Chairman Sellers called the meeting to order and asked the Clerk to call the roll.

The Board of Supervisors of Maricopa County, Phoenix, Arizona, convened in Formal Session at 
9:30 AM on Wednesday, September 25, 2024, in the Supervisors' Auditorium 205 W. Jefferson 
Phoenix, AZ 85003, with the following members present:  Jack Sellers, Chairman, District 1;  
Thomas Galvin, Vice Chairman, District 2;  Bill Gates, Supervisor, District 3;  Clint Hickman, 
Supervisor, District 4;  Steve Gallardo, Supervisor, District 5 (entered meeting late). Also present: 
Juanita Garza, Clerk; Kelly Gardiner, Minutes Coordinator; Jen Pokorski, County Manager,

INVOCATION - INVOCACIÓN
Supervisor Hickman introduced his guest, Lieutenant Martin (Marty) Overton. Lt. 
Overton who has worked with Maricopa County Sheriff’s Office (MCSO) for 25 years 
and is currently the Chase Field Ball Park Commander. Lt. Overton offered the 
invocation.
3.
PLEDGE OF ALLEGIANCE - JURO FIDELIDAD A LA BANDERA
Lt. Overton led the Pledge of Allegiance to the flag. 
Supervisor Hickman thanked Lt. Overton for coming to the meeting. He shared the story 
of their introduction in December 2020, when Supervisor Hickman was threatened 
following the Canvass of the 2020 Election. Supervisor Hickman gave a detailed 
accounting of that evening and the friendship that resulted, including their sons mutual 
interest in playing baseball. He thanked Lt. Overton and the MCSO for all the work that 
they do to help keep our communities safe.

PET SHOWCASE BY MARICOPA COUNTY ANIMAL CARE AND CONTROL - 
PRESENTACIÓN DE ANIMALES DOMESTICOS POR EL DEPARTAMENTO DE
CONTROL Y CUIDADO DE ANIMALES
Kim Powell, with Animal Care and Control, introduced Willy, a one-year-old male Lab 
mix that arrived at the shelter August 10. She said he is very friendly, is great with kids, 
and needs training. Ms. Powell said Willy is neutered and ready to go home today.
Chairman Sellers asked the Clerk if there were any announcements or corrections to the 
agenda. The Clerk said item 10 will be continued to the October 23, 2024, meeting.

Supervisor Gallardo thanked the Chairman for bringing this forward and acknowledged

Commission Recommendation:  On 8/8/24, the Commission voted 5-0 to adopt a motion 
recommending the Board of Supervisors deny Z2024056. 
Item was continued from the September 11, 2024 hearing per the applicant’s request.

Chairman Sellers asked Tom Ellsworth, Planning and Development Director, and 
Darren Gerard, Planning Division Manager, to come forward.
Mr. Ellsworth gave an overview of the case which was a request for a Special Use 
Permit (SUP) for a wireless communication facility, the associated design standards, 
and its proximity to a local school. He explained the details of the modification proposal. 
Mr. Ellsworth said there had been community outreach with the neighbors, who 
expressed concerns about the health effects and the safety for the surrounding 
community. He said this case was heard by the Planning and Zoning Commission on 
August 8, 2024, and it was determined by Legal Counsel that the objections being 
raised in this case fall under the purview of the Federal Communication Commission 
(FCC). They concluded this was not in the jurisdiction of Maricopa County, Planning 
and Zoning. Under the circumstances, the Commission voted 7/0 to deny this SUP 
request.
Chairman Sellers announced that each side would be allowed five minutes total to 
speak. 
The applicant, Craig Morgan, came forward and stated there has been extensive 
research done and this is the only place for the tower. He said this is about the rights 
of the business community to have safe and reliable internet, and health and safety 
were considered.  Mr. Morgan said they are willing to consider all adjustments and 
setbacks as recommended. He stated that reliable technology is needed in this area.
Suzanne DeStefano, Headmaster of a Great Hearts Elementary School, Archway 
Classical Academy Glendale, came forward to speak. The following four slides were 
projected in-room to provide visual aid in the case.

Ms. Stefano spoke in opposition. She expressed her concern as well as the concerns 
of many families in the area that the presence of a cell tower, with the proximity to the 
school property, could pose a potential danger. The school property is within the fall-
zone if the tower were to come down in a storm, she was also concerned that parents 
would pull children out of the school because of this possible danger.

Kyle Navarrette, representing Great Hearts – Glendale Preparatory, spoke in 
opposition and said there are other locations where a tower could be located that is not 
in a residential neighborhood.
Morgan Larette, resident, spoke in opposition and said he has kids at Great Heart. Mr. 
Larette expressed concern that they are proposing to put a cell tower in a junk yard that 
contains combustible material, and the school property is within the fall zone.
Erin Trimble, resident, lives near the proposed site and has children who are students 
at Great Heart. Ms. Trimble echoed other resident’s comments and said the site is an 
eye sore and will bring property values down and also has open and pending code 
violations.

Doug Bergbower, property owner, spoke in favor. Mr. Bergbower said there is hypocrisy 
in some of the comments made. The school was very quick to offer to buy his family 
property when there was a death in his family. He stated that the school put up 75-foot 
stadium light towers and did not worry about the fall zone and had no regard for the 
surrounding neighbors. 
Debra Grunwald, property owner of purposed site, did not wish to speak but wanted to 
register her support for this request.
Supervisor Hickman addressed the applicant’s comments and mentioned the cell tower 
health concerns are not within the purview of the County. He said the Planning and 
Zoning Commissioners stayed within the guidelines of Maricopa County and voted 7/0 
in opposition. 
Supervisor Hickman made the following statement:
We are not here today to discuss health concerns about cell towers. A cell tower can 
be built on this property, by right, if it meets the 2 to 1 lot line setback. This Special Use 
Permit does not meet these setback requirements. The neighborhood and school have 
come out in opposition to this special use permit. They do not wish to see a lesser 
setback from the school property to the cell tower. It appears a cell tower cannot be 
erected on this site in concert with normal 2 to 1 ordinance requirements at the height 
they are requesting, and I don’t think the site is appropriate for a cell tower special use 
for that height. The Commission unanimously recommended denial of the request.

