Chairman Sellers called the meeting to order and asked the Clerk to call the roll.

The Board of Supervisors of Maricopa County, Phoenix, Arizona, convened in Formal Session at 
9:30 AM on Wednesday, May 22, 2024, in the Supervisors' Auditorium 205 W. Jefferson Phoenix, 
AZ 85003, with the following members present:  Jack Sellers, Chairman, District 1;  Thomas Galvin,

INVOCATION - INVOCACIÓN
Chairman Sellers asked Supervisor Gallardo to introduce his guest who would offer the 
invocation and lead the pledge. Supervisor Gallardo introduced his guest, Arelia Henry, 
Gila Bend Fire Department Chief.

PLEDGE OF ALLEGIANCE - JURO FIDELIDAD A LA BANDERA
Chief Henry led the Pledge of Allegiance to the flag. 
Supervisor Gallardo thanked Chief Henry and said he met Chief Henry in 2001. He 
spoke about the tragic flood that devasted the Town of Gila Bend and how the 
community came together. Supervisor Gallardo noted Chief Henry has 14 years of 
service with the Gila Bend Volunteer Fire Department and a true leader in the Town of 
Gila Bend.

PET SHOWCASE BY MARICOPA COUNTY ANIMAL CARE AND CONTROL -

Kim Powell introduced Missy, a four-year-old mixed breed dog that was surrendered by 
her family when their living situation changed. Ms. Powell said Missy’s previous family 
said she is great with kids and loves all adults. She said Missy is crate and potty trained 
and loves tennis balls. For more information about adoptions, please go to 
Pets.Maricopa.gov.
Chairman Sellers asked the Clerk if there were any announcements or corrections to 
the agenda. 
The Clerk said item 14, Patent Easement Abandonments Road File No. PAB-0236, has 
been continued to the June 12, 2024, Board of Supervisor meeting.

TOM MANOS OUTSTANDING SERVICE AWARD
In April of 2016, the Maricopa County Board of Supervisors created the Tom Manos 
Outstanding Service Award to recognize the legacy of public service left by retired County
Manager Tom Manos. This includes his ability to achieve consensus on the most tenuous of

issues; his service on a local and state level in budget and finance; his tireless work on behalf
of the homeless; his support of regulatory reform; and his unwavering commitment to 
improving the justice system through Smart Justice.

Chairman Sellers said a few words about the Tom Manos Outstanding Service Award. 
He spoke about the history of the award and the qualities that nominees possess as 
public servants in their community. Chairman Sellers noted 12 nominees were selected 
this year from various departments and elected offices. He asked the nominees in 
attendance to stand and be recognized. Chairman Sellers asked Sheriff Skinner to 
come forward and announce the 2024 Tom Manos Award recipient. 
Sheriff Skinner echoed Chairman Sellers words on the history of the Tom Manos 
Award. He explained the qualifications that a nominee must have to be recognize for 
the award. Sheriff Skinner announced the recipient, Deputy Michael Martinez, Maricopa 
County Sheriff’s Office. He said Deputy Martinez has been a Deputy Sheriff for over 19 
years and is currently assigned as an Advance Training Officer in the Training Unit and 
Field Training Coordinator for the agency. Sheriff Skinner said Deputy Martinez has 
met with multiple law enforcement agencies across the valley, conducting research to 
compare training programs. Deputy Martinez found opportunities for the agency to 
improve their training program through enhanced partnerships and advanced 
technology, and most importantly to align with 21st Century Policing standards. Sheriff 
Skinner noted the standards are best practices designed to help the agency promote 
effective crime reduction while improving public trust and safeguarding the officer’s 
wellbeing. Sheriff Skinner named the six pillars of the 21st Century Policing model. The 
changes that Deputy Martinez helped advocate for were in line with the community 
expectations. He said off duty, Deputy Martinez was involved in public events to 
enhance community engagement in the small Town of Aguila. Sheriff Skinner cited 
several examples and the positive impact the events had on the community. Sheriff 
Skinner congratulated Deputy Martinez and thanked him for his service to the 
community, the county, and to the Sheriff’s Department. Chairman Sellers asked the 
Board and guests to come forward for pictures.
Vice Chairman Galvin congratulated Deputy Martinez for his service to the County and 
thanked Sheriff Skinner for his leadership. He spoke about the great work and sacrifice 
of all Deputy Sheriffs in Maricopa County.
Supervisor Hickman talked about the importance of having the presence of Deputies in 
the Town of Aguila. He thanked Deputy Martinez for showing the Town of Aguila love 
and compassion. Supervisor Hickman talked about the Tom Manos Service Award, 
community service, leadership, and the importance of public service. 
6.
RECOGNITION OF THE RISK MANAGEMENT DEPARTMENT FOR THE SELF-
INSURED PUBLIC EMPLOYER AWARD
Maricopa County was honored with the Self-Insured Public Employer Award from the
Industrial Commission of Arizona on May 13, 2024, for being the best Self-Insured Public 
Employer.

