RESOLUTION R23-06-23 
 
A RESOLUTION OF THE MAYOR AND COUNCIL OF THE CITY OF EL MIRAGE, 
MARICOPA COUNTY, ARIZONA, DEFINING SPECIFIC POLITICAL SIGN 
POSTING DATES AND ENFORCEMENT FOR THE SPECIAL ELECTION TO BE 
HELD NOVEMBER 7, 2023. 
 
WHEREAS, Resolution R23-04-06 was passed by the El Mirage City Council on April 18, 2023 ordering 
and calling a Special Election to be held November 7, 2023 to submit to the qualified electors in the City of Mirage 
one question with respect to selling and issuing bonds payable from secondary (ad valorem) property taxes; and  
 
WHEREAS, the question was raised as to when political signs that either opposed or supported the bond 
issue could be posted in the City of El Mirage; and   
 
WHEREAS, A.R.S. § 16-1019 prohibits the City from removing political signs 71 days before a primary 
election until 15 days after the general election (if certain conditions are met) but this statute is not applicable for 
non-candidate elections held on other consolidated election dates as authorized by A.R.S. § 16-204(F); and  
 
WHEREAS, the City’s sign code § 154.134(H) states that the El Mirage Sign Ordinance (“Sign 
Ordinance”) applies outside the period established by A.R.S. § 16-1019 but the Sign Ordinance is silent as to 
political sign regulation for a non-candidate special election;  
 
WHEREAS, the City desires to provide consistent sign regulation for the November 7, 2023 Special 
Election by adopting the same posting dates, removal restrictions, and enforcement that are applicable to the City’s 
regular candidate elections;  
 
NOW, THEREFORE, be it resolved by the Mayor and Council of the City of El Mirage, Arizona, as 
follows: 
 
Section 1.  The posting of political signs relative to the Special Election to be held November 7, 2023 shall 
be permitted effective 71 days prior to the Special Election of November 7, 2023 (Monday, August 28, 2023) and 
for 15 days following the election (Wednesday, November 22, 2023). 
 
Section 2.  All provisions relating to political signs in A.R.S. 16-1019 and City Code § 154.134 
shall apply, including enforcement of signs that are in violation of state law and the City Code.
