D R A F T REGULAR MEETING OF THE COMMON COUNCIL OF THE CITY OF EL MIRAGE EL MIRAGE CITY COUNCIL CHAMBERS 10000 N. EL MIRAGE ROAD 6:00 PM -TUESDAY, JUNE 6, 2023 Minutes 1. ROLL CALL Present: Mayor Alexis Hermosillo; Vice Mayor David Shapera; Councilmember Roy Delgado; Councilmember Monica Dorcey; Councilmember Bob Jones; Councilmember Donna Winston Absent: Councilmember Anita Norton (Excused) 2. CALL TO ORDER - MEETING CALLED TO ORDER AT 6:00 PM Pledge of Allegiance Moment of Silence 3. CALL TO THE PUBLIC Citizens desiring to speak on any issue within the jurisdiction of the public body may do so at this time. Comments shall be limited to three (3) minutes per person and shall be addressed to the City Council as a whole. At the conclusion of the Call to the Public, individual City Council Members may (1) respond to criticism made by those who have spoken, (2) direct staff to review or follow up on the matter, and/or (3) direct that the matter be put on a future agenda. Spanish speaking resident Analilia Torres addressed the Council through interpretation by Staff City Engineer Jorge Gastelum and Mayor Hermosillo, stating she wants to remove a chain link fence from her property and replace it with a brick fence. Mayor Hermosillo stated she would advise staff to review and get back to her on the proper process. 4. CONSENT AGENDA All items listed under the Consent Agenda will be voted on with one motion. If discussion is desired regarding any Consent Agenda Item, that item will be removed from the Consent Agenda and voted on separately. 1. Consideration and action to approve the minutes of the Work Session and the Regular Council meeting held Tuesday May 16, 2023. (City Clerk) 2. Consideration and action to approve the destruction of municipal documents that have reached the end of their retention period. (Police) 3. Consideration and action to approve Resolution R23-06-22 authorizing Amendment No. 4 to the Cooperative Agreement between Maricopa County, administered by its Human Services Department, and the City of El Mirage to renew the existing Agreement pursuant to the automatic renewal clause in Paragraph 3 for an additional three years, Federal Fiscal Years 2024, 2025, and 2026 to participate in the U.S. Department of Housing and Urban Development's (HUD), Community Development Block Grant (CDBG) Entitlement, HOME Investment Partnership Program (HOME), Emergency Solutions Grants (ESG), and other HUD-related programs. (Community Services) 4. Consideration and action to request and accept funds, if awarded, from the Department of Justice (DOJ) Bulletproof Vest Program in an amount of approximately $13,600 to pay for a minimum of 34 bulletproof vests and authorize Finance to make necessary budget transfers. (Grants/Police). 5. Consideration and action to request and accept, if awarded, funding from the Tohono O’odham Nation 2023 revenue sharing program, an amount of approximately $150,000 for a single purpose K9, patrol vehicle, and accessories, and authorize the Finance Department to make the necessary budget adjustments (Grants). 6. Consideration and action to approve the purchase of a vehicle from Peoria Ford in an amount not to exceed $46,448 as part of CIP #62068 and authorize finance to make any transfers. (Public Works) 7. Consideration and action to approve the change from Police Explorers to Public Safety Cadets and approve the Memorandum of Understanding (MOU) between the City of El Mirage Police Department and the Public Safety Cadets regarding a program to educate and mentor young people. (Police) 8. Consideration and action to approve the use of the City of Chandler's Contract No. A-2022-1208 with 2060 Digital LLC for digital marketing services for an amount not to exceed $45,000. (Administration) 9. Consideration and action to approve an updated PSPRS funding policy for Police and Fire for FY 2024. (Finance) 10. Consideration and action to approve the adoption of the FY 2024 Financial Policies. (Administration) 11. Consideration and action to approve Resolution R23-06-23 defining specific political