Chairman Sellers asked Supervisor Gates to introduce this item. 
Supervisor Gates said he was honored to join the Maricopa County Risk Management 
Department at the Industrial Commission of Arizona. He said this is a government body 
that helps protect County employees if they are injured on the job.  Supervisor Gates 
said he was thrilled that the Risk Management Department received the Self-Insured

Public Employer of the Year award. Supervisor Gates explained some of the criteria 
that the Industrial Commission of Arizona looked at for this award. Chairman Sellers

Request: Military Compatibility Permit (MCP) with a Plan of Development (POD) for equine 
therapy uses. Per Arizona Revised Statutes the proposed land use has been deemed to be 
compatible and consistent with the high noise or accident potential zone of a Military Airport
or Ancillary Military Facility.
Site Location: Generally located north of the NWC of North 156th Ave and West Myrtle in 
the west Glendale area
Commission Recommendation:  On 4/25/24, the Commission voted 6-0 to adopt a motion 
recommending the Board of Supervisors approve MCP2023011 subject to conditions ‘a’ –
‘f’:
a. Development of the site shall be in substantial conformance with the site plan entitled 
“Hope Community Services Equine Therapy“, consisting of 1 full-size sheets, dated 1/23/24,
except as modified by the following conditions.
b. Development of the site shall be in substantial conformance with the narrative report 
entitled “HOPE COMMUNITY SERVICES FARM LOCATION”, consisting of 6 pages, dated 
11/22/23, except as modified by the following conditions.
c. The following Planning Engineering conditions shall apply: 
1. Area of new disturbance must be provided with the grading & drainage plans submitted 
for building permit. If more than 1.0 acres is newly disturbed, a SWPPP will be required.
2. Fence detail(s) must be provided with building permit submittal.
3. Final design plans must show how all onsite runoff is routed to the retention basins.
4. Engineering review of planning and/or zoning cases is for conceptual design only. All 
development and engineering design shall be in conformance with Section 1205 of the
Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain

layout may be necessitated by the final engineering design of the drainage infrastructure.
6. Detailed Grading and Drainage (Infrastructure) Plans must be submitted with the

d. All buildings will be subject to noise attenuation as per ARS § 28-8482(B) and Maricopa 
County requirements. 
e. Prior to issuance of a building permit, written confirmation will be required from the 
emergency fire protection jurisdiction having authority that the facility has been designed in 
accordance with their regulations and requirements, and that emergency fire protection 
service will be provided to the facility. Prior to issuance of the certificate of occupancy, local 
fire protection jurisdiction review and approval will be required.
f. The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner.  The granting of this approval allows the property to enjoy 
uses in excess of those permitted by the zoning existing on the date of application, subject 
to conditions.  In the event of the failure to comply with any condition, the property may be 
considered for reversion to the zoning that existed on the date of application per Maricopa 
County Zoning Ordinance procedures.  It is, therefore, stipulated and agreed that revocation
does not reduce any rights that existed on the date of application to use, divide, sell or 
possess the property and that there would be no diminution in value of the property from the
value it held on the date of application due to such revocation of the MCP. The MCP 
enhances the value of the property above its value as of the date the MCP is granted and 
reverting to the prior zoning results in the same value of the property as if the MCP had never
been granted.

Site Location:  Generally located at the NEC of the intersection of Watermelon Rd. and Old
US Hwy 80
Commission Recommendation:  On 4/25/24, the Commission voted 6-0 to adopt a motion 
recommending the Board of Supervisors approve Z2023137 subject to conditions ‘a’ – ‘h’:
a. Development of the site that be in substantial conformance with the site plan entitled 
“Yellow Bell Solar” consisting of 21 full-size sheets, dated February 9, 2024, and stamped

received March 29, 2024, except as modified by the following conditions. Staff may 
determine slight refinements to remain in substantial conformance with the approved site 
plan. Minor and major amendments to the site plan will be determined in accordance with 
Chapter 3 of the Maricopa County Zoning Ordinance.
b. Development of the site shall be in substantial conformance with the narrative report 
entitled “Narrative Report for Yellow Bell Solar”, consisting of 13 pages, dated February 26,
2026, and stamped received February 29, 2024 except as modified by the following 
conditions.
c. The following Planning Engineering conditions shall apply:
 
