5. Please add the following statement to the site plan. a. “Any change of use or occupancy 
of any building or buildings, including additions thereto requiring more parking, shall 
not be permitted until such additional parking spaces as required by this chapter are 
furnished.”  
6. A final plat will be required to record any lot combinations, easements, and/or dedication 
of land before issuing the Certificate of Occupancy. The final plat application will be 
submitted to the Zoning Administrator for processing, which will be reviewed by staff 
and approved by the City Council. Separate fees apply.  
7. On the final landscape plan, provide the plant material and specifications from the 
Arizona Nursery Association (ANA) standards.

8. Natural topping of landscaped areas. All landscaped areas shall be finished with natural 
topping material which may include, but are not limited to the following: turf, 
groundcover, planting, decomposed granite (two inches minimum depth), river run rock, 
expanded shale, or bark.  
9. The preliminary landscape plan has been reviewed and approved by the Senior Planner as 
part of the development site plan review. The preliminary landscape plan will be included 
in the zoning application staff report and presented to the Planning and Zoning 
Commission and City Council where additional stipulations may be imposed.  
10. The final landscape plan shall be in conformance with the approved preliminary plan and 
any stipulated changes or additions and shall be approved by the Zoning Administrator or 
designee prior to the issuance of a building permit.  
11. All changes in landscape plans before, during, or after preliminary or final landscape plan 
approval and/or landscape installation shall be approved by the Zoning Administrator or 
his or her designee.  
The Planning Commission and City Council shall, in addition to any other conditions, 
impose the following general conditions upon every conditional use permit granted.  
12. The right to a use and occupancy permit shall be contingent upon the fulfillment of all 
general and special conditions imposed by the conditional use permit procedure.  
13. All of the special conditions shall constitute restrictions running with the land and shall 
be binding upon the owner of the land, his or her successors, or assigns.  
14. All conditions specifically stated under any conditional use listed in this chapter shall 
apply and be adhered to by the owner of the land, his or her successors, or assigns.  
15. All of the special conditions shall be consented to in writing by the applicant.  
16. The proposed use of the fuel processing facility shall not create noise, vibrations, or odor.  
17. The landscape area shall be maintained with weed and dust control material.  
18. Applicant shall submit construction documents to the Building Safety Division for permit 
review and approval.  
19. The applicant has one calendar year to submit construction documents and satisfy the 
conditions outlined in the permit.    
20. If the application has been granted, the permit shall be issued upon the signature of the 
Senior Planner / Zoning Administrator, and any conditions, automatic termination date, 
or period of review shall be stated on the permit.

Below are the Engineering Division’s comments for the above referenced submittal provided in 
December 2023. These items will have to be addressed prior to the Planning and Zoning 
Meeting. 
 
Narrative 
1. The current zoning for Parcel 501-45-015V is CP which is Commerce Park only. 
2. It appears that a re-zoning of the property is being requested. Please state what zone is 
desired for this site. 
3. Phase I only notes the installation of a new fence. Once the fence is installed, is the 
property planned to be used for parking, storage, etc. prior to the construction of Phase 
II? 
4. The offsite improvements in Olive Avenue will be required in Phase II. 
5. How many employees are there at the existing site and how many are anticipated to be 
added for Phase II, III and IV.  How many employees will there be in the ultimate 
buildout? 
6. What are the proposed building heights? 
7. Update the Narrative to match the Site Plan. The Narrative refers to a 3,500 sf lab 
building and 3,500 sf office. The Site Plan shows a 5,000 sf lab building, 3,500 sf 
operations building and 4,000 sf storage building. 
8. Update the years in the Project Schedule. 
9. Since this project is planned to be developed in multiple phases, a Phasing Plan per 
Chapter 1, Section F of the City’s Design & Development Standards Manual (DDSM) 
will be required. 
 
The below items will have to be addressed during the Construction Plan Submittal. 
 
Site Plan  
10. Show the building setback lines based on the classification that the property is planned to 
be re-zoned to. 
11. Project Data 
a. Why is the 4,000 sf storage building not included in the parking calculations? 
b. As noted, 2 ADA spaces are required. One shall be a standard ADA space (8’ 
space and 5’ aisle) and 1 shall be a van accessible space (8’ space and 8’ aisle or 
11’ space and 5’ aisle).

