D R A F T REGULAR MEETING OF THE COMMON COUNCIL OF THE CITY OF EL MIRAGE EL MIRAGE CITY COUNCIL CHAMBERS 10000 N. EL MIRAGE ROAD 6:00 PM -TUESDAY, MARCH 7, 2023 Minutes 1. ROLL CALL Present: Mayor Alexis Hermosillo; Vice Mayor David Shapera; Councilmember Roy Delgado; Councilmember Monica Dorcey; Councilmember Bob Jones; Councilmember Anita Norton; Councilmember Donna Winston 2. CALL TO ORDER - MEETING CALLED TO ORDER AT 6:00 PM Pledge of Allegiance Moment of Silence Introduction of new City employees Police Chief Paul Marzocca introduced Police Officers Heather Rick, Tyler Winger and Jason Cardoza. 3. PRESENTATION 1. El Mirage State of the City 2023 Presentation. (Administration) Mayor Hermosillo provided a brief introduction on the events that have taken place in El Mirage in 2022 then introduced the State of the City 2023 video. 2. Dysart Unified School District El Mirage Essay Contest Deputy Director of Intergovernmental Affairs Amber Wakeman detailed the recent essay contest about El Mirage at the Valley Vista High School and the El Mirage Elementary School. Mayor Hermosillo introduced the winners in the elementary school contest as: Third place, Kaleb Rodriguez, Second place, Lejla Tvrtkovic, and first place, Esmeraldo Martinez. Mayor Hermosillo then announced the winners of the high school contest as: First place, Nathaniel Cosio, and Second place, Andre Mena. Pictures with Council and family were taken for the elementary school winners who were in attendance at the meeting. 4. CALL TO THE PUBLIC Citizens desiring to speak on any issue within the jurisdiction of the public body may do so at this time. Comments shall be limited to three (3) minutes per person and shall be addressed to the City Council as a whole. At the conclusion of the Call to the Public, individual City Council Members may (1) respond to criticism made by those who have spoken, (2) direct staff to review or follow up on the matter, and/or (3) direct that the matter be put on a future agenda. Resident Larry Wise spoke regarding the Medical Equipment Lending Center to explain how his organization supports residents in Youngtown, El Mirage, Surprise and Peoria by providing medical equipment at no cost. Mr. Wise stated they are able to provide the equipment at no cost thanks to grants provided by communities and would like El Mirage to look into possible grants available that can support his organization. Resident Scottie Gentry stated she attended the work session on March 6, 2023, regarding the bond proposal. She asked if the bond would be one question or separate questions and would like someone to clarify the specifics of the bond for her. 5. CONSENT AGENDA All items listed under the Consent Agenda will be voted on with one motion. If discussion is desired regarding any Consent Agenda Item, that item will be removed from the Consent Agenda and voted on separately. 1. Consideration and action to approve the minutes of the Regular Council meeting held Wednesday, February 22, 2023. (City Clerk) 2. Consideration and action to approve the destruction of municipal documents that have reached the end of their retention period as authorized under A.R.S. § 41 -15I.19. (City Clerk) 3. Consideration and action to approve the destruction of municipal documents that have reached the end of their retention period. (Police) 4. Consideration and action to approve the purchase of two message boards from Centerline Supply using ARPA funds in an amount not to exceed $40,187.54 and authorize finance to make any necessary transfers. (Public Works) 5. Consideration and action to approve the use of Corporate Technology Solutions to complete the installation of fiber network connection for Capital Improvement Project (CIP) 62345 Customer Service Facility in an amount not to exceed $34,000 and authorize the finance department to make any necessary transfers. (Public Works) 6. Consideration and action to approve purchase of a mobile light tower from American Highway Solutions in an amount not to exceed $11,237.30 and authorize the finance department to make any necessary transfers. (Public Works) 7. Consideration and action to authorize the City Manager to enter into a Professional Services Contract with Lee Engineering, LLC to provide a Traffic Signal Needs Study for the intersection of Thunderbird Road & Luna Street in an amount not to exceed $9,100. (Development Services) This item moved to Regular Agenda. 