AQ-2023-004-RULE 338 (SEMICONDUCTOR MANUFACTURING)
Convene a public hearing, as required by Arizona Revised Statutes (A.R.S.) § 49-479(b), to 
solicit comments on the proposed revision of Maricopa County Air Pollution Control 
Regulations, Rule 338 (Semiconductor Manufacturing) and the associated proposed revision

to the Arizona State Implementation Plan (SIP). Following the public hearing, the Board is 
requested to adopt the proposed amendments to the rule and to approve submission of the 
amended rule as a revision to the Arizona SIP.
The purpose of Rule 338 is to limit volatile organic compound emissions from the 
semiconductor manufacturing industry. The last significant revision to the rule occurred in 
1999.
 
The Maricopa County Air Quality Department (MCAQD) is proposing to revise Rule 338 to 
incorporate reasonably available control technology (RACT) controls for nitrogen oxide 
emissions generated during the semiconductor manufacturing process. In addition, MCAQD 
is proposing to revise some of the volatile organic compound controls in the rule to ensure 
the controls continue to implement RACT.

Dan Schroeder, resident, read the item. He asked if these changes are prompted by 
the recent Chinese semiconductor located in Maricopa County.
 
Phil McNeely, Director Air Quality, came forward to answer the question. Mr. McNeely 
said the changes being made are to bring the County into compliance with 
Environmental Protection Agency (EPA) standards and does not have anything to do 
with the new semiconductors in the Valley.

AQ-2023-003-RULE 331 (SOLVENT CLEANING)
Convene a public hearing, as required by Arizona Revised Statutes (A.R.S.) § 49-479(b), to 
solicit comments on the proposed revision of Maricopa County Air Pollution Control 
Regulations, Rule 331 (Solvent Cleaning) and the associated proposed revision to the 
Arizona State Implementation Plan (SIP). Following the public hearing, the Board is 
requested to adopt the proposed amendments to the rule and to approve submission of the 
amended rule as a revision to the Arizona SIP.
Rule 331 establishes limits for emissions of volatile organic compounds (VOCs) from solvent
cleaning operations. Rule 331 applies to operations using VOC-containing solvents to
remove impurities from exterior or interior surfaces.
 
The Maricopa County Air Quality Department (MCAQD) is proposing to revise Rule 331 to 
remove a reasonably available control technology (RACT) deficiency identified by the U.S.
Environmental Protection Agency so Rule 331 can be approved into the Arizona SIP as
meeting RACT. In addition, MCAQD is proposing other revisions to the rule including 
lowering the VOC content limit in the definition of Low-VOC Cleaner from 50 grams of VOC 
per liter to 25 grams of VOC per liter as well as restructuring the rule for clarity purposes. 
MCAQD plans to replace SIP Rule 34, Sections F-K (Organic Solvents – Volatile Organic
Compounds (VOC)) and current SIP Rule 331 with the revised rule to update the SIP and 
clarify regulatory requirements.

AQ-2023-002-RULE 326 (STEELMAKING OPERATIONS: ELECTRIC ARC FURNACES)
Convene a public hearing, as required by Arizona Revised Statutes (A.R.S.) § 49-479(b), to 
solicit comments on the creation of Maricopa County Air Pollution Control Regulations, Rule
326 (Steelmaking Operations: Electric Arc Furnaces) and the associated proposed revision 
to the Arizona State Implementation Plan (SIP). Following the public hearing, the Board is 
requested to adopt the new rule and to approve submission of the new rule as a revision to 
the Arizona SIP.
The purpose of Rule 326 is to limit volatile organic compounds (VOC) and nitrogen oxide 
(NOx) emissions from steelmaking operations using electric arc furnaces (EAF). The 
Maricopa County Air Quality Department is proposing to create Rule 326 to establish 
reasonably available control technology (RACT) controls for VOC and NOx emissions from 
steelmaking operations that utilize EAFs to melt scrap steel. This rulemaking is required to 
comply with Clean Air Act RACT requirements.

AQ-2022-004-RULE 330 (VOLATILE ORGANIC COMPOUNDS)
Convene a public hearing, as required by Arizona Revised Statutes (A.R.S.) § 49-479(b), to 
solicit comments on the proposed revision of Maricopa County Air Pollution Control 
Regulations (MCAPCR), Rule 330 (Volatile Organic Compounds). Following the public 
hearing, the Board is requested to adopt the proposed amendments to the rule.
The purpose of Rule 330 (Volatile Organic Compounds) is to limit volatile organic compound
(VOC) emissions from the use of organic solvents or processes that emit volatile organic 
compounds. The last significant revision to the rule occurred in 1996.
The Maricopa County Air Quality Department (MCAQD) is proposing to revise Rule 330 to 
clarify the applicability of the rule and update and restructure the rule. Proposed revisions 
include clarifying Rule 330 is a rule that regulates VOC emitting operations not regulated 
under a source-specific rule in the Maricopa County Air Pollution Control Regulations 
(MCAPCR). Further clarification to the rule applicability includes removing the regulation of 
solvents from the rule as they are more appropriately regulated under Rule 331 (Solvent 
Cleaning). In addition, MCAQD is proposing to restructure the rule to ensure consistency 
within the MCAPCR.

Brad Goss, resident, read the item and asked what has prompted the revision. Mr. 
McNeely said the EPA standards are prompting the adjustments. Chairman Sellers 
stated the air quality in Maricopa County is important for the health of citizens and the 
EPA sets the standards that need to be met.