1. The concentrated inflow locations at the east end of the solar fields east of the Gila Bend 
Canal may warrant redirection to avoid conflict with the solar field grading. These locations 
are generally shown at those depicted as 404 washes and at locations where the floodplains 
extend east from the canal. These areas shall be further evaluated with the final design.
2. On-site retention basins shall be designed to contain overflows/spillways designed to
accommodate the unattenuated peak 100 year inflow to each respective basin, inclusive of 
offsite flows.
3. Detailed grading and drainage plans shall be submitted with building permit application(s) 
indicating that runoff from each solar field area will be directed to a retention basin. 
Diversions may be required to direct flow towards the retention basins as part of the final 
design.
4. The site contains area of regulated floodplains (FEMA Zone AO2) along the Gila Bend 
Canal. Disturbance of the floodplains will require procurement of a floodplain use permit prior
to or concurrent with building permits. Inverter pads located in a floodplain shall be elevated 
to the Regulatory Flood Elevation. 
5. Preservation of 65’ of R/W on both sides of Old US 80 (measured from the centerline) will
be required. The preservation area must be shown on the plans submitted for building 
permit(s).
6. Private utilities that will occupy County R/W (Old US 80) or other County property require 
a solar license in addition to any construction related permits. The solar license must be 
effectuated prior to issuance if building permit(s).
7. Prior to building permit approval, all the proposed construction access points approved on
the US 80 under MCDOT jurisdiction, a driveway right-turn deceleration lane shall be 
provided due to anticipated high speeds on US 80 and anticipated heavy vehicle usage for 
the proposed facility. A minimum 160 feet of storage length and an opening taper rate of 15:1 
(L:W) shall be provided as per MCDOT Standards. The developer shall coordinate with 
MCDOT’s Planning Branch to identify such proposed construction access point(s) on OLD 
US 80 that fall under County jurisdiction. 
8. The developer shall coordinate with MCDOT’s Planning Branch who shall approve the
final design for the canal crossing near driveway “F”.
9. Engineering review of planning and/or zoning cases is for conceptual design only. All 
development and engineering design shall be in conformance with Section 1205 of the
Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain 
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current 
engineering policies, standards and best practices at the time of application for construction.

10. There appears to be public or private irrigation facilities located on or adjacent to this 
project site. Certain entities may have rights to work in or use said facilities. There may be 
public or private rights associated with the historical conveyance of water within said 
irrigation facilities which Maricopa County does not regulate. It will be the applicant’s sole 
responsibility to ensure the integrity of any irrigation rights. Any disputes that may arise with
respect to any irrigation rights are a civil matter that will not involve Maricopa County.
11. Based on the conceptual design nature of the information submitted, changes to the site
layout and/or a reduction in the number of solar arrays may be necessitated by the final 
engineering design of the site’s drainage infrastructure.
d. The following IND-2 IUPD Zoning District standards shall apply:
1. Maximum Electric Transmission Line Height – 150’
2. Parking Spaces Required – None required 
3. Loading & Unloading Spaces Required - None required 
4. Landscaping – No landscaping strip required
5. Sight Visibility Triangles – No sight visibility triangles are required at project site 
entry/access points and road intersection, section line, mid-section line or alignment corners
6. Article 902.91 – All utility uses shall be permitted to be conducted outdoors
7. Site Enclosure and Screening – Chain-link fencing and gates are permitted around the 
perimeter of the site boundaries except that opaque chain-link fencing with vinyl slats shall 
be required along any property line abutting a residential zoning boundary
8. Pavement Required – Pavement not required for parking spaces with approval of a dust 
control plan by Maricopa County Air Quality Department. 
9. Light Pole Height – 30’ maximum from grade
e. The IND-2 IUPD shall limit the use of the site exclusively to a solar electric generating 
facility and ancillary uses. Any other uses shall require a Zone Change Major Amendment.
f. The owner or developer shall receive approval of a traffic statement for construction in 
accordance with the comments received by ADOT in an email dated November 29, 2023. 
g. The property owner/s and their successors waive claim for diminution in value if the County
takes action to rescind approval due to noncompliance with these conditions or other 
Maricopa County regulations. 
h. The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner.  The granting of this approval allows the property to enjoy 
uses in excess of those permitted by the zoning existing on the date of application, subject 
to conditions.  In the event of the failure to comply with any condition, and at the time of 
expiration of the Zone Change, the property shall revert to the zoning that existed on the 
date of application.  It is, therefore, stipulated and agreed that either revocation due to the 
failure to comply with any conditions, or the expiration of the Zone Change, does not reduce 
any rights that existed on the date of application to use, divide, sell or possess the property 
and that there would be no diminution in value of the property from the value it held on the 
date of application due to such revocation or expiration of the Zone Change.  The Zone

Commission Recommendation:  On 4/25/24, the Commission voted 6-0 to adopt a motion 
recommending the Board of Supervisors approve Z2024010 subject to conditions ‘a’ – ‘k’:
a. The initial Plan of Development shall be developed in substantial conformance with the 
Site Plan entitled “Harquahala Sun Site Plan” consisting of 17 full-size sheets, dated March 
1, 2022, and stamped received March 1, 2022, except as modified by the following 
conditions. Staff may determine slight refinements to remain in substantial conformance with
the approved site plan. Minor and major amendments to the site plan will be determined in 
accordance with Chapter 3 of the Maricopa County Zoning Ordinance.
b. Development of the site shall be in substantial conformance with the Narrative Report 
entitled “Harquahala Sun Narrative Report”, consisting of 14 pages, dated February 25, 
2021, and stamped received March 1, 2022 except as modified by the following conditions.
c. The following Planning Engineering conditions shall apply:
 
1. At the time of application for building permits, the plans or a drainage exhibit must identify 
(quantity) offsite flows entering the site,
2. At the time of application for building permits, retention basin design for basins located in 
a floodplain must be revised to provide excavated basins.
3. Retention basin volumes must be sized for the 100 year, 2 hour storm event. Retention 
basins must drain within 36 hours. 
4. At the time of application for building permits, the weighted runoff coefficient to size 
retention basins must be verified and be based on C=0.95 for the panels, C=0.88 for gravel 
access roads; and C=0.5 for unimproved areas.
5. At the time of application for building permits, detailed grading and drainage plans must 
show diversions necessary to direct flows from solar development site to a retention basin. 
No flow from the solar development site shall be permitted to flow directly offsite (unretained).
6. Electrical equipment, including inverters must be elevated to be at or above the regulatory
flood elevation for each respective flood zone; or otherwise floodproofed.

