BETWEEN
CITRUS
ROAD
AND
177TH
AVENUE
CONSISTING
OF
APPROXIMATELY
2.41
ACRES;
PROVIDING FOR AN EFFECTIVE DATE; AND DIRECTING
THE CITY CLERK TO RECORD A CERTIFIED COPY OF
THIS ORDINANCE.
WHEREAS, the subject portion of Olive Avenue was dedicated to Maricopa County on
the Final Plat for Zanjero Pass Parcel 1-3 Phase 2-4 as it appears in the records of the Maricopa
County Recorder’s Office, which was recorded on March 31, 2008 at Docket No. 2008-0281585,
Book 979 Page 26; and
WHEREAS, the Glendale City Council took action to annex the right-of-way on
February 10, 2015, Ordinance No 2928 (AN-197) as it appears in the records of Maricopa
County Recorder’s Office, which was recorded on February 12, 2015 at Docket No. 2015-
0092818; and
WHEREAS, the City of Glendale and Maricopa County have entered into
Intergovernmental Agreement C-64-22-100-X-00 (IGA); and
WHEREAS, per the IGA, the City of Glendale is to deannex portions of Olive Avenue
right-of-way; and
WHEREAS, A.R.S. § 9-471.02(I) and A.R.S. § 9-471.03 provide a method for the
deannexation of right-of-way from a municipality to a county.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GLENDALE as follows:
SECTION 1. That the following described right-of-way is deannexed from the City of
Glendale, and that the present corporate limits are modified to exclude the following described
right-of-way within the present city limits of Glendale:
(See Exhibit A attached and incorporated by this reference.)
SECTION 2. That a copy of this ordinance together with an accurate map of the right-
of-way deannexed from the City of Glendale, certified by the Mayor of the City of Glendale, is
filed in the office of the Maricopa County Board of Supervisors with a request that the Board of
Supervisors set a hearing date as set forth in A.R.S. § 9-471.03.
SECTION 3. That this ordinance becomes effective at the time the Maricopa County
Board of Supervisors orders the deannexation and it is certified by the Clerk of the Board and the
order is filed for record in the Maricopa County Recorder’s Office.
PASSED, ADOPTED AND APPROVED by the Mayor and Council of the City of
Glendale, Maricopa County, Arizona, this 10th day of October, 2023.
