O23-01-01 Zoning Code Amendment

ORDINANCE O23-01-01 
 
AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE CITY OF EL MIRAGE, ARIZONA, 
AMENDING THE CITY OF EL MIRAGE ZONING CODE, CHAPTER 154, SECTION § 154.036 (D) 
ORGANIZATION, TO PROVIDE FOR THE COUNCIL TO APPOINT A CHAIRPERSON FROM 
THE MEMBERS FROM THE PLANNING AND ZONING COMMISSION AND DECLARING AN 
EMERGENCY.   
 
 
WHEREAS, City Council wishes to update the Zoning Code from time to time to more accurately reflect current 
conditions and realistic needs of the City; and 
 
 
WHEREAS, City Council desires to amend Section § 154.036 of the Zoning Code to provide that the Council 
appoint a chairperson from the members from the Planning and Zoning Commission; and 
 
WHEREAS, it is necessary for the usual daily operation of the municipality and for the immediate preservation 
of the public peace, health, safety and general welfare of the City that this ordinance be declared an emergency and take 
effect immediately after Council approval. 
 
 
 
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of El Mirage, Arizona that 
the City of El Mirage Zoning Code be amended as follows: 
 
Section 1.   
(D)   Organization. The Planning and Zoning Commission CITY COUNCIL shall APPOINT a 
Chairperson from the members of the Planning and Zoning Commission and shall create and fill 
such other of its offices as it may determine…” 
 
Section 2.   
Due to the urgent need for the implementation of Council’s authority to appoint a Chairperson for the 
Planning & Zoning Commission for the smooth and orderly operation of such Commission, the immediate  
operation  of  this  Ordinance  is necessary  for the  preservation  of  the health,  safety, and general welfare. 
An emergency is hereby declared to  exist  and  this  Ordinance  shall  be  in  full  force and  effect  from  
and  after  its  passage  and  approval  by  the  Mayor  and  Council  as required  by  law.
