Ms. Perry said the property was approximately 276 acres in size and was located at the northwest and northeast corner of Sarival Avenue and Olive Avenue. It was currently within Maricopa County and was zoned RU-43 (Rural). The applicant proposed a Major General Plan Amendment to light industrial and a rezoning to PAD (Planned Area Development) to allow for approximately 4.38 million square feet of industrial building area. ORDINANCE NO. Presented By: Tabitha Perry, Planning Manager Ms. Bower read the resolution and ordinance by title. Mayor Weiers opened the public hearing. Ms. Perry said the applicant was requesting a Minor General Plan Amendment from HDR 12-20 (High Density Residential) to HDR 20-30 for the east half of property and rezoning from R-4 (Multiple Residence) to Planned Area Development (PAD) for the entire 30-acre property. The PAD included: R-4 district uses City Council Meeting Minutes - October 25, 2022 Page 7 of 16 Increased residential units from 600 to 605 3-story multi-family and 4-story senior apartments Reduced site coverage Streetscapes for 67th, 69th and Maryland Four full access drives Ms. Perry said the Planning Commission recommended approval of the application. The concerns expressed at the Planning Commission's public hearing by residents regarded adequate school facilities, adequate parking and the height of the project. There were adequate school facilities and no parking would be allowed on streets. The Planning Commission added a stipulation to provide additional setbacks along 69th Avenue. Councilmember Aldama asked for clarification regarding the parking standards and the reduced balcony size. Ms. Perry said the PAD allowed deviations from the City's parking standards. Based on the parking study and other factors, staff found the parking was acceptable. Ms. Perry said the PAD also allowed deviations for the size of the balcony. Market trends indicated residents were not utilizing private balconies and preferred additional open space amenities. Councilmember Clark said the applicant admitted that it lacked 157 parking spaces for the 67 Flats portion and that it was over-parked on the Juniper Square side. She had asked the applicant to move the excess parking to 67 Flats but was told the parking could not be moved. The City allowed the applicant to reduce the size of the parking space from 10 feet by 20 feet to 9 feet by 20 feet. Councilmember Clark said the City standard for private open space such as a balcony was 100 square feet per unit, but the applicant had been granted a reduction to 65-85 square feet per unit. The applicant was allowed to deviate from the setback standard on the north and east sides of the development. The applicant had asked for additional building height to increase open space but could not accommodate adequate setbacks. Councilmember Clark said she would ask to table the item but did not believe she had support for that, and the applicant had told her if she tabled it, the project would not proceed. The applicant had been rigid and made no concessions to Glendale standards. She was disappointed that the project did not meet City standards just because it was affordable housing. Ms. Perry said the staff analysis had indicated that the deviations were justified and acceptable. Vice Mayor Aldama said the deviations were allowable. He believed residents would be using the open space amenities and the size of the balconies would not be a negative. The project would increase the affordable housing inventory in the City. It was a good project and he supported it. Councilmember Tolmachoff asked about the access to the transit system. She asked how many letters had been received regarding the project. Ms. Perry said there was a transit stop at south of Maryland Avenue and 67th Avenue. She said there were letters from two residents in opposition. Councilmember Malnar said it was an affordable housing project. Rents had skyrocketed in the Valley and the City had put out a call to builders for affordable housing projects. Councilmember Clark was not opposed to affordable housing but did not think the standards should be reduced for affordable housing projects. She would be voting no. No one wished to speak. Mayor Weiers closed the public hearing. A motion was made by Vice Mayor Jamie Aldama, seconded by Councilmember Lauren Tolmachoff to adopt Resolution No. R22-110. Councilmember Hugh said standards should be kept up for people in affordable housing. Councilmember Turner was concerned about the 9-foot wide parking spaces but would support the project. There was a need for affordable housing. Vice Mayor Aldama said Councilmember Clark had valid concerns but he knew she would be there for the groundbreaking and ribbon-cutting ceremonies for the project. Mayor Weiers said there were shortages of affordable, safe housing and he was in support of the project. O22-71 AN ORDINANCE OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY, ARIZONA, AMENDING THE ZONING ORDINANCE OF THE CITY OF GLENDALE, ARIZONA, BY APPROVING ZONING TEXT AMENDMENT ZTA22-01, AMENDING THE ZONING ORDINANCE, ARTICLE 7, SECTION 7.800 (MEDICAL MARIJUANA); PROVIDING FOR SEVERABILITY, SETTING FORTH AN EFFECTIVE DATE; AND ORDERING THAT A CERTIFIED COPY OF THIS ORDINANCE IS RECORDED. Ms. Perry said the objective of the proposed text amendment was to address the potential for co-location of specific marijuana-related facilities within industrial zones and better control of potential emissions. It would provide incentive to concentrate the facilities in industrial areas instead of commercial areas. The ordinance addressed the application process, type and scale of activities, and enclosures for offsite cultivation facilities, dispensaries, infusion or manufacturing and designated caregiver cultivation. A summary of the Code amendment included: Emission control plan requirement Allow dispensary in M-1 and M-2 Allow co-location of dispensary and cultivation, infusion/manufacturing facilities by eliminating distancing requirement in M-1 and M-2 zones Councilmember Tolmachoff asked what was meant by emission and emission control. Ms. Perry said many times the odor of marijuana was detectable from the facilities. The Planning Commission wanted to require the application to include an emission control plan so that the facility could be held accountable. Councilmember Clark thought there were no emission standards in the ordinance. She asked what would be enforced. Ms. Perry said the current Code prohibited emission. The text amendment would require the applicant to provide the City with an emission control plan that demonstrated how the odor would be controlled. Building Safety would make sure it met applicable codes. Councilmember Clark suggested that staff provide applicants with guidelines for developing a plan. Ms. Perry said some facilities had plans, but the City had not previously required it as part of the application. Staff could check the Uniform Building Code to see if there were emission guidelines. The ordinances approved purchase and sale agreements for City-owned parcels generally located south and west of 52nd and Glendale Avenues. The parcels functioned as rail spurs until the early 1900s when they were subsequently abandoned by the railroad operators to the City. Over time, the area developed into a commercial district and the unique location of the City-owned real property served as an obstruction to the current commercial operations in the area. The sale of the parcels to the adjacent property owners was deemed in the best interest of the City. It would also absolve the City of any future liability. A motion was made by Councilmember Ian Hugh, seconded by Councilmember Joyce Clark to adopt Ordinance No. O22-72. Councilmember Turner said if he owned the land, he would not sell it at the price being offered. On behalf of the taxpayers, he was reluctant to sell it at that price and would vote no on all four items. Mr. St. John said the three ordinances amended Chapter 24 of the City Code. Changes included: Section 24-65 (g) - Removal of redundant and confusing language Section 24-68 (b) - Addition of language allowing up to three (3) vehicles to be parked on any single-family dwelling lot within a residentially zoned district regardless of the size of the dwelling unit in accordance with all other parking provisions Section 24-65 (f) and (g) - Allow parking of recreational vehicles on an auxiliary drive Councilmember Tolmachoff asked how residents would know there had to be a clear delineation between the drive and the yard. Mr. St. John said the Code currently required that a parking space be distinctly different from the landscaped area of the front yard. Councilmember Tolmachoff asked if a border could be required. Mr. St. John said that provision currently existed in the Code. She encouraged residents to attend the NFL Experience event. It was a free event and did not require tickets. Councilmember Tolmachoff reminded Cholla District and Sahuaro District residents of an update on water resources and incentives being presented on Thursday, November 3rd at 6:00 p.m. at the Foothills Recreation and Aquatics Center. Councilmember Turner invited residents to attend the public meeting on Wednesday, October 26th in Council Chambers regarding the Downtown Campus Reinvestment Project. Vice Mayor Aldama reported that former Glendale City Councilmember Norma Alvarez had passed away. She was an employee of the City for 21 years and retired in 2007 as the City's Community Services Director. She was elected to the Council in 2011 and served until 2014. Her contributions to the City enriched the lives of many Glendale residents. CITIZEN COMMENTS Anna Hernandez, Phoenix resident, spoke regarding the death of Juan Carlos Bojorquez.
