RESOLUTION NO.

A RESOLUTION OF THE COUNCIL OF THE CITY OF
GLENDALE, MARICOPA COUNTY, ARIZONA,
AUTHORIZING AND DIRECTING THE ENTERING INTO OF
AMENDMENT NO. 1 TO THE RECIPROCAL SERVICES
INTERGOVERNMENTAL AGREEMENT FOR LANDFILL
DISPOSAL SERVICES WITH THE CITY OF PHOENIX.

WHEREAS, the City of Glendale has a Municipal Landfill located at 11480 West
Glendale Avenue; and

WHEREAS, the City Council previously adopted Resolution No. R18-135, which
authorized and directed the City Manager to enter into a Reciprocal Services Intergovernmental
Agreement (“IGA”) with the City of Phoenix for Landfill Disposal Services at the Glendale
Municipal Landfill; and

WHEREAS, by its terms, the IGA terminates on July 1, 2021; and

WHEREAS, the City of Phoenix is requesting an amendment to the IGA to extend its
term to June 30, 2023.

BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GLENDALE as follows:

SECTION 1. That it is deemed in the best interest of the City of Glendale and the
citizens thereof that Amendment No. 1 to the Reciprocal Services Intergovernmental Agreement
for Landfill Disposal Services with the City of Phoenix be entered into, which agreement is now
on file in the office of the City Clerk of the City of Glendale.

SECTION 2. That the City Manager or designee and City Clerk are authorized and
directed to execute and deliver said amendment on behalf of the City of Glendale at his
discretion, and to extend the term in accordance with the provisions of the Intergovernmental
Agreement.

Amendment No. 1 to
City of Phoenix Intergovernmental Agreement No. 148467

This Amendment No. 1 to Intergovernmental Agreement No. 148467 (“Agreement”)
is entered into by the City of Phoenix, a municipal corporation of the State of Arizona
(“City”), and the City of Glendale, an Arizona municipal corporation (“Glendale”) and

is made effective July 1, 2021.

Recitals

A. The Agreement was entered on or about July 1, 2018 to provide mutual service
benefits and operational efficiencies in the collection and disposal of solid waste

material.

Amendment

1. Paragraph 4.1, “Term of Agreement,” is amended by extending the term from July

1, 2021 to June 30, 2023.

2. Except as otherwise amended, all other terms and conditions of the Agreement and
any prior amendments not in conflict will remain in full force and effect. If there is
a conflict or ambiguity among amendments and the Agreement, the documents in
the following order prevail and control: (a) the most recent amendment; and (b)

the original Agreement.