7. Work with the floodplains will require a floodplain use permit issued concurrent with the 
building permits.
8. Extension of the gen-tie across FCDMC owned properties will require procurement of a 
Flood Control District R/W permit.
9. Extension of the gen-tie within County (MCDOT) right-of-way may require procurement of
a lease or license to occupy the right-of-way.
10. Driveways C and D along 491st Avenue, south of Courthouse Road must align.
11. The following R/W dedication and preservation will be required. R/W dedication must 
occur prior to issuance of building permits.
Dedication:
491st Avenue – 40’ half width (80’ full) right-of-way for a collector roadway
Preservation:
483rd Avenue – 40’ half width right-of-way 
499th Avenue – 65’ half width right-of-way 
Courthouse Road – 65’ half width right-of-way 
12. Based on the conceptual design nature of the information submitted, changes to the site
layout may be necessitated by the final engineering design of the site’s drainage 
infrastructure.
13. Detailed Grading and Drainage (Site Infrastructure) Plans must be submitted with the
application for Final Plat Approval and Building Permits.
14. Engineering review of planning and/or zoning cases is for conceptual design only. All
development and engineering design shall be in conformance with Section 1205 of the
Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain 
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current 
engineering policies, standards and best practices at the time of application for construction.

e. The applicant shall route their plans through the Department of Defense (DOD) siting 
clearinghouse process in accordance with the letter from Luke Air Force Base dated

November 1, 2021. Based on those findings, a revised site plan shall be submitted in 
accordance with condition ‘a’ if required.
f. The Owner or Developer shall address and respond to all recommendations of the Arizona
Game and Fish Department (AZGFD) included in the letter dated February 24, 2022 at the 
time of construction permitting.  The response shall be sent to AZGFD for review and 
consideration.  The Zoning Inspector and/or their designee shall review the applicant’s 
response, and any subsequent comments received from AZGFD, to determine whether the 
response issued by the Owner or Developer addresses AZGFD comments in good faith. 
Should the Zoning Inspector and/or their designee decide that the Owner or Developer has 
not substantially addressed AZGFD comments in good faith, the Owner or Developer shall
be required to propose and implement alternatives to the recommendations made by 
AZGFD.
g. The Owner or Developer shall receive approval of a Cultural Resource Survey accordance
with the comments received by AZSHPO in the letter dated July 8, 2021 prior to the issuance
of building permits.
h. The IND-2 IUPD shall limit the use of the site exclusively to a solar electric generating 
facility including ancillary offices and ancillary uses.  Any other site uses shall require a Zone
Change Major Amendment.  
i. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a 
revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. 
j. The property owner/s and their successors waive claim for diminution in value if the County
takes action to rescind approval due to noncompliance with conditions. 
k. The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner.  The granting of this approval allows the property to enjoy 
uses in excess of those permitted by the zoning existing on the date of application, subject 
to conditions.  In the event of the failure to comply with any condition, and at the time of 
expiration of the zone change, the property shall revert to the zoning that existed on the date
of application.  It is, therefore, stipulated and agreed that either revocation due to the failure

IMPACT STATEMENT HEARING FOR THE PROPOSED LAS PALMARITAS 
IRRIGATION WATER DELIVERY DISTRICT
Pursuant to A.R.S. § 48-261 and § 48-263, convene the scheduled public hearing on the
impact statement for the proposed Las Palmaritas Irrigation Water Delivery District.
The Board of Supervisors will hear those who appear for and against the proposed district 
and shall determine whether the creation of the district will promote public health, comfort, 
convenience, necessity, or welfare.
If the Board determines that the public health, comfort, convenience, necessity, or welfare 
will be promoted, it shall approve the district impact statement, a bond of $250, and authorize
the persons proposing the district to circulate petitions within the following proposed
boundaries of the district: 
Lots 1 through 5, Lots 7 through 12, Lots 14 through 19, and Lots 22 through 31, of LAS 
POMARITAS, a Subdivision of LOT 3 of Section 31, Township 3 North, Range 3 East, of the
Gila and Salt River Base and Meridian according to the Plat of Record in the Office of the 
County Recorder of Maricopa County, Arizona, Recorded in Book 43 of Maps, Page 25;

