D R A F T REGULAR MEETING OF THE COMMON COUNCIL OF THE CITY OF EL MIRAGE EL MIRAGE CITY COUNCIL CHAMBERS 10000 N. EL MIRAGE ROAD 6:00 PM -TUESDAY, APRIL 4, 2023 Minutes 1. ROLL CALL Present: Mayor Alexis Hermosillo; Vice Mayor David Shapera; Councilmember Roy Delgado; Councilmember Monica Dorcey; Councilmember Bob Jones; Councilmember Anita Norton; Councilmember Donna Winston (via phone) 2. CALL TO ORDER - MEETING CALLED TO ORDER AT 6:00 PM Pledge of Allegiance Moment of Silence 3. PROCLAMATION 1. Proclamation to recognize Week of the Young Child April 1-7, 2023. Deputy Director of Intergovernmental Affairs Amber Wakeman provided background information on the Week of the Young Child and introduced Community Outreach Coordinator with First Things First Nicole Yezzi. Ms. Yezzi also provided information on the positive impact their program has on local children. Mayor Hermosillo proclaimed April 1-7, 2023, as Week of the Young Child. 2. Proclamation to proclaim April 2023 as Fair Housing Month. Community Services Manager Autumn Grooms provided information on the Fair Housing Amendments Act of 1988 that provides full and fair housing opportunities to residents. Mayor Hermosillo proclaimed April 2023 as Fair Housing Month. 4. CALL TO THE PUBLIC Citizens desiring to speak on any issue within the jurisdiction of the public body may do so at this time. Comments shall be limited to three (3) minutes per person and shall be addressed to the City Council as a whole. At the conclusion of the Call to the Public, individual City Council Members may (1) respond to criticism made by those who have spoken, (2) direct staff to review or follow up on the matter, and/or (3) direct that the matter be put on a future agenda. Resident Scottie Gentry asked why there were no minutes or audio yet posted from the Recreation Subcommittee meeting and also if all public records request responses copied the City Manager. Ms. Gentry also stated residents in Sundial IV do not want the storage development to be approved. Resident Cindy Olivares stated she spoke at the February 7, 2023, meeting and was told someone would get back to her regarding her comments. Ms. Olivares stated the Call to the Public form should be changed to include an address and phone number so staff can get back to those who speak. Ms. Olivares stated now is not a good time to ask residents to pay for improvements and she is not in favor of the bond. 5. CONSENT AGENDA All items listed under the Consent Agenda will be voted on with one motion. If discussion is desired regarding any Consent Agenda Item, that item will be removed from the Consent Agenda and voted on separately. 1. Consideration and action to approve the minutes of the Work Session and Regular Council meeting held Tuesday, March 21, 2023. (City Clerk) 2. Consideration and action to approve the destruction of municipal documents that have reached the end of their retention period. (Police) 3. Consideration and action to approve the purchase of 6 radios and equipment for 6 Police Vehicles from Motorola Solutions for an amount not to exceed $43,025.08 ($41,825.08 payment plus a $1,200.00 trade-in) and authorize the Finance Department to make necessary transfers. (Police) 4. Consideration and action to approve the purchase of one portable radio from Motorola Solutions for a Police Lieutenant for an amount not to exceed $6,770.17 ($6,495.17 payment plus a $275.00 trade-in) and authorize the Finance Department to make necessary transfers. (Police) 5. Consideration and action to approve the purchase of one portable radio from Motorola Solutions for a Police School Resource Officer for an amount not to exceed $6,770.17 ($6,495.17 payment plus a $275.00 trade-in) and authorize the Finance Department to make necessary transfers. (Police) 6. Consideration and action to approve the Memorandum of Understanding with the National Insurance Crime Bureau. (Police) 7. Consideration and action to request and accept funds, if awarded, an FY 2024 Festival Grant from the Arizona Commission on the Arts for approximately $5,000 to support a FY2023-2024 Special Event and authorize Finance to make necessary budget transfers. (Community Services) Vice Mayor Shapera moved to approve Consent Agenda items 1-7; seconded by Councilmember Dorcey. Vote: 7 - 0 Passed - Unanimously 6. REGULAR AGENDA 2 Regular Meeting - Council Minutes April 4, 2023 1. Consideration and action to approve Ordinance O23-04-03 amending City Code Chapter 93: ABANDONED PROPERTY, Section § 93.01 DEFINITIONS, AND SECTION § 93.02(D)(1) DISPOSAL OF PROPERTY, to align the El Mirage City Code with Current Arizona Revised Statutes. (Police) Police Department Lieutenant Tim Mason provided information on the requested amendments to the City Code regarding abandoned property. Mayor Hermosillo asked City Attorney Justin Pierce to elaborate on the amendment and Mr. Pierce stated he has worked closely with the Police Department on the proposed amendment and has approved the changes. Councilmember Jones asked Lieutenant Mason how the City of Surprise handles this type of situation and Lieutenant Mason stated he can not speak to the procedures regarding firearms in the City of Surprise, but this change aligns with current law. Councilmember Delgado asked if the amendment would include AR15 firearms and Lieutenant Mason stated yes it would. Vice Mayor Shapera moved to approve Ordinance O23-04-03 amending City Code Chapter 93; seconded by Councilmember Dorcey. Vote: 7 - 0 Passed - Unanimously 7. CITY MANAGER'S COMMENTS & SUMMARY OF CURRENT EVENTS The City Council may not act upon any matter in the City Manager's summary but may have general comment or questions. City Manager Dyches introduced Public Works Operations Superintendent Cason Chambers to present the Water Wise Award to Ms. Melanie Mason. Ms. Mason witnessed a contractor using a fire hydrant and contacted Public Works to advise them of the situation. The contractor was not authorized to use the hydrant and Ms. Mason's actions helped to keep her neighbors and El Mirage residents safe. Mayor Hermosillo thanked Ms. Mason for her efforts to protect the City and residents. 8. MAYOR'S COMMENTS and COUNCIL SUMMARY OF CURRENT EVENTS The Mayor and City Council may not discuss or act upon any matter in the summary unless the specific matter is properly noticed for legal action. Councilmember Norton stated she had received calls from residents concerned about the safety of the intersection at Grand Avenue and Acoma Drive. She stated the traffic entering Acoma Drive from Grand Avenue is frequently traveling at a high rate of speed which poses a danger to other drivers and asked if the City Engineer could evaluate the intersection to see if any remedies can be implemented. Councilmember Norton also thanked staff for the Spring Faire event and noted a very large turnout. Councilmember Winston also thanked staff for the Spring Faire event and noted that she is very proud of all the new development projects throughout the City. Mayor Hermosillo provided a presentation on her recent visit to the National League of Cities Congressional Conference and thanked Council and staff for supporting her involvement with the conference. Mayor Hermosillo wished Councilmember Dorcey a happy belated birthday and commended staff on a wonderful Spring Faire. 9.
