PROCLAMATION
 
1.
Consideration and action to proclaim February 1 through February 28, 2023, as Water Awareness
Month in El Mirage. (Public Works)
Public Works Director Nick Russo provided a brief background on Water Awareness Month.
Mayor Hermosillo proclaimed February 2023 as Water Awareness Month and encouraged
residents to look for ways to preserve water.
  
 
4.
CALL TO THE PUBLIC
Citizens desiring to speak on any issue within the jurisdiction of the public body may do so at this
time. Comments shall be limited to three (3) minutes per person and shall be addressed to the City
Council as a whole. At the conclusion of the Call to the Public, individual City Council Members
may (1) respond to criticism made by those who have spoken, (2) direct staff to review or follow
up on the matter, and/or (3) direct that the matter be put on a future agenda.
Resident Maureen Redding detailed some concerns that the Senior Center members have regarding
the operation of the center.  Mayor Hermosillo thanked Ms. Redding for bringing the concerns to
Council and asked City Manager Dyches to assist with moving forward on addressing the concerns.
 
5.
CONSENT AGENDA
All items listed under the Consent Agenda will be voted on with one motion. If discussion is
desired regarding any Consent Agenda Item, that item will be removed from the Consent Agenda
and voted on separately.

Consideration and action to approve the minutes of the Regular Council meeting held Wednesday,
January 4, 2023. (City Clerk)
  
 
2.
Consideration and action to approve the destruction of municipal documents that have reached the
end of their retention period as authorized under A.R.S. § 41 -15I.19. (City Clerk)
  
 
3.
Consideration and action to request Arizona Lottery Funds (ALF) from Valley Metro in an
estimated amount of $90,694 for local and regional dial-a-ride services with Northwest Valley
Connect, Valley Metro and/or another provider for FY2023 and authorize the Finance Director to
transfer funds and make necessary changes. (Grants/Community Services)

Consideration and action to accept the 2022 Gentry Park Master Plan.  (Development Services)

Consideration and action to authorize the City Manager to enter into a construction contract with
Standard Construction Company, Inc., once Maricopa County receives approval from the U.S.
Department of Housing and Urban Development (HUD), to construct a 12-foot wide multi-use trail
along the drainage channel between the 130th Drive & Sweetwater Avenue intersection and the
123rd Lane & Cactus Road intersection in an amount of $1,212,203 (plus a 10% construction
contingency of $121,220) for a total amount of $1,333,423.  (Development Services)

Consideration and action to approve On-Call Engineering Plan Review and Inspection Services
contract EM23-INSP01 with Consultant Engineering, Inc. (CEI) at a cost not to exceed $70,000 in

Consideration and action to use City of Peoria JOC No. ACON53118 with Redhawk solutions for
the purpose of installing emergency pre-emption systems on Grand Avenue at the intersections of
Thunderbird Road/Thompson Ranch Road and Primrose Street for the amount of $55,140
including a 20% contingency.  (Development Services)

Consideration and action to approve the purchase of a 2022 Ford Explorer from Sanderson Ford
under State of Arizona Procurement Contract CTR059316 at a cost not to exceed $45,893.99.  (Fire)
  
 
9.
Consideration and action to extend the existing contract with Idemia for the Police Department's
LiveScan machine (electronic fingerprinting) in the amount of $6,550.00 for FY22/23. (Police)
  
 
10.
Consideration and action to approve the purchase of an unmarked 2022 Ford F150 XLT 4X4 for
NET (Neighborhood Enforcement Team) at a cost not to exceed $67,000 ($65,167.93 plus a
contingency of $1832.07), under state contract CTR059316 from Sanderson Ford. (Police)

Consideration and action to approve the use of Fishel Company to complete CIP 62316 Influent
Line Replacement at Water Reclamation Facility in an amount not to exceed $531,247.93 and
authorize the finance department to make any transfers.  (Public Works)
  
 
 
Vice Mayor Shapera moved to approve Consent Agenda items 1-4 and 6-11, as presented;
seconded by Councilmember Dorcey.

