D R A F T REGULAR MEETING OF THE COMMON COUNCIL OF THE CITY OF EL MIRAGE EL MIRAGE CITY COUNCIL CHAMBERS 10000 N. EL MIRAGE ROAD 6:00 PM -TUESDAY, APRIL 16, 2024 Minutes 1. ROLL CALL Present: Mayor Alexis Hermosillo; Vice Mayor David Shapera; Councilmember Roy Delgado; Councilmember Bob Jones; Councilmember Anita Norton; Councilmember Donna Winston Absent: Councilmember Monica Dorcey (Excused) 2. CALL TO ORDER - MEETING CALLED TO ORDER AT 6:00 PM Pledge of Allegiance Moment of Silence 3. PRESENTATION 1. Recognition of Tohono O'odham Nation for their generous grant funding which made it possible for the City of El Mirage to acquire an additional Police K-9 officer. (Administration/Police) Police Chief Paul Marzocca introduced Police Officer Doug Jones and his new K9 Gunner. Officer Jones detailed Gunner's background and a short video presentation was shown. Mr. Matt Smith of Strategic Issues Management Group thanked Council and staff for the great relationship Tohono O'odham Nation has with El Mirage. Director of Public and Government Relations for Desert Diamond Casinos, Ms. Treena Parvello, stated they are proud of the work they do which results in successes like Gunner. 4. PROCLAMATION 1. Proclamation declaring the month April 2024 as Sexual Assault Awareness Month. (Administration) Deputy Director of Intergovernmental Affairs Amber Wakeman introduced Councilmember Anita Norton, who provided background information on the proclamation. Mayor Hermosillo proclaimed April 2024 as Sexual Assault Awareness Month. 5. CALL TO THE PUBLIC Citizens desiring to speak on any issue within the jurisdiction of the public body may do so at this time. Comments shall be limited to three (3) minutes per person and shall be addressed to the City Council as a whole. At the conclusion of the Call to the Public, individual City Council Members may (1) respond to criticism made by those who have spoken, (2) direct staff to review or follow up on the matter, and/or (3) direct that the matter be put on a future agenda. No public comments were received. 6. CONSENT AGENDA All items listed under the Consent Agenda will be voted on with one motion. If discussion is desired regarding any Consent Agenda Item, that item will be removed from the Consent Agenda and voted on separately. 1. Consideration and action to approve the minutes of the Regular Council meeting held Tuesday, April 2, 2024. (City Clerk) 2. Consideration and action to affirm the agreement with First Data Merchant Services LLC for the rental of two credit card terminals. (City Court) 3. Consideration and action to approve the purchase and installation of Court audiovisual equipment with Bluum USA, Inc. for an amount not to exceed $60,000 utilizing Arizona State Contract ADSPO17-184593. (City Court) 4. Consideration and action to authorize the City Manager to enter into an Intergovernmental Agreement (IGA) with the Regional Public Transportation Authority (RPTA) for FY24-25 Regional Americans with Disabilities Act (ADA) Paratransit Service for an amount not to exceed $10,000. (Community Services - Grants) 5. Consideration and action to authorize the City Manager to enter into an agreement with Northwest Valley Connect, a non-profit 501(c)3, for local Dial-A-Ride transit services for FY24-25 in an amount not to exceed $240,000. (Community Service - Grants) 6. Consideration and action to approve the destruction of municipal documents that have reached the end of their retention period as authorized under A.R.S. §41-151.19. (Police Department) Vice Mayor Shapera moved to approve Consent Agenda items 1-6; seconded by Councilmember Delgado. Vote: 6 - 0 Passed - Unanimously 7. REGULAR AGENDA 1. Consideration and action on a site plan amendment zoning application to an approved major site plan for industrial use for a data center located at 12901 W Olive Avenue submitted by Jacobs Engineering. (Development Services - Planning and Zoning) Senior Planner Jose Macias provided background information on the site plan amendment. Applicant Cameron Carter introduced himself to Council. Vice Mayor Shapera stated this item 2 Regular Meeting - Council Minutes April 16, 2024 was very well presented and he was in favor of it. Councilmember Delgado asked if the area being discussed was the area that was cleaned out for the APS power poles and Mr. Macias stated the area runs parallel to Peoria Avenue towards Dysart Road and will not affect the site plan. Councilmember Norton asked what the water usage at the site would be and Ms. Avery Africa with Microsoft stated they have been working closely with EPCOR on the site water usage, and it will be using one of the most sustainable cooling methods available, as well as air-cooled chillers. Vice Mayor Shapera moved to approve a site plan amendment zoning application to an approved major site plan; seconded by Councilmember Winston. Vote: 6 - 0 Passed - Unanimously 2. Consideration and action on a zoning relief request from Chapter §152.030 requiring utilities and electrical 13KV power lines and under to be relocated underground (Development Services - Planning and Zoning) Senior Planner Jose Macias presented information on the zoning relief request. Vice Mayor Shapera stated it appears to have no adverse effects on El Mirage if granted. Vice Mayor Shapera moved to approve the zoning relief request as presented; seconded by Councilmember Delgado. Vote: 6 - 0 Passed - Unanimously 3. Consideration and action to approve an Intergovernmental Agreement (IGA) between the El Mirage Police Department and the Glendale Police Department's Special Weapons and Tactics (SWAT) Team ending on July 1, 2026 (Police). Police Chief Paul Marzocca detailed the agreement and the benefits to El Mirage. Vice Mayor Shapera stated this Council and previous Council's have encouraged cooperation between cities, and he supports this item. Councilmember Norton asked what kind of equipment would be purchased with the forfeiture funds received from this collaboration and Chief Marzocca listed some of the specialty equipment needed. Councilmember Norton asked if additional officers would be trained for this and Chief Marzocca stated in the future there are plans for other officers. Councilmember Winston stated she is excited about this opportunity and is happy to see it move forward. Councilmember Jones stated this is an exciting time, and it is always more cost-effective to utilize team efforts. Councilmember Delgado congratulated Chief Marzocca and stated he hopes the collaboration works well. Vice Mayor Shapera moved to approve an Intergovernmental Agreement between El Mirage Police Department and the Glendale Police Department's Special Weapons and Tactics Team; seconded by Councilmember Norton. Vote: 6 - 0 Passed - Unanimously 4. Public Hearing, closure of Public Hearing followed by consideration and action to recommend to the Arizona Department of Liquor Licenses & Control approval/disapproval of an application for a new license (#286304) for R&G Mini Mart, 12239 NW Grand Av, El Mirage, AZ, 85335. (Police) Mayor Hermosillo opened the Public Hearing. Chief Marzocca provided information on the application and applicant. Vice Mayor Shapera asked Chief Marzocca to advise the owner it would be beneficial to have a security system in place and 3 Regular Meeting - Council Minutes April 16, 2024 maybe the Police Department could incorporate that request in future applications. Hearing no further comments, Mayor Hermosillo closed the Public Hearing. Councilmember Delgado stated he had no issue with this location. Vice Mayor Shapera moved to recommend to the Arizona Department of Liquor Licenses & Control approval of an application for a new license for R&G Mini Mart; seconded by Councilmember Delgado. Vote: 6 - 0 Passed - Unanimously 8. CITY MANAGER'S COMMENTS & SUMMARY OF CURRENT EVENTS The City Council may not act upon any matter in the City Manager's summary but may have general comment or questions. City Manager Crystal Dyches thanked Council for their assistance at the budget work session the day before and reminded everyone of the blood drive taking place on Wednesday, April 17, 2024, from 9:30 am until 1:30 pm in Council Chambers. 9. MAYOR'S COMMENTS and COUNCIL SUMMARY OF CURRENT EVENTS The Mayor and City Council may not discuss or act upon any matter in the summary unless the specific matter is properly noticed for legal action. Councilmember Delgado stated the Rally's restaurant opened today, and it was very well attended and busy. Councilmember Jones stated he was at the Music in the Park last night and the weather was beautiful. He stated everyone had a great time. Councilmember Norton stated she is glad to see the Rally's is open now. Councilmember Winston stated she and a few other Councilmembers were invited to a family and friends event at Rally's, and it was fun to learn how to make some of the items on the menu. She stated she is glad the space is now occupied. Mayor Hermosillo recognized Keith and Lydia Forte. Mr. Forte is District Director for Congresswoman Debbie Lesko's office and a resident of El Mirage. Mayor Hermosillo also wished Councilmember Delgado a happy birthday. 9. EXECUTIVE SESSION 1. Consideration and action to adjourn into Executive Session pursuant to A.R.S. § 38-431.03.A.4. for 1) discussions or consultations with designated representatives of the public body in order to consider its position and instruct its attorneys regarding the public body's position regarding contracts that are the subject of negotiations, and pursuant to A.R.S. § 38-431.03.A.7. for 2) discussions or consultations with designated representatives of the public body in order to consider its position and instruct its representatives regarding negotiations for the purchase, sale or lease of real property. (Administration) Vice Mayor Shapera moved to adjourn into Executive Session; seconded by Councilmember Delgado. Vote: 6 - 0 Passed - Unanimously 11.