Authorize the Community Solutions Funding Proposal request for the City of Mesa I.D.E.A. 
museum in the amount of $200,000 with an expected start date of September 22, 2024. The 
Board of Supervisors’ Community Solutions Funding (CSF) is primarily intended to cover the
cost of initiatives that carry the potential of advancing Maricopa County’s Strategic Goals 
and provide a clear public benefit for Maricopa County residents. The associated Maricopa 
County Strategic Goal is: Regional Services.
Pursuant to A.R.S. 42-17106(B), authorize the following appropriation adjustments to the FY 
2025 budget:
1. Decrease the expenditure authority in the Non Departmental (D470) General Fund (100) 
Non Recurring (NRNP) budget in the line “Community Solutions Funding” (4711) by 
$200,000. 
2. Increase the expenditure authority in the Non Departmental (D470) General Fund (100) 
Non Recurring (NRNP) budget in the line “D2 – Community Solutions Funding” (4762) by 
$200,000. 
These actions will have a net zero impact on the County-wide budget and do not alter the 
budget constraining the expenditure of local revenues duly adopted by the Board pursuant 
to A.R.S. 42-17105.

start date of December 2, 2024. The Board of Supervisors’ Community Solutions Funding 
(CSF) is primarily intended to cover the cost of initiatives that carry the potential of advancing 
Maricopa County’s Strategic Goals and provide a clear public benefit for Maricopa County 
residents. The associated Maricopa County Strategic Goal is: Regional Services.
Pursuant to A.R.S. 42-17106(B), authorize the following appropriation adjustments to the FY 
2025 budget:

Blue Crowley, resident, wanted to get information on the air conditioning units for Mesa. 
He noted that there were several other air conditioning units listed later in the agenda. 
Mr. Crowley asked why the approvals are being listed separately. 
Jen Pokorski, County Manager, clarified that the agenda items listed here were for 
Board approval to use the Community Funding Solutions funds. The subsequent 
agenda items are agreements with the City of Mesa to transfer the funds.

Museum offers hands-on activities and art exhibitions for kids of all ages, and is dedicated
to early learning, nurturing creative thinking, and engaging families in quality experiences. 
The Museum is in the process of renovating its permanent exhibits to provide enhanced and
state of the art experience to the public. Community Solutions Funds in the amount not to
exceed $200,000 will be used to support the renovations.  This agreement shall become

ACCEPT FUNDS FROM DEPARTMENT OF HOMELAND SECURITY FOR SECURING 
THE CITIES PROGRAM
Approve and accept additional grant funds from Department of Homeland Security, Grant 
No. 20CWDSTC00018-02-00 formerly 20CWDSTC00016-04-00 in the amount of 
$3,150,000. This grant provides assistance to the region by developing Preventative 
Radiological and Nuclear Detection (PRND) programs and integrating them into a national 
detection architecture. The Securing the Cities program provides training and support to the 
County and the participating municipalities on radiological detection through the use of 
federally approved equipment during routine patrols/business and at special events. The 
grant award begins on August 01, 2024 and ends July 31, 2025. Due to obligated project 
costs EM will be able to recover $357,694.35 at the approved department Indirect Cost rate 
of 12.81%.
The grant award is reoccurring. There is no match requirement for this grant. Maricopa 
County does not have to fund any additional costs for the program. The grant award is a 
non-mandated function and is a non-competitive award. 
Grant revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore, expenditure of the funds is not prohibited by the budget law. The 
approval of this action does not alter the budget constraining the expenditures of local 
revenues duly adopted by the Board pursuant to A.R.S. §42-17105.

Don Adams, resident, said federal funding is being spent on these programs and stated 
the Board does not oppose the open borders. 
Vice Chairman Galvin asked the staff member who responds to the question to address 
how this item is related to the border issue.
Blanca Caballero, Assistant County Manager, asked Mitch Lach, Interim Director for 
Emergency Management, to respond. Mr. Lach said this grant money is being accepted 
from the Federal Government to help secure those cities from radiological or nuclear 
threats. Ms. Pokorski added that we are not a border County and do not have authority 
over the border.
Lezley Shepherd, resident, talked about the border and her belief that the County 
should be concerned about the border if they are accepting money from the Federal 
Government for security.
Ms. Pokorski clarified this is accepting grant money from Homeland Security to help 
protect the County from threats.

AMENDMENT TO IGA WITH CITY OF PHOENIX
Approve and execute Amendment 7 of the Intergovernmental Agreement between the City 
of Phoenix and Maricopa County. The purpose of the Agreement is to set forth the parties’ 
respective rights and obligations with respect to Phoenix’s acceptance of Maricopa County’s
Recyclables. This Amendment addresses revised processing fee changes as provided by 
the City of Phoenix. All other terms and conditions of the Agreement and the previous six 
amendments remain the same and in full force and effect.

Dianne Barker, resident, asked about getting minorities on the Greater Phoenix 
Economic Council (GPEC). Ms. Barker went on to ask about the stated processing fee 
that is paid to the City of Phoenix and wanted to know what it was for? 
Andy Linton, Environmental Services Director, said the fees that are paid to City of 
Phoenix are to process the recyclables. He said that amount changes depending on 
what the city can then sell the processed recycled material for. 
Supervisor Gates suggested that Ms. Barker consult the City of Phoenix on the 
recycling program details.

Ms. Pokorski gave a summary of the ARPA funding process which has a deadline to 
be spent. 
Mike McGee, Budget and Finance, talked about the reallocation of the ARPA funds to 
make sure the total amount can be maximized and balanced over the 100 different 
projects that are being funded. The initial amounts are based on estimates and then 
the amounts are adjusted as needed. 
Jayson Matthews, Interim Director of Human Services, said this step allows the County 
the opportunity to be efficient with the funds that are received.
 
Dan Schroeder, resident, asked the Board to justify the reduction in the Health Clinic 
and adding to Weather Relief. Ms. Pokorski said there was an estimate overage in the 
Health Clinic and that overage was put toward the needed money for heat relief.
Nancy Wilming, resident, asked who puts together agenda items.
Ms. Pokorski said the departments that manage this work spend weeks, sometimes 
months researching and putting these items together as needs are identified in the 
community. Those items are sent to the Clerk of the Boards office, reviewed and 
compiled. Ms. Garza confirmed the process.