c. Provide the Building Coverage of the site. 
12. Parking 
a. When parking spaces are adjacent to a sidewalk, the sidewalk shall be a minimum 
of 6 feet wide or 5 feet wide with parking blocks. 
b. Parking spaces shall be striped with a minimum of 4-inch painted lines. 
13. The existing half right of way of Olive Avenue is shown as 50 feet wide but it is currently 
55 feet wide. 
14. The project is responsible for widening Olive Avenue to connect the curb line on the west 
side of the APN501-45-015V to the curb line on APN 501-45-015J.  Also required is the 
dedication of 10 feet of right of way (for a total of 65 feet) and an 8-foot wide Public 
Utility Easement (PUE) along the Olive Avenue frontage, vertical curb and gutter, an 
eight-foot-wide sidewalk (detached and meandering if possible), bike lane, streetlights 
and landscaping/irrigation. The project will also be responsible for any deceleration 
lanes. 
15. No walls shall be placed within the PUE.  
16. It is believed that the 30 foot right of way of 121st Avenue has previously been dedicated 
to the City. If this is inaccurate, please include this dedication with the Final Plat. 
17. The proposed driveway shall be per MAG or City details. A stop sign shall be placed at 
the proposed driveway. Verify that the existing and proposed driveways have a minimum 
throat of 50 feet or more if the trucks that visit this site are longer. 
18. The proposed driveway would be an exit only type per the TIA. 
19. Show the sight distance requirements at the existing and proposed driveways per City 
Detail EM-158.  
20. 6-inch MAG type curbing is required around all driveways and parking lots. Curb that 
carries drainage shall include a gutter. The curbing shall be no closer than 3 feet to any 
property line.  
21. Any fire lane/emergency access route shall be designed to handle 75,000 lbs. or more if 
the site will accommodate larger vehicles. A Geotechnical Report will be required for this 
project, and it should provide a recommended design section for this access road.  
22. Provide a template that shows how a vehicle with a minimum inside radius of 19.5 feet 
and the outside radius of 45 feet can maneuver through the site. The template shall be 20 
feet wide. 
23. Show how traffic is intended to flow onsite. Signage shall be placed where necessary 
(i.e., “Do Not Enter”, “One Way”, etc.). 
24. What is being proposed just west of the existing driveway, east of the Future Storage 
Building? Parking is not allowed within a driveway entrance. 
25. Label all existing and proposed fences, walls, exterior signs and lighting. 
26. Side slopes adjacent to the public right of way, areas where pedestrian access is permitted 
and within Public Utility Easements (PUE) shall be 6:1 or flatter. There shall be at least 
two feet of level ground between any wall or vertical obstruction and the top of any side 
slope grading.  
27. The proposed retention basins shall be located a minimum of 4 feet away from any 
structures and shall not be located within any building setbacks, easements, or fire lanes. 
28. Add markers to any offsite scuppers, etc. per City Detail EM-559.  
29. Drainage 
a. The finished floor elevations are required to be a minimum of 12 inches above the 
100-year high-water level of any adjacent retention basin and 14 inches above the 
ultimate outfall of the site. 
b. The site is responsible for retaining that drainage from the site and the adjacent 
half right of way of Olive Avenue along the project frontage.

c. Label the overflow elevations for each basin and the low outfall of the lot. 
30. Dry wells shall be set 0.3’ above the bottom of the basin. 
31. A proposed storm drain connection between Basin 1 and Basin B is shown . Is this 
feasible with the difference in elevations of the two basins? 
32. The site shall be master metered with backflow preventers at both connection points. 
Meters shall be within the right of way and backflow preventers shall be on private 
property, but not within a Public Utility Easement, separated by a minimum of 5 feet.  
33. An 8-inch water main shall be looped on site with hydrants spaced every 300 feet or as 
determined by the Fire Department.  This main will be private and any hydrants within 
the project site will be private and painted Safety Red per City Detail EM-360. All 
hydrants require markers per MAG Detail 122. 
34. Water valves are recommended along the main every 500 feet and at locations so that the 
maximum number of hydrants to be out of service is 2. 
35. A fire hydrant is required along Olive Avenue, 500 feet west of the one at the intersection 
of Olive Avenue and 121st Avenue.  This hydrant will be public and painted Safety 
Yellow per City Detail EM-360.    
36. The proposed sanitary sewer main will be public between the existing tie-in manhole to 
the north of the site and SMH-3. These manholes will require an epoxy coating. The 
onsite sewer main between SMH-3 and SMH-6 will be private. 
37. Show the horizontal and vertical clearances between utilities on the plans.  Verify that the 
clearances adhere to MAG Detail 404 and City Detail EM-402. 
38. Per City Code Section 155.057, all overhead utility lines, 13kV and under, shall be placed 
underground. This includes all electrical, communication, cable, etc. facilities along 
Olive Avenue. This may require the undergrounding beyond the site boundary to the next 
convenient power pole or junction element. Relief from this requirement per may be 
requested from City Council if additional electrical lines (over 13kV) will remain on the 
poles after the undergrounding.  
39. Each proposed driveway shall have at least one streetlight. 
40. Any light or combination of lights which cause light on a public street, other than lights 
specifically intended for that purpose, shall not exceed one foot candle as measured from 
the center line of the street. Provide a Photometric Plan to show the foot candles along 
the centerline of Olive Avenue to verify that the proposed lighting will not exceed the 
maximum limit. 
41. A trash enclosure shall be proposed on site per City Detail EM-113. 
42. Offsite Improvements – Olive Avenue 
a. Label any storage and taper lengths. 
b. Left turn lanes shall be a minimum of 10 feet wide and right turn lanes shall be a 
minimum of 11.5 feet wide. 
c. The minimum longitudinal slope shall be 0.25% for Olive Avenue. 
d. The cross slope of Olive Avenue shall be between 1% and 3% with 2% preferred. 
e. A Signage and Striping Plan will be required.  
f. A raised median will be required along the project frontage. 
43. Plans shall include applicable City Notes. Call out MAG, City, etc. details to be used. 
Use the City’s Design & Development Standards Manual (DDSM) as a guide for the final 
design. 
 