Lezley Shepherd, resident, talked about the absence of full language and supporting 
documentation for this agenda item.  
Supervisor Gates stated this is a good opportunity to talk about IWDDs and the notice 
that was provided to the residents who are affected by the formation of these irrigation 
districts. 
Juanita Garza, Clerk of the Board, clarified that supporting documents for the agenda 
item are available when the final agenda is posted on the website 24 hours in advance. 
Supervisor Gates explained that Irrigation Water Delivery Districts (IWDD) deal with 
small areas or neighborhoods to help provide residents an equitable cost for irrigation 
water to areas that need it or want it. The County provides additional notices to 
surrounding people who live in those areas. 
The Clerk noted item 10 is just a hearing to approve the impact statement and authorize 
the people to circulate a petition. She said the IWDD has not yet been formed.

initial cost to Maricopa County.  Cost of maintenance moving forward is typical of roadway 
maintenance cost and will be the responsibility of Maricopa County.  The cost of roadway 
maintenance provides a benefit to the traveling public.

The Board action will result to add 0.0011 square miles to County ownership and enable the
County to assume responsibility for road maintenance.

Authorize the Community Solutions Funding Proposal request for the purchase and 
installation of drinking water fountains for McDowell Mountain Regional Park, in the amount 
of $73,731.70 with an expected start date of May 20, 2024, and an expected end date of 
June 17, 2024.
The Board of Supervisors’ Community Solutions Funding (CSF) is primarily intended to cover 
the cost of initiatives that carry the potential of advancing Maricopa County’s Strategic Goals
and provide a clear public benefit for Maricopa County residents. The associated Maricopa 
County Strategic Goal is: Regional Services.
Pursuant to A.R.S. 42-17106(B), authorize the following appropriation adjustments to the FY 
2024 budget:
1. Decrease the expenditure authority in the Non Departmental (D470) General Fund (100) 
Non Recurring (NRNP) budget in the line “Community Solutions Funding” (4711) by $73,732.
2. Increase the expenditure authority in the Non Departmental (D470) General Fund (100) 
Non Recurring (NRNP) budget in the line “D2 – Community Solutions Funding” (4762) by 
$73,732.
These actions will have a net zero impact on the County-wide budget and do not alter the 
budget constraining the expenditure of local revenues duly adopted by the Board pursuant

DATA TRANSFER AND USE AGREEMENT BETWEEN MARICOPA COUNTY AND THE 
ARIZONA BOARD OF REGENTS FOR AND ON BEHALF OF ARIZONA STATE 
UNIVERSITY
Approve and request authorization for the Chairman to sign documents related to a non-
financial Agreement with Arizona State University and the Maricopa County Attorney’s 
Office. 
The agreement's purpose is to assist the Maricopa County Attorney’s Office (MCAO) with 
the assessment, evaluation, and building of its new wellness program. ASU’s Dr. 
Stolzenberg, graduate research assistants, and MCAO’s Wellness Trainer will work together 
to conduct focus groups with employees and distribute surveys to employees to assess 
areas of stress for employees that might contribute to negative outcomes such as secondary
trauma and burnout. In addition, Dr. Stolzenberg and MCAO will examine anonymized 
employment records over time to determine whether there is a correlation between the new 
wellness program and overall MCAO retention of employees. Finally, Dr. Stolzenberg and 
MCAO will work to define and describe the core components of the wellness program to help
provide such information to other offices around the country as a potential model to emulate.
Throughout the above work, Dr. Stolzenberg and MCAO will publish relevant findings (as 
approved by both entities) in academic journals and professional outlets (e.g. attorney 
practice guides, conferences for judges and attorneys, etc.).
 
The term of this Agreement shall begin on or about April 1, 2024, and continue for five years 
after the start date, unless extended via modification or terminated by either party in 
accordance with the agreement. 
 
Approval of this item will not impact the County General Fund.

Detention Training Academy. This Agreement allows City of Mesa detention recruits to 
participate in scheduled MCSO Detention Academies at a cost of $250 per registrant as 
space permits. City of Mesa is responsible for providing worker’s compensation insurance, 
salary, benefits, uniforms, and other items for its participants.  The initial 2-year term begins 
July 1, 2024 through June 30, 2026, with automatic renewal of two, one-year terms.  It is