Services Department. The purpose of the Agreement is for the City to provide Tenant Based
Rental Assistance (TBRA) to eligible individuals that reside in the City of Surprise. The 
Agreement term is through September 30, 2025. 
The purpose of the Amendment No. 5 is to address the following:
A. Extend the term of the Agreement from September 30, 2025, through September 30, 
2026.
B. Add required Federal clause.
C. Revise Section 3 (Statement of Work) to add 2024 TBRA Work Statement:

Approve non-financial Amendment No. 1 to the Intergovernmental Agreement (“Agreement”)
between the City of Avondale (“City” or “Subrecipient”) and Maricopa County administered 
by its Human Services Department. The purpose of the Agreement is to expand availability 
of affordable housing in the Avondale area. The County provided Avondale with $2,750,000
in American Rescue Plan Act (ARPA) funds under the Assistance Listing Number 21.027 in 
order to develop and construct homes to be sold to low-income homebuyers. Avondale will 
partner with an eligible subrecipient or developer to construct the homes. The term of the 
Agreement is September 13, 2023, through December 31, 2025.
The purpose of Amendment No. 1 is to address the following:
A. Revise Paragraph 9.0 (Compensation), Subparagraph 9.1 to add language related to the 
use of ARPA funds and Developer Fees.
B. Revise Exhibit A Statement of Work to update language and budgets.
C. Revise Exhibit B Statement of Work to update language and budgets.
D. The County provided funds remain unchanged at $2,750,000. 
This Amendment shall be effective upon approval and signature by both Parties.

Supervisor Hickman asked if Ms. Wilming was from Avondale? Supervisor Hickman 
said the Board interacts with the municipalities and they are very appreciative for these 
types of agreements.
Supervisor Gallardo said he would be meeting with Mayor Weise next week to discuss 
some projects. Supervisor Gallardo commended the County for their partnerships with 
the municipalities.

COMMUNITY ACTION PROGRAM SERVICES
Approve financial Amendment No. 12 to the Intergovernmental Agreement (Agreement) 
between Arizona Department of Economic Security (DES) and Maricopa County 
administered by its Human Services Department (County). DES provides funding to the
County for administration of Community Action Program Services (Program). The Human 
Services Department administers the Program to provide eligible low-income residents with 
eviction prevention services, rent, and utility assistance.
The purpose of the Amendment is to address as follows: 
A.  In accordance with the Alert issued on June 14, 2024, the initial Itemized Service Budget 
is added for the period of July 1, 2024 through June 30, 2025.
B.  The total value of the budget is $2,814,741.38 as detailed in the attached Itemized Service 
Budget. 
DES contracts with the County on an annual reoccurring, non-competitive basis for service 
delivery of the Community Action program activities. Receipt of the funds from DES does not

employee related expenses. Therefore indirect costs are $72,035.21 and fully recoverable.
Grant revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore, expenditure of the revenues is not prohibited by the budget law. 
This Agreement does not alter the budget constraining expenditures of local revenues duly 
adopted by the Board pursuant to A.R.S. 42-17105. The overall grant budget will be adjusted 
as necessary to accommodate this Amendment through future budget reconciliation.
All terms and conditions of the original Agreement and previously approved Amendments 
shall remain unchanged and in full force and effect. The Amendment shall become effective
on the date of last signature. 
The County contracts with local Cities and Towns to provide services at the local level:
Avondale, Surprise, Tolleson, Scottsdale, Tempe, Buckeye, Guadalupe and Wickenburg. 
The County also contracts with Foundation for Senior Living (FSL) to provide services in the

AMENDMENT TO AGREEMENT WITH NEWTOWN COMMUNITY DEVELOPMENT 
CORPORATION
Approve financial Amendment No. 3 to the Developer Agreement between Newtown 
Community Development Corporation (Developer), a Community Housing Development 
Organization and Maricopa County, administered by its Human Services Department. The 
purpose of the Agreement is for the Developer to acquire and rehabilitate single-family 
homes in Maricopa County’s Urban County or County Islands which will be sold to eligible
low-income first-time homebuyers as part of Newtown Community Land Trust (CLT) 
Program. The County has provided the Developer with U.S. Department of Housing and 
Urban Development (HUD) HOME funds and American Rescue Plan Act (ARPA) funds.
The purpose of the Amendment is to address the following:
A. Extend the Agreement termination date from September 30, 2025, through September 
30, 2026.
B. Update the County Point of Contact.
C. Add Agreement required clauses
D. Revise Administrative Change Order and Addenda clause that authorizes the Chairman 
to review and execute Administrative Change Orders and Addenda.
E. Revise Sections 3 (Work Statement) which addresses the following:
1. Add PY2023 Work Statement to the Agreement, the Developer shall acquire and 
rehabilitate single-family homes in Maricopa County’s Urban County cities or County islands 
and make them available for homeownership by eligible families. The County shall provide
the Developer with $2,130,610.30 for the Work Statement activities. The funding for 
Amendment No. 3 is provided by $1,130,610.30 in HOME funds under ALN 14.239. The 
HOME funds must be fully expended by September 30, 2026. The $1,000,000 in ARPA funds 
under ALN 21.027 is made available through a financial IGA between Maricopa County and
City of El Mirage (C-22-24-096-X-00). These ARPA funds must be fully expended by
December 31, 2025.
2. Revise PY 2022 Work Statement to correctly state five (5) units shall be acquired and 
rehabilitated with HOME funds. 
3. Update the number of units acquired and rehabilitated under 2021 Work Statement from 
3 units to 2 units.
F. Revise Section 4 (Compensation), Paragraph 4.0 (Reimbursement), to address increase 
in the Reimbursement amount.
G. The Agreement funding will increase by $2,130,610.30, for a new Agreement total of 
$5,070,081.51, comprised of $3,290,081.51 HOME funds, $780,000 ARPA funds and
$1,000,00 ARPA funds through an IGA with City of El Mirage.
The Agreement is amended to incorporate the changes contained in this Amendment No. 3. 
All other terms and conditions of the Agreement shall remain the same and unchanged and 
in full force and effect as executed by the Parties. 
This Amendment No. 3 shall be effective upon approval and signature by both Parties.

