O23-55 AN ORDINANCE OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY, ARIZONA, AMENDING THE ZONING ORDINANCE OF THE CITY OF GLENDALE, ARIZONA, BY APPROVING ZONING TEXT AMENDMENT ZTA23-01, AMENDING THE ZONING ORDINANCE, ARTICLE 6, SECTION 6.806- PARKING (GLENDALE CENTERLINE OVERLAY DISTRICT) AMENDING THE ZONING ORDINANCE AS FOLLOWS: PROVIDING FOR SEVERABILITY, SETTING FORTH AN EFFECTIVE DATE; AND ORDERING THAT A CERTIFIED COPY OF THIS ORDINANCE IS RECORDED. WHEREAS, the City of Glendale Planning Commission held a public hearing on September 28, 2023, in zoning text amendment case ZTA23-01 in the manner prescribed by law for the purpose of amending various sections of the Zoning Ordinance; and WHEREAS, due and proper notice of such public hearing was given in the time, form, substance and manner provided by law including publication of such notice in The Arizona Republic on September 6, 2023; and WHEREAS, the City of Glendale Planning Commission has recommended to the mayor and the council approval of the zoning text amendment; as aforesaid and the mayor and the council desire to accept such recommendation and amend various sections of the zoning ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GLENDALE as follows: SECTION 1. That the Zoning Ordinance of the City of Glendale, Arizona, Article 6, Section 6.806- Parking is amended to read as follows: 6.806 Parking. A. Due to the pedestrian nature of the Glendale Centerline Overlay District, there are no off- street parking requirements in the Beet Sugar and Historic Downtown character areas for businesses located within this zoning district when development is in conformance with the Glendale Centerline Overlay District rather than the underlying zoning district. DEVIATIONS FROM PARKING REQUIREMENTS MAY BE CONSIDERED ON A CASE-BY-CASE ANALYSIS AS PART OF THE DESIGN REVIEW APPLICATION PROCESS AS NOTED BELOW IN ANY CHARACTER AREA: SPECIFIC HOUSING DEVELOPMENTS THAT SEEK TO REQUEST LOWER PARKING MINIMUMS MAY BE APPROVED ON THE FOLLOWING BASES: o 100 PERCENT AFFORDABLE HOUSING WITHIN ½ MILE OF A TRANSIT STOP WITH FREQUENT TRANSIT SERVICE: THE CITY [Additional are indicated by boldface capital letters, deletions by strikeout.] MAY APPROVE A REQUIREMENT OF 0.5 PARKING SPACES PER UNIT; o 100 PERCENT AFFORDABLE HOUSING FOR SENIORS, WITHIN ½ MILE OF A TRANSIT STOP WITH LOCAL TRANSIT SERVICE OR WITH ACCESS TO PARATRANSIT SERVICE OFFERED BY THE CITY AS PART OF A PROGRAM: THE CITY MAY APPROVE A REQUIREMENT OF 0.5 PARKING SPACES PER UNIT; OR o A PARKING JUSTIFICATION STUDY OR ANALYSIS MAY PROVIDE A BASIS FOR LOWER PARKING MINIUMUMS, AND ANY SUCH STUDY OR ANALYSIS MUST INCLUDE THE FOLLOWING: A COMPARATIVE STUDY BETWEEN THE REQUIREMENTS FOR TRADITIONAL MULTI-FAMILY HOUSING AND AFFORDABLE HOUSING UNITS. TRANSIT OPTIONS WITHIN THE VICINITY OF THE SUBJECT PROPERTY. ACCESSIBILITY TO GENERAL SERVICES/ RETAIL FROM THE SUBJECT PROPERTY. B. Parking Space Dimension. All parking spaces shall be striped with a 10 foot by 20-foot dimension. Handicapped parking spaces shall meet all Americans with Disabilities Act (ADA) standards, as may be amended. (Ord. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof. SECTION 3. That the provisions of this ordinance shall become effective thirty (30) days after passage of this ordinance by the Glendale City Council. SECTION 4. The City Clerk is instructed and authorized to forward a certified copy of this ordinance for recording to the Maricopa County Recorder’s Office.
