A RESOLUTION OF THE MAYOR AND COUNCIL OF THE CITY OF 
EL 
MIRAGE, 
MARICOPA 
COUNTY, 
ARIZONA, 
REPLACING 
RESOLUTION R-23-05-12, R-22-06-16 AND R21-09-22 STATING THE 
INTENDED USES OF THE STATE AND LOCAL FISCAL RECOVERY 
FUNDS ALLOTMENT THROUGH THE AMERICAN RESCUE PLAN ACT. 
 
 
WHEREAS, on March 11, 2021, the United States Congress passed the American 
Rescue Plan Act of 2021, which provides fiscal relief to State and Local Governments and other 
program areas aimed at mitigating the continuing effects of the COVID-19 Pandemic; and 
 
WHEREAS, the American Rescue Plan Act is intended to provide support to local 
governments in responding to the impact of the pandemic; and 
 
WHEREAS, the American Rescue Plan Act includes Coronavirus State and Local Fiscal 
Recovery Funds to support urgent COVID response efforts to decrease the spread of the virus; 
to replace lost public sector revenue to strengthen support for vital public services; to support 
immediate economic stabilization for households and businesses; and to address systemic public 
health and economic challenges that have contributed to unequal impacts of the pandemic on 
certain populations; and 
 
WHEREAS, the final rule of the coronavirus State and Local Fiscal Recovery Funds 
(SLFRF) allows jurisdictions to utilize a standard revenue gross allowance of up to $10 million; 
and 
WHEREAS, the Interim Final Rule for ARPA Flex allows for spending to provide for 
spending on emergency relief, transportation infrastructure eligible projects and for any program, 
project or service that is also eligible under HUD’s Community Development Block Grant 
program; and 
 
WHEREAS, the City of El Mirage, as the recipient, accepts the award of Coronavirus 
State and Local Fiscal Recovery Funds of $11,940,792; and 
 
WHEREAS, the City of El Mirage has its full distribution of funds; and 
 
WHEREAS, the United States Department of Treasury has adopted the Final Rule as 
guidance regarding the use of American Rescue Plan Act Funds; and 
 
WHEREAS, this Resolution is intended as a statement of intent of the Council to expend 
the City’s American Rescue Plan Act Funds in accordance with Federal Law and guidance for 
the current critical needs and priorities for which there is consensus as set forth below;

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of El Mirage 
that: 
 
1) The City Manager, subject to provision 9 of this Resolution, be authorized to spend funds in 
compliance with the American Rescue Plan Act of 2021 and in accordance with guidance from 
the U.S. Department of Treasury for the Coronavirus Local Fiscal Recovery. 
 
2) It is the intent of the Council that funds from Coronavirus State and Local Fiscal Recovery 
Funds for expenditure of lost revenue on governmental services be prioritized and expended 
for governmental services as follows:  
 
a) Northern Parkway Corridor  
b) Affordable Housing  
c) Technology and Communication Upgrades  
d) Public Safety Personnel  
e) Public Safety Equipment 
f) Community Services Personnel 
g) Emergency Operations Center  
h) Hohokam Multi-use Trail 
 
3) It is the intent of the Council that funds from Coronavirus State and Local Fiscal Recovery 
Funds for expenditure for public health and safety measures and negative economic impacts 
from the pandemic be prioritized and expended as follows:  
 
a) Homelessness Outreach 
 
b) Police Neighborhood Enforcement Team 
 
c) Senior Meals  
d) Transit   
e) Utility and Housing Assistance 
 
f) Senior Bus Transportation 
   
4) All necessary actions be taken to apply for and receive funds from state and federal sources 
for which the city is eligible. 
 
5) Funds be accounted for in the amount of $11,940,792, which was received in two tranches, with 
50% in 2021 and 50% in 2022. 
 
6) Appropriations be established in an amount equal to funds received. 
 
7) Appropriations, expenses, and/or cash between funds established be transferred for the 
Coronavirus recovery response. 
 
8) Any agreements necessary to receive Coronavirus State and Local Fiscal Recovery 
Funds be executed.

9) Nothing in this Resolution shall be construed as superseding any action otherwise required by 
the City Council to authorize the City Manager to enter into requisite contracts associated with 
expenditures outlined above. 
 
10) This Resolution shall be effective at the soonest date after its passage and approval, according 
to law.