GRANT ACTIVITIES
Approve a financial Intergovernmental Agreement (“Agreement”) between the Town of 
Wickenburg (“Subrecipient”) and Maricopa County the (“County”) administered by its Human 
Services Department.
The purpose of the Agreement is for the Subrecipient to complete improvements to water 
quality and flow by replacing water main transmission lines and sewer lines. Replacements
will also be made to ageing fire hydrants, curbs, gutters, ramps, and pavement to meet ADA
compliance standards. These improvements will create improvements in the Town’s water 
delivery system and safer sidewalks.

ACCEPTANCE OF 2ND YEAR GRANT FUNDS FROM ARIZONA GOVERNOR’S 
OFFICE FOR YOUTH, FAITH AND FAMILY, DISCRETIONARY FUND, FOR 
WORKFORCE INNOVATION OPPORTUNITY ACT PILOT PROGRAM ACTIVITIES
Approve the receipt of 2nd year grant funds from the State of Arizona, Governor’s Office of 
Youth, Faith, and Family (“GOYFF), Workforce Innovation Opportunity Act (“WIOA”) Grant 
Program –Discretionary Fund, Grant No. GR-WIOA-GOYFF-100123-08 for performance 
period of October 1, 2024 through September 30, 2025. The 2nd year funding amount is 
$500,000 for the delivery of WIOA training activities. 
The purpose of the Grant is to develop and deploy innovative WIOA pilot programs that 
address systematic inequities surrounding access to training that provide participants 
industry recognized credentials upon completion. The Program targets service delivery 
toward populations in Maricopa County most in need, namely Youth, Dislocated Worker, 
Veterans, those deficient in basic-skills and receiving public assistance, in the communities 
of Gila Bend, Wickenburg, Queen Creek and closely surrounding areas. 
The purpose of the 2nd year grant is to continue training programs in the identified 
communities. Activities under this grant are administered by the Human Services 
Department Workforce Development Division Arizona@Work Maricopa County. The 
Program supports a training provider to deliver training in the identified areas. 
As a current recipient of the Arizona Governor’s Office for Youth, Faith and Family, 
Discretionary Fund Grant Program, the County received 2nd year funds through a non-
competitive process. The grant funds are a recurring award. Receipt of the grant funds does
not require future or ongoing contributions by the County at the end of the performance 
period. The Program will leverage existing WIOA training resources to support participants
with wrap-around services for up to 12 months, post-completion of training. The County is 
not required to provide cash or in-kind match.
The Human Services Department provisional indirect rate of 24% by the U.S. Department of
Health and Human Services for FY2025 is for salaries and employee related expenses. The 
2nd year Grant amount is $500,000 of which no costs will be allocated for salaries and ERE.
Indirect costs if any, will be absorbed by the Human Services Department budget. The 
awarded grant funds will be passed through to training providers and are not subject to 
indirect cost recovery. 
The services provided under this grant are not a mandated function but provide a benefit to 
Maricopa County residents by providing career and training opportunities, assistance to job 
seekers, youth, dislocated workers, veterans and to employers that need to fill vacancies. 
Program services help to establish a stronger workforce in the local area.
The County contracts with Maricopa County Community College District to provide industry
recognized training and credentials in the communities listed above.
Grant revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore, expenditure of the revenues is not prohibited by the budget law. 
This Grant award does not alter the budget constraining expenditures of local revenues duly

1. Pursuant to A.R.S. 42-17106, approve acceptance of grant funds from the U.S. 
Department of Justice, Office of Justice Programs, Bureau of Justice Assistance, for the 
Edward Byrne Memorial Justice Assistance Grant (JAG) Program through the City of 
Phoenix.
 
2. Authorize the Chairman of the Board of Supervisors to execute IGA between City of 
Phoenix, Maricopa County and City of Mesa. Because disparity exists between the City of 
Phoenix, Maricopa County and City of Mesa, an IGA is required pursuant to the grant 
application. This IGA includes allocation to City of Phoenix of $961,159 and $253,043 in 
funds reallocated to Maricopa County Office of the Medical Examiner (OME)($95,489) and 
City of Mesa ($157,554). Grant awards are to be expended within four (4) year period of 
time, starting on October 1, 2024 and ending September 30, 2028. The City of Phoenix 
has been designated as the fiscal agent for this consortium and municipalities.
 
3. Authorize Chairman of the Board to sign all documents related to the acceptance of the 
grant funds.
 
4. Authorize OME Administrative Director to sign all non-financial documents related to the 
grant application.
 
5. Pursuant to ARS §42-17106(B), increase the FY 2025 Office of the Medical Examiner 
(D290) Medical Examiner Grant Fund (224) Operating (OPER) revenue and expenditure

The Consent sets forth the approval of modifications to the existing Crown Castle monopole 
communications tower at Lake Pleasant Regional Park.  The construction consists of 
removal of existing microwave on the tower and replace with new microwave for carrier 
AT&T.  The size of the microwave will not change, therefore no change in appearance on 
the tower. This will enhance the wireless communication for recreational users at the Park

2/28/2025.

DEPARTMENT OF HEALTH AND HUMAN SERVICES THRU THE ARIZONA 
DEPARTMENT OF CHILD SAFETY
Approve the acceptance of Tile IV-E federal entitlement funds from the Department of Health
and Human Services thru the Arizona Department of Child Safety in the amount not to 
exceed $3,411,264 for the purpose of supplementing the costs of dependency in Public 
Defense Services. The department began receiving these funds in FY20.  This grant is an 
open-ended entitlement and does not need to be applied for annually. Per the MOU, 75% of
the funding must be invested in dependency to supplement Public Defense Services. The 
other 25% may be used to offset costs to the County. The 25% (approximately $852,816) 
will be used to offset General Fund expenditures.
Also, approve the waiver of indirect costs. Public Defense Services will receive a total of up 
to $3,411,264; at the indirect rate of 15.54%, the indirect costs are estimated at $530,110.43,
all of which will be waived. These indirect costs are not being sought so that the grant funds
can be used for contract attorney costs previously funded by the General Fund. 
The grant award is re-occurring. There are no in-kind match requirements and requires no 
ongoing cash contributions. This entitlement award supplements a mandated function. 
Public Defense Services is the only eligible entity to receive this award.

