Shopping Cart Ordinance Presented by Rick St. John, Deputy City Manager Shopping Cart Ordinance 2 We are seeking Council consensus on amending the Glendale City Code by adding Section 21.5 Shopping Carts Shopping Cart Ordinance 3 • ARS 44-1799.31 – 36 Makes it unlawful to; – Remove a shopping cart from a retail establishment – Altar or remove identifying information from a shopping cart – Posses a shopping cart that has been removed from a retail establishment – Abandon a shopping cart at a location other than the retail establishment Shopping Cart Ordinance 4 To aide in preventing violations of ARS 44- 1799.31-36, several valley cities have adopted an ordinance regulating what protections retail establishment owners must have in place. Shopping Cart Proposed Ordinance 5 New retail shop owners at newly constructed locations must equip all shopping carts with a restrictive device that prevents removal – Must certify with the City prior to receiving a business license or Certificate of Occupancy Shopping Cart Proposed Ordinance 6 • Existing retail shop owners or new owners doing business out of an existing facility must either, – Equip each shopping cart with the restrictive device, or – Enter into a contractual agreement with a shopping cart retrieval service • If the contract option is used, the owner must; – Post a public notice stating the removal of a shopping cart from the premises is illegal, and – Display the name, address, and contact phone number for the retail establishment on each shopping cart • Violations are a civil offense Shopping Cart Proposed Ordinance 7 • The proposed ordinance affirms State law making it illegal to; – Remove a shopping cart from a retail establishment – Possess a shopping cart – Abandon a shopping cart in a location other than the retail establishment • The ordinance sets forth the process for impounding shopping carts, getting the impounded carts back to the rightful owner, and disposing of unclaimed shopping carts – Violations are a Class 3 misdemeanor Shopping Cart Ordinance 8 We are seeking Council consensus on amending the Glendale City Code by adding Section 21.5 Shopping Carts