Exterior Elevations 
44. The provided elevations are for the future operation building. Are elevations available for 
the 5,000 sf lab building or 4,000 sf storage building?

Preliminary Landscape Plan 
45. Add City Landscaping and Irrigation Notes (City Detail EM-101-4) to the plan set. 
46. Show the sight distance requirements at the existing and proposed driveways per City 
Detail EM-158.  
47. DG is required on all non-paved areas both on site and within the right of way adjacent to 
the project site. 
48. All plantings at maturity shall maintain a minimum of 6 feet of clearance from all fire 
hydrants and fire suppression devices per City Detail EM-361. 
49. Add a note to the plans that the maintenance for all landscaping and irrigation shown on 
the plans will be the responsibility of the property owner. 
50. Show the botanical and common names of the vegetation to be used. 
51. Irrigation plans will be required. A separate landscaping service, meter and backflow 
preventer is required. 
52. The raised median shall be landscaped and irrigated. The City can provide examples of 
other median landscaping upon request. 
 
Deed 
53. No comments. 
 
Preliminary Drainage Report 
54. Use the City Runoff Coefficients per City Code Section 155.054(B)(6)(a). Concrete = 
0.95, roofs/asphalt = 0.85, grass = 0.15 and desert/rock lawn = 0.70.  
55. The basin areas shall be included in the calculations. 
56. Verify the areas in the report as they differ slightly then the ones shown on the Site Plan. 
57. Drainage Area Exhibit - Provide the volume required and provided calculations for the 
“Containment Area” and the adjacent portion of 121st Avenue. 
58. Calculations for any curb openings, wall opening, catch basins, scuppers, etc. will be 
required. This includes pipe capacity, inlet capacity and scupper openings, as applicable. 
59. Provide dry well calculations to show any basin over 1 foot deep will drain within 36 
hours. The City recommends using a dry well percolation rate of 0.10 cfs for design. 
60. Street calculations for an arterial street (Olive Avenue) shall verify that: 
a. 10 year flows can be carried within the curb and maintain a 12 foot dry lane in 
each direction. 
b. 100 year flows can be carried within the right of way with a maximum depth of 6 
inches over the crown. 
 
ALTA Survey 
61. The “status” in the title block is labeled as Preliminary. 
62. Flood Zone - The FIRM Zone is X (Shaded), not AE. 
63. Site Information – Parcels 501-45-015H and J are zoned EI and Parcel 501-45-015V is 
zoned CP. 
64. Verify the location of Schedule B, Note 6 on Sheet 2 which is currently shown in the 
middle of Lot 2. Is this correct? 
65. Should the line within the right of way, between Parcels 1 and 2, be light and dashed? 
 
Topographic Survey 
66. No comments.

Phase I Environmental Assessment 
67. Page 13 – A portion of the SQG bullet point states “no violations, enforcement actions 
and/or documented release incidents were not reported in the EDR database”. Is this 
sentence correct? 
68. Pages 20 & 21 – The PFOA/PFOS bullet point refers to a previous penalty in 2000 while 
a later sentence states no violations were reported. Is this accurate? 
 
