PRESENTATION
 
1.
Presentation of the 2022 Annual Report.  (Administration)
City Manager Dyches presented the 2022 Annual Report for the City of El Mirage detailing
previous year's accomplishments from each City department.
  
 
4.
PROCLAMATION
 
1.
Proclamation for Teen Dating Violence Prevention and Awareness Month February 2023.
(Administration)
Councilmember Norton provided background information on teen dating violence prevention
and awareness month. 
Mayor Hermosillo proclaimed February 2023 as Teen Dating Violence Prevention and Awareness
Month.
  
 
5.
CALL TO THE PUBLIC
Citizens desiring to speak on any issue within the jurisdiction of the public body may do so at this
time. Comments shall be limited to three (3) minutes per person and shall be addressed to the City
Council as a whole. At the conclusion of the Call to the Public, individual City Council Members
may (1) respond to criticism made by those who have spoken, (2) direct staff to review or follow
up on the matter, and/or (3) direct that the matter be put on a future agenda.
Resident Scottie Gentry spoke about the history of Bill Gentry Park and the contributions to the
city from her father, Mr. Bill Gentry. Ms. Gentry asked Council not to make changes to the

baseball field at the park.  Resident Ernie Sinclair stated he was not aware of a survey sent to
residents and explained his group, Desert King Baseball, plays on the baseball field regularly. 
Resident Angelina Morales Solis stated she is the great-granddaughter of Bill Gentry, and she
does not want to see the park changed or the family history lost.  Resident Natalia Morales stated
she was speaking for Anita Gentry, the eldest daughter of Bill Gentry, and they do not want to see
the baseball field replaced with a soccer field.  Resident Kirstie Limon stated many residents have
grown up playing on that baseball field and they do not want to see it removed.  Cindy Olivares
stated she is the daughter of Bill Gentry and her father built that baseball field.  Ms. Olivares
stated she is against the new plans for the park and any changes made would destroy the legacy. 
Resident Consuelo Vasquez stated she appreciates all that Council has done for the City, but she is
concerned that changing Bill Gentry park would destroy a legacy.  Ms. Vasquez stated it would be
unfair to proceed with the plans without asking for community input.
 
6.
CONSENT AGENDA
All items listed under the Consent Agenda will be voted on with one motion. If discussion is
desired regarding any Consent Agenda Item, that item will be removed from the Consent Agenda
and voted on separately.
 
1.
Consideration and action to approve the minutes of the Work Session and Regular Council
meeting held Wednesday, January 18, 2023. (City Clerk)
  
 
2.
Consideration and action to approve the destruction of municipal documents that have reached the
end of their retention period as authorized under A.R.S. § 41 -15I.19. (City Clerk)
  
 
3.
Consideration and action to approve an updated FY 2023-24 agreement for legal services with
Pierce Coleman PLLC at an annual flat fee of $240,000.  (Administration)
  
 
4.
Consideration and action to request and accept, if awarded, an Assistance to Firefighters Grant
(AFG) from the Department of Homeland Security (DHS) for an approximate amount of
$111,215 for a Direct Recirculating Apparatus Firefighting Training & Sustainability (DRAFTS)
Unit apparatus that will aid in training for the El Mirage Fire Department and authorize Finance
to make necessary budget transfers. (Grants/Fire)
  
 
5.
Consideration and action to approve the fourth extension of four one-year periods for the Senior
Center congregate meal service with Banner Olive Branch Senior Center for an amount not to
exceed $27,000 per year. (Community Services)
  
 
6.
Consideration and action to request and accept funds, if awarded, for an FY2023 Arizona
Department of Homeland Security (AZDHS) State Homeland Security Grant and/or Urban Areas
Security Initiative Grant in an approximate amount of $10,000 for the El Mirage Fire Department
to seek training opportunities, provide training for Emergency Management and conduct training
for the City of El Mirage Employees, and authorize Finance to make necessary budget transfers.