Approve the Year 2 Notice of Award 5 NH28CE003540-02-00 of grant funds from U.S. 
Department of Health and Human Services, Centers for Disease Control (CDC), “Overdose 
Data to Action: Limiting Overdose through Collaborative Actions in Localities (OD2A: 
LOCAL). Funding is to support efforts to use data to inform activities and programs intended
to decrease nonfatal and fatal drug overdoses, overall and especially among 
disproportionately affected and underserved populations within the community, public safety, 
and healthcare system settings. The total not-to-exceed amount of $2,892,500. The budget 
period for this award is September 1, 2024, through August 31, 2025. The term of the 
agreement is September 1, 2023, through August 31, 2028.   
The grant award is reoccurring and has been awarded to the department in previous years. 
This is a competitive grant. There is no cash or in-kind match required and should the grant 
cease, on-going contributions would not be required. This program is not a mandated 
function but provides a benefit to all citizens, especially those disproportionately affected and
underserved, by decreasing nonfatal and fatal drug overdoses.
MCDPH’s Indirect Rate for FY 25 is 15.79%.  The indirect costs are estimated at $394,443.17
which are fully recoverable.  Departmental indirect rates are re-established at the beginning 
of each fiscal year and the future indirect rates will be collected at the corresponding rates.

Roger Linquist, resident and LD 12 Precinct Committeeman said he did not know a lot 
about this agenda item. He thought that accepting federal money through the Center of 
Disease Control endears the local to the federal by holding us hostage.
Marcy Flanagan, Assistant County Manager, came forward to clarify the grant awarded 
to the Maricopa County Health Department. She said this is a competitive grant and by 
being awarded this grant, it allows Maricopa County financial ability to create and 
execute prevention and treatment programs with regards to drug overdose issues.
Supervisor Galvin asked if drug overdose is a big problem in our County? Ms. Flanagan 
said yes it has been a big problem over the past 10 years. She said it is getting better 
in part because of the grant money being spent on the programs and education.

Approve Amendment 3 to the Intergovernmental Agreement (IGA), CTR062177, between 
Arizona Department of Health Services (ADHS) and Maricopa County by and through its 
Department of Public Health (MCDPH), Office of Community Wellness and Health 
Promotion, provides funding for Immunization Services. The IGA provides voluntary
vaccines to children and adults in accordance with recommendations of the CDC Advisory 
Committee on Immunization Practices (ACIP) to prevent and control Vaccine-Preventable
Diseases (VPD).  
It is mutually agreed that the referenced IGA is amended as follows:
Pursuant to Terms and Conditions, Provision Six (6), Contract Changes, Section 6.1., 
Amendments, Purchase Orders and Changes Orders, the following revision is made under
this Amendment Three (3):
1.1. The Price Sheet is hereby revised and replaced; and
1.2. Exhibit F is hereby revised and replaced.

AMENDMENT TO IGA WITH ARIZONA DEPARTMENT OF HEALTH SERVICES FOR 
DIETETIC INTERNSHIP PROGRAM
Approve Amendment No. 6 to Intergovernmental Agreement (IGA) Contract No. CTR046145
between Arizona Department of Health Services (ADHS) and Maricopa County by and 
through its Department of Public Health (MCDPH) to provide continued funding for the 
Dietetic Internship Program. The price sheet is effective October 1, 2024, through September
30, 2025, for the not-to-exceed amount of $186,726.00. The term of this Agreement is 
October 1, 2019, through September 30, 2025. 
It is mutually agreed that the referenced IGA is amended as follows:
1. Pursuant to Terms and Conditions, Provision Six (6), Contract Changes, Section 6.1., 
Amendments, the following revision is made under this Amendment Six (6): 
1.1. The Price Sheet is hereby revised and replaced.
1.2. Exhibit A – 2 CFR 200.332 is revised and replaced.
This grant award is reoccurring and has been awarded to the department for many years. 
There is no cash or in-kind match required and indirect costs are fully recoverable. Ongoing 
cash contributions will not be required. The grant award is not a mandated function but 
provides a benefit to the citizens by increasing the number of Women, Infant and Children 
(WIC) Registered Dieticians to provide nutrition counseling for the community. The grant 
award is not competitively bid, and the department’s operating budget is not required to
absorb any costs.
The Department of Public Health’s Indirect Rate for FY2024 is 15.79%. Indirect costs are 
budgeted at $25,463.37 which are fully recoverable. Departmental indirect rates are 
reestablished at the beginning of each fiscal year and the future indirect rates will be collected 
at the corresponding rates.
Board Required Information: Grant revenues are not local revenues for the purpose of the 
constitutional expenditure limitation, and therefore expenditure of the revenues is not 
prohibited by the budget law. This Amendment does not alter the budget constraining 
expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105.
The overall grant budget will be adjusted as necessary to accommodate this grant through 
a future reconciliation. Funding for this Agreement is provided by a Grant from ADHS and 
will not affect the County’s general fund.

NOTICE OF AWARD TO ACCEPT SUPPLEMENTAL GRANT FUNDING FROM THE 
CENTER'S FOR DISEASE CONTROL AND PREVENTION FOR EPIDEMIOLOGY AND 
LAB CAPACITY
Approve the Notice of Award (NOA) 6 NU51CK000383-01-01 and acceptance of 
supplemental grant funds from The Center's for Disease Control and Prevention (CDC) in 
the amount not-to-exceed $968,313.00. This grant is to support Epidemiology and 
Laboratory Capacity for Prevention and Control of Emerging Infectious Diseases (ELC). The 
grant award begins on August 01, 2024, and ends July 31, 2029.  The budget period for the
supplemental funds is August 01, 2024, and ends July 31, 2025.   
This grant deviates from County Policy A2505 and does not allow for full indirect cost 
reimbursement, but a maximum of 10%.  The full indirect costs are estimated at $138,996.93
of which $88,028.45 is recoverable and $50,968.48 is unrecoverable.  Program costs not 
covered by the grant will be subsidized by the MCDPH indirect cost pool. Departmental 
indirect rates are re-established at the beginning of each fiscal year and the future indirect 
rates will be collected at the corresponding rates.
This grant is competitive, and it is unknown whether the grant will be awarded again.  It 
should be noted that this grant award has not been awarded to Department of Public Health 
in previous years.  There is no in-kind match requirement, and the grant does not require on-
going cash contributions.  The grant award is not a mandated function but provides a benefit 
to citizens by preventing and controlling emerging infectious diseases.

