AMENDMENT NO. 1
Arterial Reconstruction of 51st Avenue from Olive Avenue to Cactus Road
(Project Nos. 202112 & 202113, Contract No. C23-0278-1)
This Amendment No. 1 (“Amendment”) to the Professional Services Agreement (“Agreement”) is
made this ______ day of ________, 2023, (“Effective Date”), by and between the City of Glendale,
an Arizona municipal corporation (“City”) and Ardurra Group, Inc., a Florida Corporation, authorized
to do business in Arizona (“Contractor”).
RECITALS
A.
City and Ardurra Group, Inc. (“Contractor”) previously entered into Professional Services
Agreement, Contract No. C23-0278, dated March 14, 2023 (“Agreement”); and
B.
City and Consultant wish to modify and amend the Agreement subject to and strictly in
accordance with the terms of this Amendment.
AGREEMENT
In consideration of the mutual promises set forth herein and other good and valuable consideration,
the receipt and sufficiency of which are hereby acknowledged, the City and Contractor hereby agree
as follows:
1.
Recitals. The recitals set forth above are not merely recitals, but form an integral part of this
Amendment.
2.
Term. The term of the Agreement is unchanged and shall expire on March 14, 2024.
3.
Scope of Work. This amendment includes providing the design and pothoing for all of the
ADA improvements along the roadway for the design phase of the project.
4.
Compensation. The compensation for this Agreement will increase by $158,810.00, for a
new not to exceed amount of $253,375.
5.
Insurance Certificate. Current certificate will expire on June 30, 2024 and a new certificate
applying to the extended term must be provided prior to this date to Materials Management
and the Contract Administrator.
6.
Non-discrimination. Contractor must not discriminate against any employee or applicant
for employment on the basis of race, color, religion, sex, national origin, age, marital status,
sexual orientation, gender identity or expression, genetic characteristics, familial status, U.S.
military veteran status or any disability. Contractor will require any Sub-contractor to be bound
to the same requirements as stated within this section. Contractor, and on behalf of any
subcontractors, warrants compliance with this section.
7.
No Boycott of Israel. To the extent A.R.S § 35-393 through § 35-393.03 are applicable, the
parties hereby certify that they are not currently engaged in, and agree for the duration of the

Agreement to not engage in, a boycott of goods or services from Israel, as that term is defined
in A.R.S § 35-393.
8.
Uyghur Forced Labor Prevention Act (UFLPA). Contractor certifies that it does not
currently, and during the term of this Agreement, will not use:
(a)
the forced labor of ethnic Uyghurs in the People’s Republic of China;
(b)
any goods or services produced by the forced labor of ethnic Uyghurs in the People’s
Republic of China; and
(c)
any contractors, subcontractors or suppliers that use the forced labor or any goods or
services produced by the forced labor of ethnic Uyghurs in the People’s Republic of
China.
9.
Attestation of PCI Compliance. When applicable, the Contractor will provide the City
annually with a Payment Card Industry Data Security Standard (PCI DSS) attestation of
compliance certificate signed by an officer of Contractor with oversight responsibility.
10.
Ratification of Agreement. City and Contractor hereby agree that except as expressly
provided herein, the provisions of the Agreement shall be, and remain in full force and effect
and that if any provision of this Amendment conflicts with the Agreement, then the provisions
of this Amendment shall prevail.

COG Project Nos: Task 1A (202112) & Task 1B (202113)
City of Glendale (City) requested Ardurra prepare sealed sheets for ADA ramp sidewalk and curb
replacements not included in existing contract scope. City provided Adobe pdf with photos and notes
for each of the replacement locations and requested Ardurra prepare/submit contract modification.
Ardurra’s scope of work for the survey and final design services is described in the following tasks:
Project Administration and Progress Meetings
1. Project Meetings: Ardurra will schedule with City Project Manager (PM), representatives and
stakeholders, conduct, and prepare and distribute agenda and minutes for:
a. Kickoff/Strategy Meeting (1): The meeting will overview Ardurra’s project schedule to
complete survey and prepare construction documents.
b. Progress Meetings (3): Meetings will overview and discuss design progress, project’s
technical aspects and action item resolution status.
c. Comment Resolution Meetings (2): Meetings will overview and discuss design progress,
project’s technical aspects and action item resolution status.
2. Project Schedule: Ardurra will prepare, submit, and revise design schedule reflecting NTP,
major design activities, submittal milestones, and anticipated completion dates. Updated
schedule showing completed and in-progress tasks with each monthly invoice.
3. Project Administration: Ardurra will:
a. Perform accounting functions to establish project tasks, subtasks, and billing rates to match
executed contracts.
b. Submit monthly invoice, progress report, and cash flow schedule.
Topographic Survey & Base Mapping
1. Horizontal and vertical control: Ardurra will re-establish and verify project control using NAD 83
Arizona State Plane Central Zone Coordinates and City of Glendale NAVD88 benchmarks.
2. Data Collection: Ardurra will collect supplemental survey of roadway and sidewalk features
including curb, gutter, sidewalk ramps at (53) locations attached to City’s 8/17/23 email.
3. Base Mapping: Ardurra will incorporate supplemental survey and topographic data into existing
AutoCad file of existing surface features.
Design & Plan Production
1. Scoping/Predesign: Ardurra will prepare an Initial and Final Scoping Document. The Scoping
Document will confirm project limits, provide 60% design plans that identify concrete
reconstruction areas.
2. Final Design: Ardurra will:
a. Prepare construction documents in accordance with most current City of Glendale Project
Development Guidelines, MAG Standard Specifications and Details as amended by the City
of Glendale, and other standards such as AASHTO, MUTCD and ASTM.
b. Perform horizontal and vertical calculations to establish concrete replacement locations and
elevations.
c. Prepare ADA compliant details for sidewalk ramps at twenty-one (21) locations
3. Drainage Evaluation: No additional scope resulting from this contract modification.
4. Construction Plans: Ardurra will update current 90% road plans to reflect the concrete sidewalk,
curb/gutter and sidewalk ramp replacement locations and prepare ADA compliant ramp
replacement details. Revised/updated plan sets will be with 60%, 100%, and sealed construction
plans (24” X 36") using AutoCAD Civil 3D (2020) at a scale of 1”=40’ Horizontal and 1”=4’
Vertical. Current set of plans will be added/supplemented as follows:
a. Cover (1 sheet)
b. General Notes and Legend (1 sheet)
c. Geometric Control (2 sheet)
d. Plan/profile sheets (sheet quantity depends on sidewalk and curb replacement locations)
e. ADA ramp details (6 sheets)
Opinion of Probable Cost (OPC) and Special Provisions
1. Prepare and include OPC to update existing OPC with the 60%,100% and sealed submittals.
2. Prepare and include Special Provisions to update existing with the 60%, 100% and sealed
submittals.
a. It is anticipated Special Provisions will be “performance” based description of contractor’s
requirements. Special Provision will describe material, installation and product acceptance
requirements for asphalt pavement, sidewalk, curb/gutter/aprons, ADA ramps, associated
allowances, and pedestrian push button poles.
Allowance: Potholing
1. Ardurra will, after receiving City approval, pothole per a mutually agreed upon plan.