REGULAR AGENDA
6.1.a Consideration and action to authorize the City Manager to enter into a construction contract
with Standard Construction Company, Inc., once Maricopa County receives approval from the
U.S. Department of Housing and Urban Development (HUD), to construct a 12-foot wide multi-use
trail along the drainage channel between the 130th Drive & Sweetwater Avenue intersection and
the 123rd Lane & Cactus Road intersection in an amount of $1,212,203 (plus a 10% construction
contingency of $121,220) for a total amount of $1,333,423. (Development Services)
Vice Mayor Shapera stated he asked to pull this item from Consent because he does not think this
project is good for the City, and it is too much money to spend on a trail.  Councilmember
Delgado stated the money for the project is not coming from the City.  Vice Mayor Shapera stated
the light fixtures will be disturbing to residents and asked how much this will cost El Mirage.  City
Engineer Jorge Gastelum stated there is no money needed from the City as the funding has already
been provided by other means.  Councilmember Dorcey stated people are already walking through
the wash and this project will increase the number of people who use it. Councilmember Norton
stated that residents have told her they are looking forward to using the trail and the project could
cut down on mischief in the area.  Mr. Gastelum stated safety is a concern for the area, and he has
met with the Police Department to share ideas for the area's safety improvements. 
Councilmember Jones stated it would be beautiful once completed, and he has also spoken with
residents who are looking forward to its completion.  
Councilmember Dorcey moved to authorize the City Manager to enter into a construction contract

Public Hearing, closure of Public Hearing followed by consideration and action to recommend to
the Arizona Department of Liquor Licenses & Control approval/disapproval of an application for a
new license (#219114) for Comiendo Con Memo #2, 12313 NW Grand Av #F & #G, El Mirage,
AZ, 85335. (Police)
Mayor Hermosillo opened the Public Hearing.
Police Chief Paul Marzocca gave a brief presentation on the application submitted by Comiendo
Con Memo and stated there is no recommendation from the Police Department.  Councilmember
Jones asked what no recommendation means and Chief Marzocca stated the department has no
objection to the application.
Hearing no public comments Mayor Hermosillo closed the Public Hearing.
  
 
 
Vice Mayor Shapera moved to recommend to the Arizona Department of Liquor Licenses &
Control approval of an application for a new license (#219114) for Comiendo Con Memo #2, as
presented; seconded by Concilmember Winston. 
 
Vote: 7 - 0 Passed - Unanimously

Consideration and action to approve Ordinance O23-01-01 amending Zoning Code, Chapter 154,
Section 154.036, allowing Council to appoint a Chairperson from the members of the Planning and
Zoning Commission and create and fill such other offices as may be determined and declaring an
emergency. (Vice Mayor Shapera and Councilmember Dorcey)
Vice Mayor Shapera stated it is time for a change in the Planning and Zoning Commission, and it
has been difficult to fill the chairperson seat.  Vice Mayor Shapera also stated the City will have
leadership training provided to all members of the Commission.
  
 
 
Vice Mayor Shapera moved to approve Ordinance O23-01-01 amending Zoning Code, Chapter
154, Section 154.036, allowing Council to appoint a Chairperson from the members of the
Planning and Zoning Commission and create and fill such other offices as may be determined and
declaring an emergency, as presented; seconded by Councilmember Dorcey. 
 
Vote: 7 - 0 Passed - Unanimously

Consideration and possible action to discuss, nominate and appoint a Planning and Zoning
Commission Chairperson and Vice Chairperson pursuant to Zoning Code 154.036.  (Vice Mayor
Shapera and Councilmember Dorcey)
  
 
 
Vice Mayor Shapera moved to appoint Marie Houston as the Planning and Zoning Commission
Chairperson and appoint Lupe Amarillas as the Planning and Zoning Commission Vice
Chairperson pursuant to Zoning Code 154.036, seconded by Councilmember Dorcey. 
 
Vote: 7 - 0 Passed - Unanimously
 
7.
CITY MANAGER'S COMMENTS & SUMMARY OF CURRENT EVENTS 
The City Council may not act upon any matter in the City Manager's summary but may have
general comment or questions.
City Manager Dyches reminded staff of the CIP work session on February 6, 2023 at 9:00 am.
 
8.
MAYOR'S COMMENTS and COUNCIL SUMMARY OF CURRENT EVENTS 
The Mayor and City Council may not discuss or act upon any matter in the summary unless the
specific matter is properly noticed for legal action.
Vice Mayor Shapera congratulated the Police Department on the arrests in the latest
investigation.  Councilmember Delgado also congratulated the Police Department.
Councilmember Dorcey encouraged staff to consider another bulk trash event.  Councilmember
Norton reminded everyone that February is Teen Violence Awareness Month and there will be
webinars presented at the library for residents.  Councilmember Winston stated she appreciates all
the hard work staff does for the City and encouraged all veterans to seek help for any issues they
may be experiencing.