PARTNERSHIP AGREEMENT WITH ARIZONA FAITH NETWORK
Approve a non-monetary Partnership Agreement (PA) between Maricopa County by and
through its Department of Public Health (MCDPH) and Arizona Faith Network (AFN) 
establishing a collaborative partnership to address environmental Issues. The collaboration, 
as part of the EPA’s Environmental and Climate Justice Community Change Grants 
Program, focuses on building community resilience to extreme heat and poor air quality, 
while enhancing local capacity to mitigate environmental challenges. MCDPH, serving as the 
Lead Applicant, will manage and oversee the project, including the disbursement of federal 
funds, compliance with legal requirements, and decision-making in partnership with AFN.
AFN, as the Statutory Partner, will participate in shared decision-making and support project-
specific activities related to community resilience and pollution reduction strategies. AFN will 
also facilitate public engagement, provide technical expertise, and monitor project outcomes.
Both parties will ensure compliance with data sharing, employment verification, and legal 
obligations, while maintaining flexibility to collaborate with other entities. Dispute resolution 
mechanisms, including negotiation, mediation, and arbitration, are established, and the 
agreement will remain in effect from the date of final signature, until November 20, 2027, 
with options for early termination.

TRADEMARK LICENSE AGREEMENT WITH CENTERS FOR DISEASE CONTROL AND 
PREVENTION
Approve a Trademark License Agreement between the Centers for Disease Control and 
Prevention/ATSDR (PHS) and the Maricopa County Department of Public Health (Licensee)
(MCDPH) outlining the terms under which the Licensee can use the CDC's trademarks. 
MCDPH is granted a non-exclusive, non-transferable, royalty-free license to use, reproduce,
and display the CDC’s trademarks for non-commercial use in connection with jointly 
developed public health and safety messages, as specified in Attachments A and B. Any use
of the trademarks outside of these guidelines requires written consent from PHS. The 
agreement's term is 36 months from August 13, 2024, and can be terminated by either party
under certain conditions.
The agreement also stipulates various standards for the use of the trademarks, emphasizing 
quality and adherence to CDC guidelines. Licensee must seek approval for any content that
will use the trademarks, and such content must not be used for political or commercial 
endorsements, nor can it be defamatory, obscene, or otherwise objectionable. Trademark

ownership remains with PHS, and MCDPH is prohibited from registering any trademarks 
similar to those of PHS.
In terms of termination, either party can terminate the agreement with notice if the other party
is in breach or if legal claims arise regarding the trademark's use. Upon termination, MCDPH
must cease all use of the trademarks and confirm the destruction of any material bearing 
them. Any disputes will be initially appealed to the designated PHS official before pursuing 
other remedies. The agreement also contains clauses for indemnification, assignment, 
partial invalidity, and the entire agreement, ensuring a comprehensive understanding of the 
terms between both parties.

Appendix G (Incorporated Materials). Following the public hearing, the Board is requested 
to adopt the proposed incorporations into the Maricopa County Air Pollution Control
Regulations.
The Maricopa County Air Pollution Control Regulations contain several rules, Rules 360,
370, 371, and Appendix G, which incorporate by reference federal regulations from Title 40 
of the Code of Federal Regulations (CFR). These federal regulations include New Source 
Performance Standards (NSPS), National Emission Standards for Hazardous Air Pollutants 
(NESHAP) and Acid Rain regulations. Every July 1, the U.S. Environmental Protection 
Agency (EPA) codifies revisions made to these federal regulations during the preceding year. 
The purpose of this rulemaking is to incorporate by reference the applicable federal 
regulations as codified on July 1, 2024, and thereby update Rules 360, 370, 371, and 
Appendix G with any revisions made to the corresponding federal rules during the preceding 
year. This is necessary in order to continue to comply with the Maricopa County Air Quality 
Department’s delegated authority from EPA to implement and enforce NSPS, NESHAP, and
acid rain programs in Maricopa County, except for those specific authorities retained by the
EPA. After the rules are adopted by the Board of Supervisors, the MCAQD will request 
delegation authority from the EPA to implement and enforce the federal standards.

AQ-2024-006-RULE 510 (AIR QUALITY STANDARDS)
Set a public hearing, as required by Arizona Revised Statutes (A.R.S.) § 49-479(b), for 
November 6, 2024, at 9:30 a.m. to solicit comments on incorporating the recently revised 
primary annual PM2.5 National Ambient Air Quality Standard (PM2.5 NAAQS) into Maricopa
County Air Pollution Control Regulations, Rule 510 (Air Quality Standards) and the 
associated proposed revision to the Arizona State Implementation Plan (SIP). Following the 
public hearing, the Board is requested to adopt the proposed revision to the rule and to 
approve submission of the revised rule as a revision to the Arizona SIP.
On February 7, 2024, the U.S. Environmental Protection Agency (EPA) revised the primary 
annual PM2.5 NAAQS from 12 micrograms per cubic meter (µg/m3) to 9.0 µg/m3. In 
response to the primary annual PM2.5 NAAQS revision, MCAQD is proposing to revise Rule 
510 to incorporate the new standard of 9.0 µg/m3.  
The purpose of Rule 510 is to establish ambient air quality standards per § 110(a) of the 
Clean Air Act (CAA), which are necessary to protect human health and public welfare. The 
standards implemented in Rule 510 incorporate the NAAQS as codified in 40 CFR 50
“National Primary and Secondary Ambient Air Quality Standards”. States are required to 
submit an infrastructure SIP under Section 110(a) of the CAA that implements, maintains, 
and enforces new or revised NAAQS within three years of the EPA issuing the standard. 
Rule 510 supports the Maricopa County portion of Arizona’s infrastructure SIP.

