D R A F T REGULAR MEETING OF THE COMMON COUNCIL OF THE CITY OF EL MIRAGE EL MIRAGE CITY COUNCIL CHAMBERS 10000 N. EL MIRAGE ROAD 6:00 PM -TUESDAY, FEBRUARY 6, 2024 Minutes 1. ROLL CALL Present: Mayor Alexis Hermosillo; Vice Mayor David Shapera; Councilmember Roy Delgado; Councilmember Monica Dorcey; Councilmember Bob Jones; Councilmember Anita Norton; Councilmember Donna Winston 2. CALL TO ORDER Pledge of Allegiance Moment of Silence 3. PRESENTATION 1. 2023 Annual Report Presentation by City Manager Crystal Dyches. (Administration) City Manager presented the 2023 Annual Report for the City of El Mirage detailing previous year's accomplishments from each City department. 4. PROCLAMATION 1. To recognize the month of February 2024 as Teen Dating Violence Prevention and Awareness month. (Administration) Councilmember Norton provided background information on teen dating violence prevention and awareness month. Mayor Hermosillo proclaimed February 2024 as Teen Dating Violence Prevention and Awareness Month. 5. CALL TO THE PUBLIC Citizens desiring to speak on any issue within the jurisdiction of the public body may do so at this time. Comments shall be limited to three (3) minutes per person and shall be addressed to the City Council as a whole. At the conclusion of the Call to the Public, individual City Council Members may (1) respond to criticism made by those who have spoken, (2) direct staff to review or follow up on the matter, and/or (3) direct that the matter be put on a future agenda. Resident Scottie Gentry stated she believes, after reading the annual report, the City is not putting residents first. Ms. Gentry asked why the City would spend $207k on a trail instead of helping residents with their utilities and rent. Resident Steve Gilliam stated he spent two hours being introduced to the social media online about the City and introduced Moses, his mascot of the citizens' action group he is forming. 6. CONSENT AGENDA All items listed under the Consent Agenda will be voted on with one motion. If discussion is desired regarding any Consent Agenda Item, that item will be removed from the Consent Agenda and voted on separately. 1. Consideration and action to approve the minutes of the Worksession and Regular Council meeting held Wednesday, January 17, 2024. (City Clerk) 2. Consideration and action to authorize the City Manager to enter into a construction contract with Danson Construction L.L.C. to construct the new Public Works building in an amount of $2,304,000, plus an 8% construction contingency of $184,320, for a total amount of $2,488,320. (Development Services) 3. Consideration and action to authorize the City Manager to amend the Professional Services Contract (PSC) with LEA Architects L.L.C. to provide Construction Administrative Services for the Public Works Building project for an amount not to exceed $68,393.00. (Development Services) 4. Consideration and action to appoint Mircea Ionescu to the Public Safety Personnel Retirement System (PSPRS) Fire and Police Local Retirement Boards for a four-year term beginning February 2024 through February 2028. (Human Resources) 5. Consideration and action to approve the El Mirage Police Department entering into an Intergovernmental Agreement (IGA) to participate in the Arizona Child Abduction Response Team (AZCART) ending on June 30, 2030. (Police) Vice Mayor Shapera moved to approve Consent Agenda items 1-5 as presented; seconded by Councilmember Dorcey. Vote: 7 - 0 Passed - Unanimously 7. REGULAR AGENDA 1. Consideration and action to approve Resolution R24-01-02, including the attached Exhibit "A" enacting and adopting a supplement (S-14 - 2023) to the Code of Ordinances through December 2023. (City Clerk) Vice Mayor Shapera moved to approve Resolution R24-01-02, including attached Exhibit "A" enacting and adopting a supplement (S-14 - 2023) to the Code of Ordinances through December 2023, as presented; seconded by Councilmember Dorcey. Vote: 7 - 0 Passed - Unanimously 2. Consideration and action to approve Ordinance O24-01-01 enacting and adopting a supplement (S-14 - 2023) to the City of El Mirage Code of Ordinances. (City Clerk) 2 Regular Meeting - Council Minutes February 6, 2024 Vice Mayor Shapera moved to approve Ordinance O24-01-01 enacting and adopting a supplement (S-14 - 2023) to the City of El Mirage Code of Ordinances, as presented; seconded by Councilmember Dorcey. Vote: 7 - 0 Passed - Unanimously 3. Consideration and action to approve Resolution #R24-02-03 Stating the Intended Uses of State and Local Fiscal Recovery Funds (SLFRF). (City Clerk) Vice Mayor Shapera moved to approve Resolution R24-02-03 Stating the Intended Uses of State and Local Fiscal Recovery Funds (SLFRF), as presented; seconded by Councilmember Dorcey. Vote: 7 - 0 Passed - Unanimously 8. CITY MANAGER'S COMMENTS & SUMMARY OF CURRENT EVENTS The City Council may not act upon any matter in the City Manager's summary but may have general comment or questions. City Manager Crystal Dyches advised the Council that depending on the amount of rain received in the next day, a decision on whether to cancel the Public Safety Day event scheduled for Saturday, February 10, 2024, will be made on Wednesday, February 7th. 9. MAYOR'S COMMENTS and COUNCIL SUMMARY OF CURRENT EVENTS The Mayor and City Council may not discuss or act upon any matter in the summary unless the specific matter is properly noticed for legal action. Vice Mayor Shapera stated he met with Congressman Paul Gosar and had a productive meeting. Councilmember Delgado stated he met with Program Coordinator Martina Longoria to discuss the CDAC requests for future CDBG funding. Councilmember Norton stated she attended a three-day summit on teen dating violence prevention that was very thought-provoking. She also suggested staff provide more information to residents about the lockbox program being offered by the Fire Department. Mayor Hermosillo stated she would be traveling to Washington D.C. in March for the Congressional City Conference. Mayor Hermosillo also thanked Economic Development Manager Tom Doyle for attending the International Economic Development Council Leadership Conference in Phoenix with her this past weekend. 10. EXECUTIVE SESSION 1. Consideration and action to adjourn into Executive Session pursuant to A.R.S. §38-431.03.3. and 4. for discussion, consultation, and legal advice from the City attorney regarding pending or contemplated litigation. (Administration) Vice Mayor Shapera moved to adjourn to Executive Session pursuant to State law for consultation with the City Attorney on current or pending litigation, seconded by Councilmember Dorcey.