Preliminary Water Report 
69. Design Criteria 
a. The minimum domestic service size is 1 inch. 
b. The minimum fire service size is 6 inches unless the Fire Department approves a 
small diameter. 
70. Demands 
a. Show calculations for the average day demand, max day demand and peak hour 
demand per the City’s Water System Design Criteria. 
b. How was the 3,500 gpm fire flow determined?  Fire Flow can only be reduced to 
50% with approval from the Fire Department. 
c. The developer is required to schedule and perform their own fire flow test. 
Contact the City’s Public Works Department (623-876-4251) to act as a witness 
to the test one week prior to the scheduled date. 
71. The water loop around the site shall be a minimum of 8 inches. 
 
Preliminary Sewer Report 
72. Section II – A 10 inch main cannot connect to an 8 inch downstream main. However, the 
8 inch main is only a 10 foot long stub which can be removed and the new 10 inch main 
can be connected directly to the existing manhole. The main north of this manhole is 18 
inches. 
73. Section IV  
a. The slope of 0.32% minimum is acceptable except the last run of pipe shall be a 
minimum of 1.00%. 
b. Show calculations for the average day demand, dry weather peak hour demand 
and wet weather peak hour demands per the City’s Wastewater System Design 
Criteria. 
 
Traffic Impact Analysis (TIA) 
74. A Traffic Impact Statement (TIS) from KE Design was provided along with the TIA 
prepared by SWTE.  
75. Study Methodology – Bullet Point 4 - Capacity analysis shall be performed for the 
opening year of 2025 and 5 years in the future, or 2030.  
76. The Site Plan included in the report does not match the one provided with the City 
submittal. The 3,500 sf operations building is not included. 
77. Existing Conditions – 1st Paragraph – Olive Avenue, east of the project site, is a four lane 
undivided road. 
78. Existing Traffic Data  
a. 2nd Paragraph – Revise to “narrowing two way center left turn lane” 
b. 3rd Paragraph – Was any multiplier added to the traffic counts since school was 
not in session? 
79. Access 
a. 1st Paragraph – It is noted that the hatched out lane on the north side of Olive 
Avenue will be restriped as an additional westbound lane. Would this not be

better utilized as a deceleration for the main entrance to the site for the large 
trucks on a 45 mph roadway? 
b. 2nd Paragraph – The first sentence refers to the Pro Petroleum Driveway as the 
main driveway “to and from” the existing and proposed sites. The West Driveway 
should be the main exit for both sites. It was noted in the TIS that “the proposed 
expansion will allow the facility to modify on-site traffic to enter form the 
existing driveway, utilize the facility, then proceed through the east parcel to exit 
onto Olive Avenue at the new driveway” and that this would “…greatly improve 
on-site traffic patterns and at Olive Avenue”. 
80. The Legend for many of the Figures list AM Peak Hour twice. Should one be Midday 
Peak? 
81. Figure 5 – There are only two eastbound through lanes on Olive Avenue at the West 
Driveway. 
82. Trip Generation – This section refers to 5 additional employees that the proposed site will 
gain. What is the total number of employees expected? What are the total number of trips 
per day including trucks at buildout. 
83. Figure 6 – Is this exhibit showing that 40% of site traffic plan to use the West Access and 
60% use the east access?  
84. It is noted throughout the TIA that the Prop Petroleum Drive/Olive Avenue “operates at 
an inadequate LOS during the weekday AM, MIDDAY and PM peak hours”.  The 
midday peak is not inadequate. 
85. Turn Lane Analysis - Olive Avenue is an arterial roadway so all driveways require a right 
turn deceleration lane. The City requires a minimum of 160 feet of storage and a 100-foot 
taper. If the developer wishes to remove the requirement for the deceleration lane, a 
Request for Design Exception must be provided. 
86. Mitigation – 2nd Paragraph - Is this section referring to the West Driveway? 
87. Page 27 – The first two paragraphs seem to contradict one another.    
88. Provide an exhibit that shows the distances between the following driveways, measured 
from nearest face of curb to nearest face of curb: existing Burger King driveway, 
proposed FPO driveway, existing FPO driveway and 121st Avenue. Minimum driveway 
spacing on an arterial roadway is 250 feet. 
 
