Amendment No. 2

SECOND AMENDMENT TO
FIRE AND MEDICAL SERVICES AGREEMENT

THIS SECOND AMENDMENT to the Intergovernmental Agreement for Fire and Medical
Services Response is made this _ day of April __, 2021, by and between the City of Peoria,
Arizona, an Arizona Charter City and municipal corporation referred to as "Peoria” and the City of
Glendale, Arizona, an Arizona Charter City and municipal corporation referred to as "Glendale”, and
the Sun City Fire District, a special taxing district organized under the laws of the State of Arizona
referred to as “Sun City”. Peoria, Glendale and Sun City are referred to herein collectively as the

“Parties” or individually as a “Party”.

RECITALS

WHEREAS, the Parties entered into an Intergovernmental Agreement for Fire and Medical
Services Response dated August 8, 2017 ("Agreement") that set forth the terms and conditions of
reimbursing the Parties for providing Fire and Medical Services to the property owned by Desert
Diamond Casinos & Entertainment, an enterprise of the Tohono O'odham Nation, which is located
at 9431 W. Northern Avenue in Glendale, Arizona ("Subject Property"); and

WHEREAS, the Parties previously amended the Agreement on May 31, 2019 (LCON
02017A) whereby the term of the Agreement was extended an additional two years to May 31,
2021; and

WHEREAS, the Agreement will terminate on May 31, 2021; and

WHEREAS, the Agreement only may be extended or modified in writing signed by both
parties; and

WHEREAS, the Parties desire to extend the term of the Agreement for two years
through May 31, 2023.

In consideration of the mutual benefits and obligations set forth in this Second Amendment,
the Parties agree as follows:

I. EXTENSION OF TERM

Sections II and IV of the Agreement shall be amended to extend the termination date of the
Agreement to May 31, 2023.

I. NO OTHER CHANGES
Except for the amendment, set forth in Section I herein, which extends the termination date

of the Agreement, all other terms and conditions of the Agreement shall remain in full force and
effect.

IN WITNESS WHEREOF, the Parties have executed this Second Amendment to the
Agreement effective as of the date first set forth above.