AGREEMENT WITH THE OFFICE OF NATIONAL DRUG CONTROL POLICY (ONDCP) 
FOR THE HIGH INTENSITY DRUG TRAFFICKING AREA (HIDTA) PROGRAM – 
INITIATIVE XXXIV
Approve the Agreement and acceptance of grant funds to the Sheriff’s Office from the Office
of National Drug Control Policy (ONDCP) Award Number G24SA0005A, for the High 
Intensity Drug Trafficking Area (HIDTA) Program, in the amount of $667,152 for the award 
period beginning January 1, 2024 and terminating December 31, 2025. This amount 
represents the total FY 24/25 budget and spending ceiling for this initiative. 
The Maricopa County Sheriff’s Office is the Fiduciary of these funds for the County. The
Maricopa County Sheriff’s Office award amount is $552,125. The Maricopa County 
Attorney’s Office award amount is $115,027. 
The Sheriff’s Office funding award is designated for two separate initiatives: Intelligence 
Initiative (HIDTAISC): $65,552 and Interdiction Initiative (MCDST): $486,573. The total 
indirect cost amount for these two initiatives is $92,315.30 ($10,960.29 and $81,355.01). The
Sheriff Office indirect rate is 16.72% and the indirect costs of $92,315.30 are unrecoverable 
and will be absorbed by the General Fund. The County Attorney’s funding award is
designated for the Investigation Initiative (MISTIC) and its indirect rate is 20.2%. The total 
indirect cost amount for this initiative is $23,235.45 and MCAO will not recover $23,235.45.
This is not a mandated function although it supports the MCSO public safety mandate 
through efforts to reduce illegal drug use with the interruption of drug trafficking. The funding
is recurring and has been awarded to the Sheriff’s Office for over fifteen years. There is no 
matching requirement and there are no future or ongoing contributions required after the 
grant period ends. This is a competitive award.
   
Grant revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore, expenditures of these revenues are not prohibited by the budget 
law.

7517 between Maricopa County and IP BPG City Square, LLC, a Delaware limited liability
company (“Lessor”). This First Amendment allows for reimbursement of additional tenant 
improvements not contemplated in the Lease Agreement in the Amount of One Hundred 
Seventy-One Thousand Seventy-One Dollars and Sixty-Seven Cents ($171,071.67). In 
association with the additional tenant improvements, the First Amendment also extends the 
default period for Lessor’s failure to substantially complete the tenant improvements from 
May 1, 2024 to no later than July 1, 2024. This space will be used by Maricopa County

The County Treasurer’s Office has on deposit National Forest Fees for FY 2023-24 in the 
amount of $319,810.89. The $319,810.89 represents Maricopa County’s share of the 
National Forest Fees Apportionment. These fees will be allocated as described below:

BUDGET ADJUSTMENT FOR THE FY 24 EMPLOYEE BENEFITS TRUST FUND
In accordance with A.R.S. § 11-981 (C), approve the following amendments to the FY 2024 
budget:
a.  Approve an increase to the Human Resources (D310) Benefits Trust Fund (685) 
Operating (OPER) revenue and expenditure appropriation by $5,000,000.
b.  Approve offsetting eliminations to the Eliminations County (D980) Eliminations Fund (900) 
Operating (OPER) revenue and expenditure appropriation by $5,000,000.
Budgeted expenditures in the Benefits Trust can be increased pursuant to A.R.S. § 11-981 
(C), which states that expenditures during the fiscal year from a trust are not subject to the 
provisions of title 42, chapter 17, article 3.
The requested budget adjustments would increase both the revenue and expenditure 
authority for the Benefits Fund (685) by $5 million. There are three major factors that have 
contributed to the increase in expenditures over the budgeted amount:
1) A “return to normal” from pre-pandemic level of claims under $100,000.
2) New specialty drugs launched in 2023 including those for Diabetes were not budgeted for
in Fiscal Year 2024.
3) The 2024 budget revenues (rates) were not increased, which kept expenses artificially 
low.

These premium pay rates apply to the County’s elected offices, appointed departments, 
Judicial Branch of Maricopa County, which receives funding from Maricopa County,  the 
Flood Control District of Maricopa County, and the Maricopa County Library District (Special

a. Extend Competition Impracticable Contract with Sikotar, LLC DBA: Valley Inn
(“Contractor”), Amendment No. 3 (C-22-22-092-X-03/220250), located at 965 East Van 
Buren Street, Phoenix, AZ 85006. The purpose of the Contract is for the County to provide 
non congregate shelter to homeless individuals. Extend term of Contract through December
31, 2024. Increase expenditure limit by $1,180,000.
b. Extend Competition Impracticable Contract with North Black Canyon Hospitality, LLC 
(“Contractor”) Amendment No. 3 (C-22-22-053-X-03/220181), located at 8101 North Black 
Canyon Hwy Phoenix, 85021. The purpose of the Contract is for the County to provide non 
congregate shelter to homeless individuals. Extend term of Contract through September 30,
2024. Increase expenditure limit by $1,510,000.
c. Approve financial Amendment No. 10 to the Agreement with Native American Connections 
(Subrecipient) (C-22-20-058-3-10). The purpose of the Agreement is for the Subrecipient to 
provide bridge shelter services for individuals and families experiencing homelessness in
Maricopa County. The Amendment will extend the term of the Agreement through December
31, 2024. The County shall increase funding by $41,000.
d. Approve financial Amendment No. 13 to the Agreement with Community Bridges, Inc. 
(Subrecipient) (C-22-20-029-3-13). The purpose of the Agreement is for the Subrecipient to 
provide bridge shelter services for individuals and families experiencing homelessness in
Maricopa County. The Amendment will extend the term of the Agreement through December
31, 2024. The County shall decrease funding by $70,694.
e. Approve financial Amendment No. 5 to the Agreement with Human Services Campus, Inc. 
(Subrecipient) (C-22-22-104-X-05). The purpose of the Agreement is for the Subrecipient to 
provide bridge shelter services for individuals and families experiencing homelessness in
Maricopa County. The Amendment will extend the term of the Agreement through February 
28, 2025. The County shall increase funding by $271,488.
Also, authorize the Office of Budget and Finance to make the following adjustments to
revenue and expenditure authority in FY 2025 for the Coronavirus Fiscal Recovery Fund 
(Fund 296) Non-Recurring Non Project (NRNP) budgets in the following departments:
Human Services (D220): $1,767,688
Non-Departmental (D470): ($1,767,688)
Grant revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore, expenditure of the funds is not prohibited by the Budget Law.
Approval of this action does not alter the budget constraining the expenditure of local 
revenues duly adopted by the Board pursuant to A.R.S. §42-17105.