Miscellaneous 
89. A Final Plat per Chapter 1, Section B-2 of the City’s Design & Development Standard 
Manual (DDSM) will be required prior to Certificate of Occupancy. The Plat shall show: 
a. All right of way and easement dedications including PUEs, Drainage Easements, 
etc. 
b. Consolidation of lots or any cross easement/agreements to share access, parking, 
drainage, etc. 
c. A 1-foot Vehicular Non-Access Easement is required along Olive Avenue except 
at legitimate driveways. 
d. Right of way and easement dedications from previous Pro Petroleum projects 
were never recorded and shall be added to the Final Plat of this project. This 
includes the chamfer at the northwest corner of the intersection of Olive Avenue 
and 121st Avenue and the water easement along the east side of the existing 
driveway. Copies of those legal descriptions are attached. 
90. A Geotechnical Report will be required to provide asphalt/concrete pavement sections 
including Olive Avenue. Verify the proposed pavement sections can handle 75,000 lbs. 
for any fire access lane or more if the trucks entering and exiting the site will be heavier.

91. A Haul Permit will be required if 500 cubic yards or more of material will be brought 
into or out of the site. This will require a separate application, an exhibit showing the haul 
route and insurance from the company performing the haul. The fee is $300. 
92. An Approval to Construction (ATC) will be required from MCESD for the water and 
sewer line extensions. A copy shall be provided to the City prior to the release of any 
Engineering permit. 
93. It appears that a septic system may be an alternative for this site. If a septic system is 
preferred, the plan review would be performed by Maricopa County and the City would 
require a copy of the system installation approval prior to granting Certificate of 
Occupancy.  
94. A Dust Control Permit from the County will be required prior to the release of any 
Engineering permit. 
95. A Stormwater Pollution Prevention Plan (SWPPP) will be required per the City’s SWPPP 
Guidelines document. A Notice of Intent (NOI) from ADEQ will be required prior to 
release of any Engineering permit. 
 
The above comments are meant to be general in nature and are not considered to be all inclusive. 
Additional comments will arise during the formal permit submittal.

For the consideration of Ten Dollars ($10.00), and other good and valuable consideration, 
the receipt and sufficiency of which is hereby acknowledged, GRANTOR does hereby grant and 
convey to GRANTEE, its successors and assigns, a perpetual easement as described herein for 
utility purposes, including, but not limited to, the right to erect, construct, install, maintain, use, 
operate, inspect, repair, replace and remove delivery and/or water lines and related appurtenances in, 
on, over, under, across, above and through the attached described real property situated within 
Maricopa County, Arizona, identified in the attached Exhibits A and B. 
 
 
The GRANTEE shall also have the right and privilege forever to patrol, inspect, alter, 
improve, add to, repair and remove such utility facilities, including the right to increase or decrease 
the size of the lines, and all other rights and privileges necessary or convenient for the full use and 
enjoyment of the easement, servitude and privileges herein granted for the purposes herein 
described, including the right of ingress and egress to and from said easement and pipeline over 
adjoining property of the GRANTOR, and the right to use existing roads and as much of the surface 
of the land, herein above described as may be necessary for the purpose of constructing, inspecting, 
maintaining, operating, repairing, replacing, and/or removing the facilities, either in whole or in 
part, at the will of GRANTEE. 
 
 
To have and to hold said easement, servitude and privileges unto the GRANTEE, its 
successors and assigns, forever, subject to the conditions and limitations herein contained. 
 
 
It is agreed that the GRANTOR shall have full use of said easement except for the purpose 
for which the same is herein conveyed to the GRANTEE, and except for uses which interfere with 
the enjoyment by GRANTEE of the rights and servitude herein conveyed to it, and provided always 
that no building or structure of any nature or kind whatsoever, including without limitation fences, 
nor any part of same, shall be constructed, installed or placed on or over said easement or any part 
thereof by GRANTOR or the successors or assigns of GRANTOR, and that the grade over any 
buried facilities shall not be changed by GRANTOR or the successors or assigns of GRANTOR 
without the prior written consent of the GRANTEE.  The rights and obligations of GRANTEE shall 
be construed broadly and consistent with the performance of its obligations to provide utility service

to its customers. 
 
 
GRANTEE shall be and remain responsible for the construction, operation, maintenance and 
repair of the utility facilities and GRANTOR shall have no responsibility or liability in such 
construction, operation, maintenance or repair.  GRANTEE shall indemnify and hold GRANTOR 
harmless from all injuries and damages arising from GRANTEE’S use of the easement area.  
GRANTEE shall return the property to its prior condition after completing the construction, 
maintenance or other uses permitted under the foregoing easement. 
 
 
This Public Water Easement constitutes a perpetual covenant running with the land for the 
benefit of the GRANTEE, its successors and assigns. 
 
CAUTION: The above described easement may contain underground facilities the location of 
which must be verified as required by Arizona Revised Statutes, Section 40-360.21 et seq. (Arizona 
Blue Stake Law) prior to excavation.
