RESOLUTION NO. R21-24 
 
A RESOLUTION OF THE COUNCIL OF THE CITY OF 
GLENDALE, 
MARICOPA 
COUNTY, 
ARIZONA, 
AUTHORIZING AND DIRECTING THE ENTERING INTO OF A 
DEVELOPMENT AGREEMENT FOR INFRASTRUCTURE WITH 
NEWMARK HOMES, LLC AND BEAU MONDE, LLC. 
 
 
WHEREAS, pursuant to A.R.S. § 34-201(L), as a condition of development and as authorized 
by A.R.S. § 9-463.01, Newmark Homes, LLC and Beau Monde, LLC have designed and caused to 
be constructed at their cost an extension of the public sewer system at 61st Avenue; and 
 
 
 
WHEREAS, in consideration of the public infrastructure built by Newmark Homes, LLC and 
Beau Monde, LLC the City will credit the cost of the sewer line against the development impact fees 
owed by Newmark and Beau Monde. 
 
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GLENDALE as follows: 
 
SECTION 1.  That it is deemed in the best interest of the City of Glendale and its citizens that 
the City of Glendale enters into a Development Agreement with Newmark Homes, LLC and Beau 
Monde, LLC. The Agreement is now on file in the office of the City Clerk of the City of Glendale. 
 
SECTION 2.  That the City Manager and City Clerk be authorized and directed to execute and 
deliver such agreement on behalf of the City of Glendale.  
 
PASSED, ADOPTED AND APPROVED by the Mayor and Council of the City of Glendale,
