RESOLUTION AUTHORIZING THE CHAIRMAN TO EXECUTE CERTAIN 
UTILITY EASEMENTS
WHEREAS, on February 12, 2025, the Maricopa County Board of Supervisors approved 
Contract #240056-CMR with Core Construction. (C-73-24-073-X-01) for construction services 
for the Downtown Elections Facility on land owned by the County located between Jefferson and 
Madison streets between 8th and 9th Avenues and between Jefferson and Madison streets West of 
9th Avenue (the “Project’); and
WHEREAS, pursuant to A.R.S. § 11-251(9), with unanimous consent of the Board, 
Maricopa County may grant easements on County property for public purposes to utilities 
without public auction and it is in the public interest to grant easements to such utilities, as 
defined in A.R.S. § 40-491, as are necessary to service and/or advance the Project; and
WHEREAS, it is in the public interest to have the Project completed in a timely fashion; 
and
WHEREAS, requiring that each individual grant of easement to a utility, as defined in 
A.R.S. § 40-491, necessary to service and advance the Project to be placed on a separate Board 
agenda for approval would unreasonably and unnecessarily delay the completion of the Project.
NOW, THEREFORE, BE IT RESOLVED THAT the Maricopa County Board of 
Supervisors does authorize its Chairman, without the necessity of further Board action, to 
execute and deliver all easements to utilities, as defined in A.R.S. § 40-491, necessary to serve 
and/or advance the Project, provided that each of the following is true:
a.
The easement is needed based on the utility or other plans for the Project that have 
been authorized by this Board; and
b. The Director of the Maricopa County Real Estate Department has approved the 
granting of the easement; and
c.
The Director of the Maricopa County Facilities Management Department has 
approved the granting of the easement; and
d. The office of the Maricopa County Attorney has approved the easement as to form 
and as being within the authority of Maricopa County.
