RESOLUTION NO. R21-123
A RESOLUTION OF THE COUNCIL OF THE CITY OF 
GLENDALE, 
MARICOPA 
COUNTY, 
ARIZONA,
AUTHORIZING AND DIRECTING THE ENTERING INTO OF 
AN INTERGOVERNMENTAL AGREEMENT TO PROVIDE A 
WASTEWATER BYPASS FOR THE CITY OF
PEORIA
BUTLER DRIVE WATER RECLAMATION FACILITY TO 
THE 99th AVENUE INTERCEPTOR AND THE CITY OF 
PHOENIX 91st
AVENUE WASTEWATER TREATMENT 
PLANT DURING EMERGENCY OR BYPASS EVENTS. 
WHEREAS, the City of Peoria owns a wastewater bypass manhole and overflow main 
located in the vicinity of 99th Avenue and Northern Avenue to provide a wastewater bypass of 
the City of Peoria Butler Drive Water Reclamation Facility to the 99th Avenue Interceptor; and 
WHEREAS, the City of Peoria desires the City of Glendale to receive and transport
wastewater flow conveyed from the bypass structure from the portion of the 99th Avenue 
Interceptor to 91st Avenue Wastewater Treatment Plant during emergency and planned bypass 
events; and 
WHEREAS, the City of Glendale owns capacity in the 99th Avenue Interceptor from the 
diversion structure to the 91st Avenue Wastewater Treatment Facility; and
WHEREAS, the City of Peoria desires that the City of Phoenix receive and treat 
wastewater at the 91st Avenue Wastewater Treatment Plant and has the excess capacity to 
provide temporary treatment services; and
WHEREAS, the City of Glendale desires to transport and the City of Phoenix desires to 
treat wastewater flows released by the City of Peoria during emergency and planned events.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GLENDALE as follows:
SECTION 1.  That it is deemed in the best interest of the City of Glendale and the 
citizens thereof for the City of Glendale to enter into the Intergovernmental Agreement with City 
of Peoria and the City of Phoenix to provide a wastewater bypass of Butler Drive Water 
Reclamation Facility and transport the flow to the 91 Ave Wastewater Treatment Plant to treat on 
an emergency and planned bypass event. 
SECTION 2. That it is the City of and Peoria responsibility for all cost and expenses 
associated with the conveyed wastewater flows and treatment.
SECTION 3.  That the City Manager or designee and the City Clerk are authorized and 
directed to execute and deliver any and all documents necessary to effectuate said Agreement on 
behalf of the City of Glendale.
