Glendale Code Compliance Repeat Offender Ordinance City Council Workshop April 23, 2024 Repeat Offender Ordinance 2 We are seeking Council direction on adopting an ordinance defining a repeat offender as it relates to violations of the Glendale City Code and setting mandatory penalties. Repeat Offender Administrative Policy 3 The repeat offender policy is designed to provide relief for neighborhoods experiencing problems with persons who repeatedly violate city codes, and/or persons who fail to correct city code violations on their property. Repeat Offender Definition 4 A responsible person who has been issued two (2) compliance orders and/or citations at the same property within a twelve (12) month timeframe. The violations must involve the same responsible person at the same address and can include any city code violation within a twelve (12) month period. The repeat offender status will remain in effect for twelve (12) months following the second compliance order or citation. Repeat Offender Definition 5 In addition, a responsible person may also be deemed a repeat offender regardless of the timeframe after having received multiple prior notices, including but not limited to, verbal warnings, courtesy notices, compliance orders, notice of parking violations, notice of violations letters, etc. Repeat Offender Enforcement Process 6 •Repeat Offender Letter sent to Responsible Party •Same Violation – Straight to Citation or File Criminal Charges •Different Violation – Short Notice to Educate •Approx. 40 Repeat offenders in CY 2023 – 11,357 cases resolved Standard Penalties 7 •Civil Code Infraction (City Code) $20-300 Fine Fixed by the Court Unless sanctions are otherwise set by ordinance •Criminal Charges (ARS) Class one Misdemeanor Up to $2,500 Fine Up to six months imprisonment As Fixed by the Court Proposed Ordinance 8 Glendale City Code Chapter 25-22 Repeat Offenders (a) A Repeat Offender is defined as a responsible person who has been issued two (2) compliance orders and/or citations at the same property within a twelve (12) month timeframe. The violations must involve the same responsible person at the same address and can include any city code violation within a twelve (12) month period. The repeat offender status will remain in effect for twelve (12) months following the second compliance order or citation. (b) In addition, a responsible person may also be deemed a repeat offender regardless of the timeframe after having received multiple prior notices, including but not limited to, verbal warnings, courtesy notices, compliance orders, notice of parking violations, notice of violations letters, etc. (c) A person that is a Repeat Offender of any violation of this Chapter is subject to a civil sanction of not less than four hundred dollars ($400.00) nor more than one thousand dollars ($1000.00).
