 0 Passed - Unanimously 6. REGULAR AGENDA 7. CITY MANAGER'S COMMENTS & SUMMARY OF CURRENT EVENTS The City Council may not act upon any matter in the City Manager's summary but may have general comment or questions. City Manager Dyches wished everyone a Happy New Year and stated the Strategic Planning Meeting will be held on January 12, 2023 at 9:00 am. 2 Regular Meeting - Council Minutes January 4, 2023 8. MAYOR'S COMMENTS and COUNCIL SUMMARY OF CURRENT EVENTS The Mayor and City Council may not discuss or act upon any matter in the summary unless the specific matter is properly noticed for legal action. Vice Mayor Shapera asked staff to remove the political signs that are still posted around the City. He also stated the holiday lights were very nice. Councilmember Delgado stated there were too many gunshots and fireworks over the holiday, and it is time to curb the use of both. Councilmember Dorcey stated Public Works did a great job decorating the City for the holidays. Councilmember Jones stated the holiday decorations looked great, Public Works did a wonderful job on them, and he has received numerous complaints regarding the use of fireworks over the holiday. Councilmember Norton stated Public Works did a wonderful job decorating the City and wished everyone a Happy New Year. Councilmember Winston stated the decorations, parade and Winterfest were all wonderful. Mayor Hermosillo thanked everyone involved in the recent raids on Luna Street and appreciates the hard work being put into cleaning up the City. 9. EXECUTIVE SESSION 1. Consideration and action to adjourn into Executive Session pursuant to A.R.S. § 38-431.03.A.1. for the annual review of the Court Judge contract and performance evaluation. (Council) Vice Mayor Shapera moved to adjourn into Executive Session pursuant to A.R.S. § 38-431.03.A.1 for the annual review of the Court Judge contract and performance evaluation; seconded by Councilmember Delgado. Vote: 7 - 0 Passed - Unanimously 10. RECONVENE - MEETING RECONVENED AT 7:19 PM 1. Consideration and action to approve updates to the Judge's contract as discussed in Executive Session on 1/04/2023.
