D R A F T REGULAR MEETING OF THE COMMON COUNCIL OF THE CITY OF EL MIRAGE EL MIRAGE CITY COUNCIL CHAMBERS 10000 N. EL MIRAGE ROAD 6:00 PM -TUESDAY, MAY 16, 2023 Minutes 1. ROLL CALL Present: Mayor Alexis Hermosillo; Vice Mayor David Shapera; Councilmember Roy Delgado; Councilmember Monica Dorcey; Councilmember Bob Jones Absent: Councilmember Anita Norton (Excused); Councilmember Donna Winston (Excused) 2. CALL TO ORDER - MEETING CALLED TO ORDER AT 6:00 PM Pledge of Allegiance Moment of Silence 3. PROCLAMATION 1. A proclamation to proclaim May 21-27, 2023, as Public Works Week in El Mirage. (Public Works) Public Works Director Nick Russo provided a brief history of Public Works Week. Mayor Hermosillo proclaimed May 21-27, 2023 as Public Works Week in El Mirage. 2. Proclamation to declare the month of May 2023 as Building Safety Month (Development Services). Building Official Brigham Bennett explained the history of Building Safety Month. Mayor Hermosillo proclaimed May 2023 as Building Safety Month in El Mirage. 4. CALL TO THE PUBLIC Citizens desiring to speak on any issue within the jurisdiction of the public body may do so at this time. Comments shall be limited to three (3) minutes per person and shall be addressed to the City Council as a whole. At the conclusion of the Call to the Public, individual City Council Members may (1) respond to criticism made by those who have spoken, (2) direct staff to review or follow up on the matter, and/or (3) direct that the matter be put on a future agenda. No public comments were received. 5. CONSENT AGENDA All items listed under the Consent Agenda will be voted on with one motion. If discussion is desired regarding any Consent Agenda Item, that item will be removed from the Consent Agenda and voted on separately. 1. Consideration and action to approve the minutes of the Work Session held on May 1, 2023, and the Regular Council meeting held Tuesday, May 2, 2023. (City Clerk) 2. Consideration and action to approve the destruction of municipal documents that have reached the end of their retention period. (Police) 3. Consideration and action to authorize the Finance Department to make budget adjustments for FY 2023-24 to adjust the balance of FY 2022-2023 carry-forward projects. (Finance) 4. Consideration and action to authorize the Finance Department to make transfers as necessary for FY 2022-2023 to adjust fund and department balances to comply with state law. (Finance) 5. Consideration and action to approve Resolution R23-05-16 designating Robert Weddigen as the City of El Mirage Chief Fiscal Officer for FY 2024 as required by Arizona Revised Statutes §41-1279.07(E). (Finance) 6. Consideration and action to enter into an Intergovernmental Agreement (IGA) with the Arizona Department of Transportation (ADOT) to procure speed display feedback signs and authorize payments in an amount not to exceed $24,570 as identified in the IGA and allow finance to make the necessary budget transfers. (Development Services/Community Services) 7. Consideration and action to enter into an Intergovernmental Agreement (IGA) with the Arizona Department of Transportation (ADOT) to procure educational materials in an amount not to exceed $9,600 (City cost $547 and Federal funds $9,053) and allow finance to make the necessary budget transfers. (Development Services/Community Services) 8. Consideration and action to authorize the City Manager to enter into the amended multi-year agreement with Policy Confluence, Inc. for a benchmark survey and Performance Plan Subscription for an amount not to exceed $9,807 (including tax) for the fiscal year 2023. (Administration) 9. Consideration and action to approve Resolution R23-05-20, authorizing the Adoption of the City of El Mirage Council Strategic Priorities. (Administration) 10. Consideration and action to request, and accept if awarded, an FY23-24 Department of Public Safety (DPS) Victim of Crime Act (VOCA) Crime Victim Assistance Grant in an amount of approximately $56,300 for the Victim Assistance program and authorize the Finance department to make the necessary budget adjustments. (Community Services/Police) 11. Consideration and action to request and accept funds if awarded for the FY24 Water Conservation Project from the Water Infrastructure Finance Authority of Arizona (WIFA) for an amount of up to $250,000 for the 127th Lane Well Site - Water Reclamation Improvements and authorize Finance to make necessary budget transfers (Grants/Public Works) 2 Regular Meeting - Council Minutes May 16, 2023 12. Consideration and action to authorize the City Manager to enter into an IGA with RPTA for Regional ADA Paratransit Service for FY23-24. (Community Services) 13. Consideration and action to authorize the City Manager to enter into an agreement with Northwest Valley Connect (NVC), a nonprofit 501(C)3, for local Dial-a-Ride transit services for FY23-24 in an amount not to exceed $199,052. (Community Services) 14. Consideration and action to approve the City of El Mirage Classification and Compensation Schedule effective on or about July 1, 2023. (Human Resources) 15. Consideration and action to approve Resolution R23-05-15 to amend the Memorandum of Understanding (MOU) between the City of El Mirage and the El Mirage Fire Fighters Association (EMFFA), Appendix A, Step Pay Plan for Firefighters, Fire Engineers, and Fire Captains, beginning with the July 13, 2023 paycheck. (Human Resources) 16. Consideration and action to approve Resolution R23-05-14 to amend the Memorandum of Understanding (MOU) between the City of El Mirage and the El Mirage Police Employees Association (EMPEA), Appendix 1: Step pay plan for Police Officers and Police Sergeants, beginning with the July 13, 2023 paycheck. (Human Resources) 17. Consideration and action to approve the purchase of a replacement vehicle from Courtesy Chevrolet in an amount not to exceed $57,769.21 for a water division