7.
Consideration and action to enter into an Intergovernmental Agreement (IGA) with the Arizona
Department of Transportation (ADOT) to construct pedestrian and bicycle improvements along
Varney Road and authorize payment to ADOT as per the agreement. (Development Services)

8.
Consideration and action to approve a final plat to accept and record a dedication of land and
public utility easements for a 13.26-acre development located at the southeast corner of El
Mirage Road and Joe R Ramirez Road submitted by Cold Water Holdings, LLC.  (Development
Services)
  
 
9.
Consideration and action to enter into a Development Agreement with CarMax, Inc. in
connection with the proposed vehicle reconditioning and wholesale auction facility located at the
northwest corner of Olive Avenue and Dysart Road. (Development Services)
  
 
10.
Consideration and action to enter into a Development Agreement with DPML Copperwing LLC
in connection with the proposed multi-building industrial facility located at the northeast corner of
Olive Avenue and Dysart Road. (Development Services)
  
 
11.
Consideration and action to enter into an Intergovernmental Agreement (IGA) with the Arizona
Department of Transportation (ADOT) to construct roadway improvements along 121st Avenue
and authorize payments to ADOT as identified in the IGA. (Development Services) 
  
 
12.
Consideration and action to allow parking restrictions on the east side of 124th Lane between
Acoma Drive and Hearn Road in the Rancho El Mirage neighborhood. (Development Services)
  
 
13.
Consideration and action to waive formal purchase requirements under El Mirage City Code §
30.23 PURCHASING AUTHORITY section  (B) (3) and to approve the use of Chasse Building
Team to complete Capital Improvement Project (CIP) 62345 Customer Service Facility in an
amount not to exceed $620,000 and authorize the finance department to make any necessary
transfers. (Public Works)
  
 
 
Vice Mayor Shapera moved to approve Consent Agenda items 1-13 as presented; seconded by
Councilmember Dorcey. 
 
Vote: 7 - 0 Passed - Unanimously
 
7.
REGULAR AGENDA
 
1.
Consideration and action to appoint Brian Campbell-Sanderfield to fill a vacancy on the Planning
& Zoning Commission with a term that expires June 30, 2026.  (Commission Review Board -
Mayor Hermosillo, Councilmembers Norton, and Shapera)
  
 
 
Vice Mayor Shapera moved to appoint Brian Campbell-Sanderfield to fill a vacancy on the
Planning & Zoning Commission with a term that expires June 30, 2026, as presented; seconded
by Councilmember Norton. 
 
Vote: 7 - 0 Passed - Unanimously

CITY MANAGER'S COMMENTS & SUMMARY OF CURRENT EVENTS 
The City Council may not act upon any matter in the City Manager's summary but may have
general comment or questions.
City Manager Dyches had no comments.

MAYOR'S COMMENTS and COUNCIL SUMMARY OF CURRENT EVENTS 
The Mayor and City Council may not discuss or act upon any matter in the summary unless the
specific matter is properly noticed for legal action.
Vice Mayor Shapera stated he attended the tree planting event on February 4, 2023, and he was
pleased to see so many volunteers participating.  Councilmember Delgado stated the CDAC
scores will be announced next week for upcoming CDBG projects.  Councilmember Jones
stated the Tailgate Event on February 6, 2023, was a lot of fun and congratulated the Police
department on their hard work solving recent difficult cases.  Councilmember Norton stated
there will be Domestic Violence webinars presented at the library throughout the month of
February that are free and are being recorded for future viewing.  Councilmember Winston
stated the groundbreaking ceremony at the new Emergency Center on El Mirage Road was
amazing, and the Tailgate Event was also a lot of fun.  Mayor Hermosillo thanked staff for all of
their hard work on the annual report and reminded all that February is also water conservation
month.  Councilmember Winston added that the YMCA accepts some medical insurance and
residents should check to see if their insurance is accepted.