These actions will have a county-wide net impact of zero and they do not alter the budget
constraining the expenditures of local revenue duly adopted by the Board pursuant to A.R.A
42-17105.
The Department’s FY24 administrative expenditures total $8,245,014 with 56% of those 
costs being CSCA, ISF, and other County internal charges to Human Services Department 
(HSD). In FY 2024, CSCA/ISF charges increased by $831,046. Additionally, due to reduced 
grant funding in the Workforce Development Division (2270) and increased program costs in 
Early Education Division (2220) in FY 2024, HSD had to cut 30 positions that resulted in a 
loss of revenue from indirect collection of $468,498. The Department does continue to collect
full indirect (22.2%) on all personnel expenses, which is projected to be $6,235,322 in FY 
2024. However, the additional cost (CSCA/ISF) and reduction in revenue from position 
inactivation (indirect collection) does not allow for a balanced budget. In FY 2024, HSD 
requires additional administrative support in the amount of $700,481, which is the 
Department’s over-baseline request. The Department will continue to explore options to

The not-to-exceed amount is $99,108 per year. The term of this Agreement shall begin on 
date of last signature and shall end on April 30, 2025, unless otherwise amended.
The Department of Health’s indirect rate for FY24 is 15.65%.  This grant deviates from 
County Policy A2505 and does not allow for full indirect cost reimbursement, but a maximum
of 15.00%.  The full indirect costs are estimated at $13,487.35 of which $12,927.17 is 
recoverable and $560.18 is unrecoverable.  Program costs not covered by the grant will be 
subsidized by the MCDPH indirect cost pool. Departmental indirect rates are re-established 
at the beginning of each fiscal year and the future indirect rates will be collected at the 
corresponding rates. 
 This is the first time this grant has been awarded to MCDPH, but it is unknown if it will be 
awarded after the intended term ends.  It is non-competitive and there is no cash or in-kind 
match required.  The services this grant provides are not mandated functions but provide 
valuable benefits to the community. Future or ongoing contributions are not required after 
the grant period ends.
Grant revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This
Agreement does not alter the budget constraining expenditures of local revenues duly 
adopted by the Board pursuant to A.R.S. §42-17105.  The overall grant budget will be 
adjusted as necessary to accommodate this grant through a future reconciliation. Funding 
for this Agreement is provided by state funding through ADES and will not affect the County’s
general fund.

Approve the use of Public Health Opioid Settlement Funds for Naloxone-related supplies, 
Community Training, and Correctional Health Services purchase of narcotic storage and 
dispensing machines dedicated to controlled medications across six correctional facilities. 
This approval shall continue as long as Public Health Opioid Settlement Funds are available.
Funds may be spent as follows:
• Lease of narcotic storage and dispensing machines shall not exceed $100,000 per fiscal 
year. 
• Purchase of naloxone-related supplies shall not exceed $100,000 per fiscal year. 
• Substance use training to support community-based organizations that work with people 
experiencing substance use disorder shall not exceed $100,000 per fiscal year.
This initiative aligns with the county's commitment to addressing the opioid crisis, as outlined
in Goal 3 of the Maricopa County Strategic Plan Fiscal Year 2023-2026. Manual tracking of 
narcotic controlled substances poses a threat to regulatory compliance with the Drug 
Enforcement Agency (DEA) and elevates the risk of diversion within the County Jail system.
To rectify these issues, Correctional Health Services (CHS) aims to implement an onsite 
dispensing solution dedicated to controlled substances. This measure will enhance CHS' 
ability to account for these medications accurately, comply with DEA regulations, and ensure 
timely dispensing as part of the OTP program.

forward and clarify Ms. Baroni’s questions. Ms. Flanagan explained the contract with 
the University of Arizona is to reach out in rural areas and provide different types of 
vaccines. She stated the vaccines are always voluntary if the public want to receive

Approve and execute a Resolution to extinguish three easements that were acquired as part
of the Northern Parkway El Mirage Alternative Access Project.
The Real Estate Department obtained Drainage and Slope Easements for the purposes of 
improving the access along 129th Ave and Butler Drive in connection with the El Mirage
Northern Parkway Alternative Access Project (TT0498).  Since then, the City of El Mirage 
requested Maricopa County relinquish the easements. All parties have agreed to terminate 
the Drainage and Slope Easements therefore releasing the county and city from any future 
maintenance responsibilities.