8. Consideration and action to authorize the City Manager to enter into a multi-year contract with ClearGov Inc. to enhance the budget and strategic software system with additional modules of ClearPlans for an amount not to exceed $8,500 for fiscal year 2024. (Administration) 2 Regular Meeting - Council Minutes March 7, 2023 Vice Mayor Shapera moved to approve Consent Agenda items 1-6, and 8 as presented; seconded by Councilmember Delgado. Vote: 7 - 0 Passed - Unanimously 6. REGULAR AGENDA 6. a Consideration and action to authorize the City Manager to enter into a Professional Services Contract with Lee Engineering, Inc., to provide a Traffic Signal Needs Study for the intersection of Thunderbird Road & Luna Street in an amount not to exceed $9,100. (Development Services) Vice Mayor Shapera stated he is concerned about the heavy traffic in this area of the City and would like this item's cost increased to $15,000 to provide for a more comprehensive study. Councilmember Dorcey asked if it would include nearby streets and Vice Mayor Shapera answered yes. Councilmember Delgado agreed that the area needs to be evaluated. Mayor Hermosillo stated she is aware of resident's concerns regarding traffic in this area. Vice Mayor Shapera moved to authorize the City Manager to enter into a Professional Services Contract with Lee Engineering, Inc., to provide a broadened Traffic Signal Needs Study to improve roadway access on Thunderbird Road between Frontage Road and Verbena in an amount not to exceed $15,000, seconded by Councilmember Dorcey. Vote: 7 - 0 Passed - Unanimously 1. Consideration and action on a site plan zoning application for a Data Center operation on 121 acres of vacant land located at the southwest corner of El Mirage Road and Peoria Avenue submitted by H & H Capitol Acquisition. (Development Services, Planning and Zoning) City Engineer Jorge Gastelum provided background information on the site plan zoning application. Councilmember Norton asked what the setback on Peoria Avenue would be and Mr. Gastelum stated there is a twenty-foot landscape buffer and the building setback is 100 feet. Vice Mayor Shapera stated the project looks good. Councilmember Dorcey asked if the applicant would explain how long it will take to complete phase three and how many employees would be on-site. Brett Collard with Compass Data Centers advised they plan on completing the first building in the second quarter of 2025 and a new building each year thereafter. Mr. Collard also stated there would be approximately thirty-five employees for each building. Councilmember Dorcey stated this is a desirable project for the area. Councilmember Delgado asked if operations in the buildings would be twenty-four hours a day or normal business hours and Mr. Collard stated the operations would be twenty-four hours each day. Councilmember Delgado asked if a traffic signal would be installed on Peoria Avenue for this project and Mr. Gastelum stated the entrance on Peoria Avenue would be for emergency access only. Councilmember Jones asked what type of activity would be taking place in the buildings and Mr. Collard stated the buildings will be data centers that host multiple servers. Vice Mayor Shapera moved to approve a site plan zoning application for a Data Center operation on 121 acres of vacant land at the southwest corner of El Mirage Road and Peoria Avenue submitted by H&H Capital Acquisitions, seconded by Councilmember Dorcey. Vote: 7 - 0 Passed - Unanimously 3 Regular Meeting - Council Minutes March 7, 2023 7. CITY MANAGER'S COMMENTS & SUMMARY OF CURRENT EVENTS The City Council may not act upon any matter in the City Manager's summary but may have general comment or questions. City Manager Dyches stated the Downtown Revitalization Plan is currently being developed, and she invited everyone to attend a Community Workshop at the El Mirage Senior Center on March 16, 2023, from 5:30 pm until 7:30 pm, to provide input to guide the vision of downtown El Mirage. 8. MAYOR'S COMMENTS and COUNCIL SUMMARY OF CURRENT EVENTS The Mayor and City Council may not discuss or act upon any matter in the summary unless the specific matter is properly noticed for legal action. Vice Mayor Shapera asked the Police Department to increase visibility at City parks and use contingency funding to support this effort. Vice Mayor Shapera also stated he would like to add to a future agenda a discussion regarding a Recreation Director; he also participated in Read Across America at elementary schools and it went very well. Councilmember Dorcey stated Proposition 400 is in need of support as it is very important to the West Valley and would like to hear an update on its progress and how to get involved in supporting it. Councilmember Jones stated the State of the City presentation was outstanding and agreed with Vice Mayor Shapera on the Recreation Director position and increased presence at City parks. Councilmember Winston stated Council had not proposed to change the name of Gentry Park and they have only approved a consultant to provide options to refresh the park. Councilmember Winston also stated the recent Music in the Park event was amazing. 9. ADJOURNMENT - MEETING ADJOURNED AT 6:52 PM _____________________________ Alexis A.