vehicle recently lost in a vehicle accident and authorize finance to make any necessary transfers. (Public Works) 18. Consideration and action to approve a contract with M.R. Tanner for FY23 pavement maintenance work for an amount of $49,000 and authorize finance to make any necessary transfers. (Public Works) 19. Consideration and action to approve a contract with P1 Paving for FY23 pavement maintenance work for an amount of $35,000 and authorize finance to make any necessary transfers. (Public Works) Vice Mayor Shapera moved to approve Consent Agenda items 1-19; seconded by Councilmember Dorcey. Vote: 5 - 0 Passed - Unanimously 6. REGULAR AGENDA 1. Consideration and action to approve Resolution R23-05-08 amending Title III of the El Mirage City Code, including revising Sections 30.21, 30.23, 30.25, 30.28, and 30.35 regarding changes in definitions, purchasing authority, professional services, municipal construction projects and disposition of surplus property. (FInance) Finance Director Robert Weddigen detailed the amendments being proposed in R23-05-08. Vice Mayor Shapera moved to approve Resolution R23-05-08; seconded by Councilmember Dorcey. Vote: 5 - 0 Passed - Unanimously 3 Regular Meeting - Council Minutes May 16, 2023 2. Consideration and action to approve Ordinance O23-05-06 amending Title III of the El Mirage City Code, including revising Sections 30.21, 30.23, 30.25, 30.28, and 30.35, which document was made a public record by Resolution R23-05-08 regarding changes in definitions, purchasing authority, professional services, municipal construction projects, and disposition of surplus property. (Finance) Vice Mayor Shapera moved to approve Ordinance O23-05-06; seconded by Councilmember Dorcey. Vote: 5 - 0 Passed - Unanimously 3. Consideration and action to approve Resolution R23-05-09 amending Chapter 32, § 32.080 Prior Approval, to conform it to the authority given to the City Manager in Title III, Chapter 30, § 30.23 Purchasing Authority. (Finance) Finance Director Robert Weddigan explained the amendments proposed in R23-05-09. Vice Mayor Shapera moved to approve Resolution R23-05-09; seconded by Councilmember Dorcey. Vote: 5 - 0 Passed - Unanimously 4. Consideration and action to approve Ordinance O23-05-07, amending Chapter 32, § 32.080 Prior Approval, giving authority to the City Manager to enter into agreements that meet the requirements of Title III, Chapter 30, § 30.23 Purchasing Authority, that authorizes the City Manager to make purchases up to $30,000. (Finance) Vice Mayor Shapera moved to approve Ordinance O23-05-07; seconded by Councilmember Dorcey. Vote: 5 - 0 Passed - Unanimously 5. Consideration and action to approve Resolution R23-05-10 amending the existing City of El Mirage City Code Title XV, Chapter 150, also known as Building Code, adopting the 2018 International Building and Fire Codes and local code amendments and declaring the Resolution as a public record. (Development Services) Building Official Brigham Bennett provided a presentation on the amendments being proposed to the Building and Fire Codes which would take effect July 1, 2023, if approved. Vice Mayor Shapera moved to approve Resolution R23-05-10; seconded by Councilmember Dorcey. Vote: 5 - 0 Passed - Unanimously 6. Consideration and action to approve Ordinance O23-05-08 amending the existing City of El Mirage City Code Title XV, Chapter 150, also known as Building Code, adopting the 2018 International Building and Fire Codes and local code amendments and declaring the Resolution as a public record. (Development Services) 4 Regular Meeting - Council Minutes May 16, 2023 Vice Mayor Shapera moved to approve Ordinance O23-05-08; seconded by Councilmember Dorcey. Vote: 5 - 0 Passed - Unanimously 7. Consideration and action to approve Resolution R23-05-19 adopting the Capital Improvements Plan (CIP) for fiscal years 2024 through 2028. (Administration) Fiscal Services Administrator Macy Walker provided background information on the Capital Improvements Plan for fiscal years 2024 through 2028. Vice Mayor Shapera moved to approve Resolution R23-05-19; seconded by Councilmember Dorcey. Vote: 5 - 0 Passed - Unanimously 8. Consideration and action to approve Resolution R23-05-18 adopting the tentative budget, thereby setting the maximum expenditure limit for FY23-24. (Administration) Fiscal Services Administrator Macy Walker detailed the changes to the tentative budget. Councilmember Dorcey thanked Ms. Walker and staff for the hard work put into preparing the budget. Mayor Hermosillo also thanked staff for their efforts on the budget. Vice Mayor Shapera moved to approve Resolution R23-05-18; seconded by Councilmember Dorcey. Vote: 5 - 0 Passed - Unanimously 7. CITY MANAGER'S COMMENTS & SUMMARY OF CURRENT EVENTS The City Council may not act upon any matter in the City Manager's summary but may have general comment or questions. City Manager Crystal Dyches had no comments. 8. MAYOR'S COMMENTS and COUNCIL SUMMARY OF CURRENT EVENTS The Mayor and City Council may not discuss or act upon any matter in the summary unless the specific matter is properly noticed for legal action. Vice Mayor Shapera stated having the Fire Department personnel teach CPR to Court staff was a well-thought out idea. He also complimented the Police Department on the recent arrests made in the City. Councilmember Delgado commended the Police Department for all of the good work they have done recently. Councilmember Dorcey also commended the Fire Department and Police Department for their hard work. Councilmember Jones stated all emergency services staff were doing an excellent job and he appreciated the Police Department for stopping a motorist from speeding in his neighborhood recently. Mayor Hermosillo stated the Music in the Park event held May 15, 2023, appeared to be a great success and complimented Public Works staff on their hard work with all of the events. 9.