EXERCISE BLM LAND LEASE AT SAN TAN MOUNTAIN REGIONAL PARK
Approve and execute the Department of the Interior Bureau of Land Management (“BLM”) 
Recreation or Public Purposes Lease for the 6,908.6 acres of land at San Tan Mountain 
Regional Park (“Park”) that is was under a Cooperative Recreation Management Agreement 
(“CRMA”) (C-30-99-014-2-00) until 2013, followed by a contribution of services to manage 
the Park in accordance with the BLM approved Park plan.  The term of the lease is twenty-
five (25) years with a privilege of renewal.
Maricopa County (“County”) originally submitted a lease application on June 1, 1999.  While
pending completion of the BLM’s Lower Sonoran Resource Management Plan, the BLM 
allowed the County to manage the Park through a CRMA through September 9, 2013. On 
November 25, 2013, the BLM accepted the County’s offer of the contribution of services to 
continue management of the Park in accordance with the BLM approved Park plan. On 
September 15, 2021, the County requested the BLM to move forward with the lease 
application.  On July 15, 2024, the BLM received a letter from Pinal County concurring with 
the BLM to enter a lease with the County. On August 13, 2024, the BLM issued a letter 
offering the lease and requested the County sign the lease document.

Chairman Sellers asked the Clerk if there was anything to report regarding Public 
Comment email responses. The Clerk said there were none received. She said there 
were Public Comments slips received from the audience and she delivered them to the 
Chairman.
Don Adams, resident, read a post from Donald J. Trump which generally referenced 
the upcoming elections and skepticism for a fair election.
Kim Baker, resident, said he has delivered a stamped, legal document to the Board and 
wants the Board to do something.
Garrett O’Dell, resident, said this was the first time he has attended a Board meeting. 
Mr. O’Dell said he watches every meeting on YouTube, and he sees the same people 
talking about the same issues. He said he was inspired to come today having watched 
the HBO documentary, Stop the Steal. Mr. O’Dell was incredulous that the controversy  
has gone on for four years without any merit to support it. He asked what the Board is 
going to do about it so it does not happen again with the upcoming election.

Tom Arnold, resident, said he works with City of Phoenix Fire. He read a quote from a 
fellow worker running for Supervisor for District 1, saying he wanted to beat the MAGA 
backed extremist who was also running for the position. Mr. Arnold read another quote 
and concluded by saying he wants to support country over party.
Lezley Shepherd, resident, talked about the social activity of Vice Chairman Galvin. Ms. 
Shepherd stated that she did not believe that he listened to his constituents unless they 
had deep pockets. She is promoting a hand count and the importance of free and equal 
elections. She declared that the country is a Republic and needs to follow the 
Constitution.
Brad Goss, resident, asked the Board if they have upheld the Constitution, because 
citizens are preparing for a hand count for all counties. He stated they need access to 
ballots after the close of voting.
Joe Hopf, resident, talked about the Board upholding the Constitution. The 
Ombudsman guide says the Board can comment when criticized, and the Boards says 
they cannot. He believed the Board is gaslighting the public. He wants free and equal 
elections. 
Stephanie Pleasance, resident, said she is starting to see a pattern of avoidance of 
issues. She criticized the Board for not upholding their oaths, interrupting during 
comments, and other belittling behavior. Ms. Pleasance said she is in favor of free and 
equal elections.
Dan Schroeder, resident, acknowledged the Board is responsible for the day of voting. 
He referenced Executive Order 13-848 and said the Board is guilty of election 
interference. He challenged mail-in voting, chain of custody, and said tabulators can 
change the votes.
Suzette Coggins, resident, said she is recently retired and started going to PC 
meetings. She stated she wants to participate in a hand count. Ms. Coggins talked 
about a variety of issues she thought were a problem in our elections. 
Roger Linquist, resident and LD 12 Precinct Committeeman talked about sobriety and 
the importance of support for those who are addicted. He stated the border issues have 
a lot to do with addiction and we need to close the border and stem the flow of drugs. 
Christina Tyler, resident, said she wants to continue to talk about ADA and her desire 
to speak from home during Board meetings. She wants to have a conversation to assist 
her in getting things done. Ms. Tyler referenced the ARS regarding public comments.
Blue Crowley, resident, talked briefly about the agenda for the upcoming Regional 
Public Transportation Authority (RPTA) meeting. Mr. Crowley said they are scheduled 
to talk about service changes for the bus routes and they have not acted on the 
promises they made in the past. He said better bus service is needed throughout the 
valley.

a subject they choose rather than a subject that someone else chooses.

This item is located in Supervisory District #3. 
On June 24, 2024, FCD parcel FP-016-EX was sold at public auction to the highest bidder 
for the final bid of $71,000.00. The Board of Directors approved of this sale on July 24, 2024 
(C-69-25-003-X-00). On August 23, 2024, the winning bidder opted to cancel the sale. 
Pursuant to Paragraph 7 B. of the signed Purchase Agreement “Upon default, Buyer 
acknowledges Seller may then offer to sell the Property to the second highest bidder at the 
price bid by the second highest bidder, under the terms set for in the Bid Package.” On 
August 27, 2024, the second highest bidder agreed to the sale at the second highest bid of 
$66,000.00.
The District utilizes its Disposition Program on all excess properties to evaluate them for the 
best potential of sales or leasing, depending on current market conditions. This parcel was 
acquired as part of the Floodprone Properties Assistance Program project and declared 
excess to the needs of the District on May 23, 2012 (C-69-12-068-8-00). The property is 
being sold to Victor Yovany Montes Juarez and Anaida Nevarez Rojo.
