Considerations 
The applicant is requesting the approval of a conditional use permit for the 
collocation of wireless communication equipment on an existing monopole (tower) 
located in Gentry Park. The City of El Mirage is the landowner of the property and 
collects annual rent from the owner of the monopole Crown Castle USA. The 
monopole stands at 110-ft. tall with existing wireless communication and City 
equipment mounted. Under Section 6409 of the Federal Communication (FCC) 
clarifies that the 30-day and 60-day deadlines begins when an applicant takes the 
first step required under state or local law and submits information sufficient to 
inform the jurisdiction.  
 
General Plan 
Compliance 
The El Mirage 2020 General Plan identifies this site as being in the Mixed-Use 
Planning Area and is in compliance with the plan.  
 
Zoning & Land Use 
The site is located in the Natural Reserve (NR) zoning area with the proposed use 
of a collocation of wireless communication requiring a conditional use permit 
approval. 
 
ARS 28-8481 Land Use 
Compatibility 
The site is located within the Luke Air Force Base Noise Contour Zone and is 
subject to ARS 28-8481 land use compatibility regulations. Staff is still awaiting a 
review letter from the base. Staff believes that the conditional use permit use should 
not have a negative impact on the base’s operation due to the fact that the tower is 
not increasing in height.  
 
City Staff Review 
Staff has reviewed the application and finds that it meets the zoning code 
requirements. 
 
Stipulations: 
The applicant shall address and consent to the TAC Review comments mentioned 
in the June 1, 2023, memorandum with the submittal of the construction documents 
for permitting review.  
 
Planning Commission 
Recommended approval of the application at the June 13, 2023, public hearing 
with a 5-0 unanimous vote.  
 
City Council 
Staff will present and seek a final action from the City Council at the July 11, 2023, 
public hearing.