sign posting dates and enforcement for the Special Election to be held November 7, 2023. (Mayor/Council) Vice Mayor Shapera moved to approve Consent Agenda items 1-11 as presented; seconded by Councilmember Dorcey. Vote: 6 - 0 Passed - Unanimously 5. REGULAR AGENDA 2 Regular Meeting - Council Minutes June 6, 2023 1. Consideration and action on a site plan approval zoning application for a light manufacturing use for a building truss plant located at 9105 N. El Mirage Road, El Mirage, AZ 85335, submitted by PHNX DESIGN, LLC. (Development Services - Planning & Zoning) Senior Planner Jose Macias provided background information on the application. Vice Mayor Shapera asked if there would be an adequately sized deceleration lane on the southbound side of El Mirage Road and why isn't the vehicle entrance/exit on the northern edge of the property. Applicant Bill Blades stated the trucks would be coming from the freeways rather than southbound on El Mirage Road. Councilmember Delgado asked where the fire hydrants would be located on the property and Mr. Macias detailed the locations of the ten fire hydrants that will be onsite. Vice Mayor Shapera moved to approve a site plan zoning application for a light manufacturing use for a building truss plant located at 9105 N. El Mirage Road, El Mirage; seconded by Councilmember Dorcey. Vote: 6 - 0 Passed - Unanimously 2. Consideration and action to hold a public hearing to permit any taxpayer to be heard in favor or against any proposed expenditure or tax levy. (Administration) Mayor Hermosillo opened the Public Hearing. Fiscal Administrator Macy Walker provided background information on the proposed expenditure or tax levy. Resident Scottie Gentry asked why are they getting taxed again when they are trying to pay for a bond and why is this for the Police Department and the Fire Department if they are on the bond also? Ms. Gentry asked when the notifications will be sent out for the bond and when can residents begin placing signs? Hearing no further comments, Mayor Hermosillo closed the Public Hearing. 3. Consideration and action to approve the increased FY2023-2024 Primary Property Tax levy equal to the amount of $2,817,634, in accordance with Truth in Taxation legislation. (Administration) Vice Mayor Shapera moved to approve the increased FY2023-2024 Primary Property Tax levy in accordance with Truth in Taxation legislation, seconded by Councilmember Dorcey. Consideration and action to convene in a Special Meeting to determine and adopt proposed expenditure estimates pursuant to A.R.S. 42-17105. Adoption of Budget. Vote: 6 - 0 Passed - Unanimously 5. SPECIAL MEETING OF THE COMMON COUNCIL OF THE CITY OF EL MIRAGE EL MIRAGE CITY COUNCIL CHAMBERS 10000 N. EL MIRAGE ROAD TUESDAY, June 06, 2023 Consideration and action to approve Resolution R23-06-21 to finally determine and adopt the FY 2023-2024 proposed spending limitation and budget. (Administration) Vice Mayor Shapera moved to approve Resolution R23-06-21; seconded by Councilmember Dorcey. Vote: 6 - 0 Passed - Unanimously 6. Consideration and action to close the Special Meeting and reconvene in a Regular Session. CITY MANAGER'S COMMENTS & SUMMARY OF CURRENT EVENTS The City Council may not act upon any matter in the City Manager's summary but may have general comment or questions. City Manager Dyches had no comments. 7. MAYOR'S COMMENTS and COUNCIL SUMMARY OF CURRENT EVENTS The Mayor and City Council may not discuss or act upon any matter in the summary unless the specific matter is properly noticed for legal action. Vice Mayor Shapera stated there is increased funding for the new Fire Engine and he thanked Councilmember Delgado and staff for working so hard on this item. Councilmember Dorcey stated the new recreation trail in the wash area is proceeding beautifully, is accessible to everyone and she thanked City Manager Dyches and staff for the completion of the budget. Councilmember Winston reminded everyone to ensure children are drinking plenty of water as the heat increases. 8. ADJOURNMENT - MEETING ADJOURNED AT 6:30 PM.
