Page 1 of 4 FIRST AMENDMENT TO THE INTERDEPARTMENTAL AGREEMENT AMONG THE MARICOPA COUNTY DEPARTMENT OF TRANSPORTATION AND THE MARICOPA COUNTY FACILITIES MANAGEMENT DEPARTMENT AND THE MARICOPA COUNTY SHERIFF’S OFFICE (C-50-24-007-X-01) This First Amendment to the Interdepartmental Agreement among the Maricopa County Department of Transportation and the Maricopa County Facilities Management Department and the Maricopa County Sheriff’s Office (C-50-24-007-X-00) (First Amendment) is entered into by and among the Maricopa County Department of Transportation (MCDOT), the Maricopa County Facilities Management Department (MCFMD), and the Maricopa County Sheriff’s Office (MCSO), collectively referred to as the Parties or individually as a Party. RECITALS 1. The Parties previously entered into an Interdepartmental Agreement (C-50-24-007-X-00) (IDA). The IDA was effective on August 9, 2023, the date it was approved by the Board of Supervisors. 2. The Agreement consists of MCDOT leasing Office Space and Yard Space, located at 12975 West Bell Road, Surprise, AZ 85374 (Property), to the MCSO. 3. MCDOT has received funding for its facilities and operations through the Arizona Highway User Revenue Fund (HURF), which is subject to Article 9, Section 14 of the Arizona Constitution, which limits the use of HURF monies to highway and street-related purposes. 4. MCSO needs temporary office space to maintain its mandated responsibilities. 5. The Parties desire to further amend the IDA, through this First Amendment, to extend the duration of the agreement and delete Section 4.1. NOW, THEREFORE, in consideration of the foregoing and the covenants herein set forth, the Parties agree as follows: Page 2 of 4 AGREEMENT 6. Section 1 of the IDA is deleted in its entirety and replaced with the following: The term of this IDA shall be from July 1, 2023, through June 30, 2026, unless terminated earlier as provided hereunder. Prorated monthly fee payments set for below shall commence upon MCSO taking possession of Yard Space. 7. Section 4.1 of the IDA is deleted in its entirety. 8. All other conditions of the IDA shall remain in full force and effect. 9. This First Amendment shall become effective as of the date it is approved by the Maricopa County Board of Supervisors and may be filed with the Maricopa County Recorder.