Chairman Sellers asked the Clerk if there was anything to report regarding Public 
Comment. The Clerk handed the Public Comment speaker forms to Chairman Sellers.
Florence Smith, resident, spoke about the Dominion voting machines and issues that 
occurred. Ms. Smith talked about people committing perjury in Michigan and the voting 
machines being connected to the internet.  
Don Adams, resident, spoke about the State of Georgia’s elections and the types of 
paper used for the 2020 election. 
Dan Schroeder, resident, read an executive order from 2018. Mr. Schroeder spoke 
about the new election facility. 
Tom Arnold, resident, talked about a podcast he had recently listened to on election 
integrity and freedom of speech. He asked the Chairman if the findings from the 2020 
and 2022 election investigation are public information.

Jen Pokorski, County Manager, asked Brooke Worcester, Legal Counsel, to read the 
guidelines on Call to the Public, Public Comment. 
Blue Crowley, resident, spoke about jurisdiction equity. He asked the Board about their 
input in the Regional Public Transportation Authority (RPTA) routings. Mr. Crowley 
asked where the bus routes in rural areas of the County are.  He objected to spending 
funds on security to watch the rails and not on expanding bus route services. 
Ray Michaels, resident, spoke about the budget meeting on 6/24/224 with no public 
comment. He asked who oversees the Board of Supervisors. He spoke about 
accountability, responsibility, and servitude. 
Lezley Shepherd, resident, spoke about a handout on constitutional law and elections. 
Lumar Garza, resident of Miami, Florida, spoke about vaccines, public comments, and 
elections.

Veronica Cocron, resident, spoke about public feedback, the constitution, passports, 
and asked the Board to do the right thing.  
Roger Pickerill, resident, read a quote from a book. He spoke about We the People,

Lauri Baroni, resident, commented on the amount of time allowed to review agenda 
items. She talked about the County budget, and library funding for inappropriate books.

Project; to advertise, select, negotiate, and award contracts for Project engineering and 
construction services as appropriate.  
The Grand Avenue, Olive Avenue, and 75th Avenue Regional Drainage Improvements 
project area is located within the City of Peoria (CITY). The PROJECT is intended to mitigate
the flood hazards in the southwest corner of the intersection of Grand Avenue, Olive Avenue,
and 75th Avenue. The area was the subject of the Glendale/Peoria Area Drainage Master 
Plan (GPADMP) prepared in November 2011. The GPADMP was used as the basis for the 
Peoria Storm Drain Master Plan prepared in 2014 which took a closer look at the existing 
storm drain system and made improvement recommendations to mitigate the flood hazards 
in the southwest corner of the intersection of Grand Avenue, Olive Avenue, and 75th Avenue.
The estimated cost for this Project is $7,706,000 and the PROJECT cost will be shared 
between the DISTRICT and the CITY.  
This Agenda Item impacts Supervisorial District 4.

Adopt Resolution FCD 2024R002 for Hohokam and Laveen Drainage Improvements 
(PROJECT), authorizing the Director of the Flood Control District of Maricopa County 
(DISTRICT) to include funds for Project implementation in the District’s current and future 
Five-Year Capital Improvement Program; to negotiate and prepare Intergovernmental

management and future operation and maintenance of the Project; to advertise, select, 
negotiate, and award contracts for Project engineering and construction services as

The Hohokam and Laveen Drainage Improvements (PROJECT) area is located within the 
City of Phoenix (CITY). Project design, and construction are the next steps for 
implementing the drainage improvements for this area, with the CITY as the lead agency.
The PROJECT consists of the following projects in the Hohokam area;
1) Basin 5 – Circle K Park
2) 14th/15th St. Storm Drain
3) Basin 1 & 16th St/ Ardmore Rd. Storm Drain
4) South Mtn. Ave Storm Drain
5) Basin 11 and Outfall Storm Drain
6) 20th St. / Euclid Ave. Storm Drain
7) 19th St. / S. Mtn. Ave Storm Drain and Wash
8) Basin 10
and, the following projects in the Laveen area;
1) 43rd Ave Conveyance Improvements
2) 15th Ave Conveyance Improvements
3) Lindo Park Storm Drain Connection
4) 35th Ave and Olney Conveyance Improvement
The eight Hohokam area projects were the subject of the Hohokam Area Drainage Master
Plan prepared for the DISTRICT in February 2014. The four Laveen area projects were 
the subject of the Laveen Area Drainage Feasibility Study prepared for the CITY in March 
2022.  The Hohokam Area Drainage Master Plan provided solutions to mitigate the flood 
hazards in the Hohokam area, and the Laveen Area Drainage Feasibility Study provided 
solutions to mitigate the flood hazards in the Laveen area. The estimated cost for this 
Project is $77,857,000 and the PROJECT cost will be shared between the DISTRICT and 
the CITY 65%/35% making the DISTRICT cost share $50.6M.  
This Agenda Item impacts Supervisorial District 5.
