i. The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to enjoy
uses in excess of those permitted by the zoning existing on the date of application, subject
to conditions. It is, therefore, stipulated and agreed that either revocation due to the failure
to comply with any conditions, or the expiration of the SUP, does not reduce any rights that
existed on the date of application to use, divide, sell or possess the property and that there
would be no diminution in value of the property from the value it held on the date of
application due to such revocation or expiration of the SUP. The SUP enhances the value
of the property above its value as of the date the SUP is granted and reverting to the prior
zoning results in the same value of the property as if the SUP had never been granted.

k. The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to enjoy
uses in excess of those permitted by the zoning existing on the date of application, subject
to conditions. In the event of the failure to comply with any condition, and at the time of
expiration of the SUP, the property shall revert to the zoning that existed on the date of

GRANT FROM THE DEPARTMENT OF EMERGENCY AND MILITARY AFFAIRS FOR
VICTIM ADVOCACY, SERVICES, AND TRAINING
Approve the application and acceptance of grant funds from the Department of Emergency
and Military Affairs for the Anti-Human Trafficking Grant Fund for $457,554.22
These grant funds are intended to be used exclusively to reimburse expenditures related to
human trafficking, including court advocacy, direct services for survivors, staff training, and
community awareness and prevention activities.
This grant agreement commences on October 1, 2022, and will terminate on June 30, 2027.
The Maricopa County Attorney’s Office's indirect rate for FY24 is 20.20%; the grantor allows
for up to 10% indirect cost recovery, but due to budget constraints, $13,036.85 was provided
for in this award. Total grant indirect costs are estimated to be $13,036.85 recoverable, and
$76,755.66 is not recoverable. This grant is a new grant for the Maricopa County Attorney’s
Office and is not reoccurring. There is no expectation of continued funding. There is no match
requirement. No future contributions are required with this funding.
Authorize the Chairman of the Board of Supervisors, or designee, to sign all documents
related to this award.
This grant provides funding for a victim advocate within MCAO so they may work to ensure
victims of human trafficking crimes receive the services mandated by the Arizona
Constitution and the Crime Victim’s Bill of Rights and the ability to contract to provide direct
victim services to human trafficking survivors and staff training to investigate and prosecute
human trafficking cases effectively, and community awareness to better recognize and
prevent human trafficking. The grant award is competitive, and other eligible agencies may
or may not apply for funding.
Funding for this agreement is provided by a Grant from the Arizona Department of
Emergency and Military Affairs with funds appropriated through Arizona Revised Statutes
26-106, which established the Anti-Human Trafficking Grant Fund. House Bill 2862, Section
110 allocates funding. Grant revenues are not local revenues for the purpose of the
constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited
by the budget law.

ACCEPT TITLE II AND I-D GRANT FUNDS FROM THE ARIZONA DEPARTMENT OF
EDUCATION FOR THE JUVENILE DETENTION EDUCATION PROGRAM
Accept $642,479.18 in Title I-D and $4,572.91 in Title II FY2023 grant funds from the Arizona
Department of Education for the juvenile detention education program. The term of this grant
funding is 7/1/2022 through 7/1/2023. The purpose of these grants is to provide prevention

and to support effective instruction to increase student achievement.
These grants help fulfill mandated services to educate children in the County’s juvenile
detention center. There are no matching or ongoing cash contribution requirements; and this
award is non-competitive, legislative, and formulaic. Although the School Superintendent’s
Office has an approved FY2024 indirect cost rate of 1.43% (equating to $9,252.84 in

passing the grant monies on to the accommodation school through which the detention
education program operates. There are no costs that will need to be absorbed by the
MCSSO’s operating budget.

Roger Pickerill, resident, said he was concerned with what the “High Intensity Drug
Trafficking Area” funding is used for. He said he thought border security would reduce
the drug trafficking and why doesn’t the Board promote a closed border.
Supervisor Hickman asked if Mr. Prindiville, Chief Financial Officer (CFO), Maricopa
County Sheriff’s Office, was available to answer a question. Mr. Prindiville came forward
and was asked what do the funds go toward? Mr. Prindiville said the money goes
toward a variety of task force efforts and, for security reasons, was not at liberty to
discuss details in a public setting. Supervisor Hickman acknowledged the comments.
Karni Rusaved, public, spoke about the open border issue and the Board not on record
opposing it. She asked about where the money is being used in “high intensity drug
traffic areas”. Vice Chairman Galvin asked Ms. Rusaved if she wanted the drug cartels
to know where law enforcement is operating? She responded that, no, she did not.

MOA WITH CITY OF PHOENIX

commitment for Maricopa County to join a coalition, led by the City of Phoenix, to apply for
federal funding for the Phoenix-Mesa-Chandler metropolitan statistical area (MSA).

recoverable indirect cost is $2,016.00.

contributions are not required after the grant period. The grant award is not a mandated
function but provides a benefit to the citizens by training and educating our Medical
Examiners. The grant award is non-competitive. There are no costs that will need to be
absorbed by the department’s operating budget.

Upon receipt of funds and pursuant to ARS §42-17106(B), approve revenue and expenditure
appropriation adjustments to the Office of the Medical Examiner (D290) Medical Examiner
Grant Fund (224) Operating (OPER) associated with the grant in the amount of $3,500 for

expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget
law. This budget adjustment does not alter the budget constraining the expenditure of local
revenues duly adopted by the Board pursuant to A.R.S. §42-17105.

to finance $400 million to help families with single family homes?
Jen Pokorski, County Manager, asked the Clerk if Shelby Scharbach, Industrial

Ms. Scharbach was not available to speak on this matter.
The Board returned to item 76 after other business was completed. Ms. Pokorski said
the bonds are independent IDA funding streams and confirmed the money is not
taxpayer money. Ms. Pokorski explained that the IDA has a separate Board of Directors
and Ms. Scharbach is the Executive Director that reports to the IDA Board. The IDA

RESOLUTION FOR WATSON DRIVE AND BONARDEN LANE
Adopt Resolution FCD 2024R001 for Watson Drive and Bonarden Lane (PROJECT),
authorizing the Director of the Flood Control District of Maricopa County (DISTRICT) to
include funds for Project implementation in the District’s current and future Five-Year Capital
Improvement Program; to negotiate and prepare Intergovernmental Agreements for cost
sharing, rights-of-way acquisition, design, construction, construction management and future
operation and maintenance of the Project; to advertise, select, negotiate, and award
contracts for Project engineering and construction services as appropriate.
The Watson Drive and Bonarden Lane (PROJECT) area is located within the City of Tempe
(CITY). Project construction is the next steps for implementing the drainage improvements
for this area, with the CITY as the lead agency. The PROJECT consists of installing a 24”
RCP storm drain connection along the abandoned El Paso Gasline Trail from Rural Road to
Forest Avenue in order to increase the storm drain capacity and create ponding relief. The
area was the subject of the Tempe Storm Drainage Management Study prepared for the
CITY in June 2019. The Tempe Storm Drainage Management Study provided solutions to
mitigate the flood hazards in the area of Watson Drive and Bonarden Lane. The estimated
cost for this Project is $2,700,000 and the PROJECT cost will be shared between the
DISTRICT and the CITY 65%/35% making the DISTRICT cost share $1,755,000.
This Agenda Item impacts Supervisorial District 1.
